Billionaire Elon Musk said Tuesday he will move the headquarters of private company SpaceX and social media site X from California to Texas, calling Governor Gavin Newsom's decision to sign a new law on student gender identity “the last straw.”

The law, signed Monday, prevents school districts from requiring teachers to inform parents of changes in a student's gender identity or sexual orientation without the child's consent. It also requires the state Department of Education to provide resources for families of LGBTQ+ students in seventh grade through high school.

“This is the last straw,” Musk wrote on X. “Because of this law and many others before it that attacked both families and businesses, SpaceX will now be moving its headquarters from Hawthorne, California to Starbase, Texas.”

Elon Musk said SpaceX will move its headquarters to Texas. REUTERS

Musk added that he “made it clear to Governor Newsom about a year ago that laws like this would force families and businesses to leave California to protect their children.”

In another post, the billionaire added that the headquarters of X, the social media site formerly known as Twitter, will be moving from San Francisco to Austin, Texas.

“I'm tired of dodging gangs of violent drug addicts just to get in and out of the building,” Musk wrote on X.

Critics argue that the bill is too invasive and undermines parents' rights. One group opposing the bill, the California Family Council, said it “undermines their fundamental role and puts boys and girls in potential danger.”

Meanwhile, supporters said the bill would provide necessary protections for transgender students whose parents live in disapproving households. The law takes effect in January.

In a separate response to an X post by “All In” podcast host Jason Calacanis, Musk said the law would cause “many families and businesses to move out of California.”

“Who would want to risk having their children taken away from them by the government?” Musk said.

Nicolas Dromard has worked his way up from ensemble to lead in two high-flying musicals: Wicked, in which he jumped from swing in the first national tour to an acclaimed run as Fiyero in the San Francisco production, and Mary Poppins, in which he progressed from swing in the original Broadway cast to a star turn as Mary’s chimney sweep pal Bert. As the show moves toward its March 3 closing date, Broadway.com chatted with the Canadian-born actor about his rising career and dream role.

How does it feel to come full circle with Mary Poppins and close out the Broadway run as Bert?
Amazing! It’s such an honor. At first we were shocked and sad that the show was closing, but six and a half years on Broadway is a great run. The show has an incredible message and makes audiences so happy. To be able to say that I was the final Bert on Broadway is a privilege.

What’s fun about playing Bert?
I think Bert is one of the best male roles on Broadway. He’s the narrator, he sets the mood, and he’s omnipresent—he’s constantly on stage dancing. In what other role can you tap dance on the ceiling?

Right! What’s that moment like?
It’s a roller coaster ride. “Step In Time” is my favorite part of show. There’s an adrenaline rush, and I get butterflies in my stomach each time. They clip me in, and I just go for it. It’s such an impressive stunt: I’m walking up a wall, and 30 seconds later I’m back down. It goes by so quickly! I wish it was longer.

You’ve danced on ceilings all over America. Does the New Amsterdam Theatre feel different?
The set is different on tour—the Banks’ home opens like a pop-up book, as opposed to the Broadway set, which is a three-story house! But coming back to New York was like riding a bike again.

What are your memories of playing Fiyero in the San Francisco company of Wicked?
It was so much fun. I left Poppins on Broadway in 2009 to join Wicked. Fiyero is a dream role because you get to kiss the blonde, you kiss the green, you swing on a rope and you take a bow! Bert is a beast of a role compared to Fiyero. It’s very physical.

You were also in the ensemble of The Boy From Oz a decade ago. Any good Hugh Jackman stories for us?
Just that he’s amazing and I want to work with him again. He’s so gung-ho; I’ve never seen someone work so hard. And his dressing room was always open—if your mom and dad came backstage after the show, he’d chat with them.

You were born and raised in Ottawa, Canada, and didn’t speak English until you were seven years old. Do you still speak fluent French?
Oh yeah, with my family. My grandmother doesn’t speak a word of English, but my parents do. They translated for the Canadian government.

At what age did you shed your French accent?
I still have a slight French accent, but I’m able to hide it. It still comes out when I’m tired or I’ve had a glass of wine or two.

You’ve played squeaky-clean roles for a stretch now. Any desire to be bad?
Of course! I’d love to be in Jersey Boys and play Tommy DeVito.

The Philadelphia Eagles are 10-2 after losing to the San Francisco 49ers at Lincoln Financial Field. Final score: 42 to 19.

The Eagles actually got off to a nice start in this one in terms of moving the ball with 120 yards on their first two drives. But stalling out in the red zone twice to settle for Jake Elliott field goals only resulted in a 6 to 0 lead.

Allowing the 49ers to hang out proved to be costly. San Francisco took advantage by going on two long touchdown drives to go into halftime up eight points.

The 49ers then started the second half with another long touchdown drive to go up 21 to 6. Kyle Shanahan did a nice job of putting the 49ers in position to take advantage of weak points in the Eagles’ defense (see: Eli Ricks, Nicholas Morrow).

It looked like the Birds might have life after scoring a touchdown on a drive where Dre Greenlaw and Eagles senior advisor to the general manager/chief security officer Dom DiSandro got ejected in a sideline scuffle after a 49ers penalty. Philly was able to cut the lead to one score. But then the 49ers came right back and answered with a huge Deebo Samuel catch-and-run after a Morrow missed tackle to make it 28 to 13.

Facing 4th-and-2 from their own 32-yard line after allowing four straight touchdowns, Nick Sirianni essentially waived a white flag and punted. The 49ers took advantage to find their fifth touchdown. Fin.

Adding injury to insult, Jalen Hurts left the game to be evaluated for a concussion. He did return after Marcus Mariota took over for several snaps. But it was for naught with the game already out of reach.

Congratulations to the 49ers on their Super Bowl. They played like the much better team and retroactively won the 2022 NFC Championship Game with this win. All joking aside, not a comforting feeling to see the Eagles get outclassed like that. Especially in the trenches.

The Eagles will try to rebound with a very tough road matchup against the Dallas Cowboys coming up in Week 14. Their opponent will be coming off extra rest having last played on Thursday night. They’ll have to dig deep and find a way to win in order to hold on to their lead in the NFC East and the conference as a whole.

It will not be easy. But the Eagles still have a very viable path to the No. 1 seed ahead of them if they don’t totally collapse.

Read on for a recap and stay tuned for BGN’s postgame coverage, including the BGN Radio postgame show.

FIRST QUARTER

The 49ers won the coin toss and elected to defer, putting the Eagles’ offense on the field first. Jalen Hurts had a ton of time to throw on his first dropback but checked down to D’Andre Swift, who couldn’t hang on after being hit by Fred Warner. Swift took his first carry for a yard. Facing 3rd-and-9, Hurts hit a crossing A.J. Brown for a 38-yard catch-and-run into Eagles territory. Big pop from the Eagles home crowd. The Eagles did a good job of picking up a blitz to give Hurts time to hit a crossing Quez Watkins (!) for another first down. Facing 3rd-and-6, a bubble screen to Kenny Gainwell (!) picked up enough for a first down at the 11. Facing 3rd-and-7 from the 8-yard line, Charvarius Ward had great 1-on-1 coverage on Brown to knock down Hurts’ back shoulder pass attempt. The Eagles settled for a 26-yard field goal from Jake Elliott. Encouraging to move the ball well but annoying to only get three points. EAGLES 3, 49ERS 0.

Deebo Samuel took the Eagles’ kickoff out of the end zone to the 27-yard line. Genius idea to have him unnecessarily take extra hits. Brock Purdy’s first pass was batted down at the line by big man Jordan Davis. Haason Reddick sacked Purdy to bring up third down. Facing 3rd-and-12, Purdy got hit by Josh Sweat and airmailed a pass to the sideline for a 49ers three-and-out. Another strong start by Sean Desai’s unit.

The Eagles took over at their own 26-yard line. Hurts dropped a shotgun snap but was able to recover and throw the ball away. Hurts escaped a sack from Randy Gregory in the pocket to taking off running. Facing 3rd-and-3, the Eagles took a timeout with the offense seemingly out of sorts. Facing 3rd-and-3 again, Hurts to Brown on a slant got the offense to midfield. Hurts did a great job of stepping up and to his left to fire a pass to DeVonta Smith to get a first down into Eagles territory. Facing 3rd-and-6, Hurts stood in against the blitz and delivered a crucial completion to DeVonta beyond the marker. Another completion to Smith along the sideline put the Eagles in the red zone for the second time in two drives. Hurts slipped on a wet field and fell to take a 15-yard loss on a play where he had all the time in the world to throw (but no one open). The Eagles picked up eight yards to make it a shorter field goal attempt. Elliott made it from 39 yards out. Nick Sirianni declined an offside penalty for a chance at a 4th-and-8. Disappointing to have only six points moving the ball well twice. EAGLES 6, 49ERS 0.

Christian Elliss (!) exploded into the backfield on an outside run by Deebo Samuel to log a TFL. Then Purdy had a pass go off George Kittle’s hands and nearly get intercepted. Facing 3rd-and-14, Purdy threw the ball away while rolling right away from Reddick pressure. Two straight three-and-outs forced by Philly.

The Eagles took over at their own 33-yard line.

SECOND QUARTER

Facing 3rd-and-6 to start the second quarter, Brown jumped early and false started to knock the offense back. Facing 3rd-and-11, Hurts took off running for a short gain to bring up a Braden Mann punt.

Ben VanSumeren had the ST coverage tackle on Mann’s 52-yard punt to pin the 49ers at their own 15-yard line. Good distance and hang time by Philly’s punter. Nolan Smith set the edge well (going up against Deebo blocking him) and then Sydney Brown picked up a TFL to keep the Niners moving backwards. Then a false start knocked SF back even more. The 49ers finally picked up positive yardage with Darius Slay playing pretty far off Brandon Aiyuk. Facing 3rd-and-3, Purdy hit Kittle for the 49ers’ first first down. Facing 3rd-and-1 after no gain on a run up the middle, Purdy to a crossing Deebo moved the chains. Christain McCaffrey took a carry into Eagles territory to mark SF’s first visit there with 9:00 left in the second quarter. A crossing Kittle was left WIIIIDE open with a ton of room to run after making a catch to get to goal-to-go territory. Facing 3rd-and-goal from the 4-yard line, Purdy’s pass was high and incomplete out of the end zone but Sweat got called for being offside (didn’t look like he was?!). Facing 3rd-and-goal from the 2-yard line, Purdy hit a diving Aiyuk in the end zone for the 49ers touchdown. Upon replay, it looked like the ball moved and the score went to automatic review … only for the ruling to stand. Wow. 11-play, 85-yard TD drive by the Niners. They weren’t going to stay quiet forever. EAGLES 6, 49ERS 7.

Hurts took a 9-yard sack with only two covered receivers downfield and Brown not even on the field. Why? Facing 3rd-and-19, the Eagles ran a screen to DeVonta … who impressively broke through contact for a first down! Wow. Not the expected result on what usually feels like a give up third down play. With Lane Johnson pancaking Nick Bosa to give Hurts time to throw deep, the pass to Quez was knocked down and pass interference went uncalled when it could’ve been. Hurts’ third down pass went out of bounds and incomplete for another punt.

The 49ers took over at their own 10-yard line after a 51-yard Mann punt. A few plays later, the 49ers moved in Eagles territory. Then San Fran moved just outside of red zone. Sweat got called for another offside. Then a toss to Deebo got the 49ers to the 5-yard line. Jalen Carter stopped CMC short of the end zone and the Eagles took their final timeout with 0:41 remaining. Then CMC took it into the end zone.

The Eagles took over at their own 25-yard line with 0:38 left and zero timeouts to work with. Hurts’ first down pass was batted high up into the air by old friend turned enemy Javon Hargrave but fortunately fell down. The Eagles gave Gainwell a carry and then let the clock run out.

THIRD QUARTER

Purdy nearly had a pass picked off by Reed Blankenship to bring up third down. Facing 3rd-and-5, Purdy found a WIDE open Jauan Jennings with Eli Ricks trailing well behind. Too easy. CMC was shut down for no gain to bring up third down. Facing 3rd-and-3, Purdy found a wide open CMC with Nicholas Morrow trailing well behind on the wheel route (undefeated). Too easy. Then Deebo took a carry to the end zone for another 49ers touchdown and taunted the Philly crowded afterwards. EAGLES 6, 49ERS 21.

The Eagles took over at their own 42-yard line after a 49ers facemask penalty on Boston Scott’s kickoff return. Facing 3rd-and-7, Hurts rolled left and signaled for Brown to come back to the ball for a first down. The Eagles got set back with DeVonta called for a pass interference on an illegal pick play even though the 49ers player initiated contact. Hurts to DeVonta twice in a row resulted in an Eagles first down. Dre Greenlaw was flagged for suplexing DeVonta late and then tried to take a swipe at Eagles head of security Dom DiSandro (big mistake). Greenlaw and Big Dom were then both ejected in that order. The Eagles were put at 1st-and-10 from the 12-yard line. Brown was pushed out of bounds by Ward but no call. Facing 3rd-and-11, Hurts to Brown went for a first down at the 2-yard line. The Eagles went Brotherly Shove to get to the 1. And then again for the touchdown. EAGLES 13, 49ERS 21.

Fletcher Cox sacked Purdy. Facing 3rd-and-7, Purdy hit Aiyuk to beat Slay yet again for a first down. Morrow missed an open field tackle on Deebo, who took off running to the end zone for a fourth consecutive 49ers TD. EAGLES 13, 49ERS 28.

The Eagles went three-and-out. Nick Sirianni decided not to go for it on 4th-and-2 from the Eagles’ own 32-yard line despite giving up four straight 49ers TDs.

FOURTH QUARTER

The 49ers slowly but surely drove into field goal range. Then into the red zone. Then Jennings broke through a poor tackling attempt from Ricks to run into the end zone. Game. EAGLES 13, 49ERS 35.

Marcus Mariota took over with Jalen Hurts being evaluated in the concussion protocol. Mariota led the Eagles to two first downs before Hurts returned to action. Hurts led the Eagles to goal-to-go territory. Hurts eventually hit DeVonta for a too-little, too-late TD. The Eagles went for a two-point conversion and Fred Warner broke it up. EAGLES 19, 49ERS 35.

Deebo broke off a 46-yard catch-and-run TD. EAGLES 19, 49ERS 42.

Hurts and the starters remained in the game despite being down 23 points with about five minutes left. Why?

The 49ers put Sam Darnold in the game to hand off and run the clock out.

FINAL SCORE: EAGLES LOSE, 42 to 19

EAGLES INJURY NEWS

Jalen Hurts was evaluated in the medical tent and then ran into the tunnel during the break between the third and fourth quarters. Hurts ran back to the Eagles’ sideline with just under nine minutes remaining in the fourth quarter.

D’Andre Swift and Jack Stoll got banged up late in the fourth quarter.

MARIN COUNTY — Officials at the Tamalpais Union High School District are deciding whether to put a tax measure on the ballot to upgrade their high school campuses, but the amount of the bond issue has some in the community accusing them of swinging for the fences.

District representatives are set to weigh the measure at its meeting Tuesday evening.

Redwood High in Larkspur is an award-winning school but at more than 60 years old, it’s buildings have seen better days.

“Our school, as you can see, it’s a little run down, especially on the inside. It gets a little hot sometimes and the classrooms are super small,” said Redwood High junior Ginger Howard. “And it’s hard to get enough state funding to fix things like this because there are other priorities, and we understand that.”

The Tam Union High School District is set to vote whether to put a bond measure on the ballot for March of 2024. The bond would raise money to upgrade the facilities at its three comprehensive high schools, including Redwood, Tampalpais and Archie Williams.

“The bottom line is we’ve got some leaky roofs that need to be tended [to]. We’ve got old outdated heating and plumbing and cooling systems and electrical systems,” said the district’s Assistant Superintendent for Business and Operations Corbett Elsen.

But it goes far beyond that. New athletic fields and solar canopies are planned for all three campuses, as well as new classrooms at Tamalpais and a new $104 million cafeteria and commons building for Redwood High. There is a hefty cost for all the planned renovation.

The ballot measure says it will raise $517 million in revenue, but if you add in the cost of the interest on the 30-year bonds, taxpayers will be paying a staggering $1.04 billion.

“We think that the size is too large. We think…we are concerned that they didn’t prioritize,” said Mimi Willard, president of the Coalition of Sensible Taxpayers.

The organization has taken up the fight to get the district to scale down the ballot measure. Willard pointed to the new cafeteria as an example of the district’s overreach.

“It was deemed by the district’s own metrics to be a ‘Priority 2,” she said. “So we would like to see the district focusing on the ‘Priority 1’ projects.”

Willard said the voters also deserve ballot language that reflects the true cost of over a billion dollars rather than just the amount of the bonds. She suspects that the district may be aiming high for the March ballot because of a large number of funding measures that are expected in November. But Elsen denied that Tam Union is trying to get all that it can before tax fatigue sets in.

“I don’t think we’ve swung for the fences,” he said. “We’ve identified what we need…in terms of what our community feels that we need. We feel we owe it to our community. They’ve asked for this, so we need to reflect upon what the cost of this is.”

The measure would tax property at a rate of $30 per $100,000 in assessed value. Elsen said that means the average homeowner in the district would pay $329 per year for the next 30 years.

It will take a 55 percent vote to approve the measure, and an early poll showed 60 percent were in favor. But a later poll shows that number has been coming down. Whether the largest bond measure in the district’s history will pass now looks to be a toss-up.

The San Francisco Giants needed a series finals win over the Kansas City Royals. It was a statistical necessity, but a spiritual one on the Day of Resurrection and Feast after a demoralizing loss on Saturday.

Demoralizing, frustrating, angry – appropriate words for a defeat “torn from the jaws of victory” at the moment. Yes, I agree that every game is worth the same from late March to early October, but April defeats like yesterday can be educational moments for players and coaches alike. If the team has chutzpah, yesterday was yesterday, it shouldn’t derail a season and might even build character.

No one went to Oracle Park to build character on opening day weekend. They wanted the bats to dish out punches, crush and crush, embarrass and destroy opponent’s arms – the fans wanted to cheer for bloodshed (in a stylish way). It didn’t happen on Friday for San Francisco, it definitely didn’t happen on Saturday, and as long as Royals starter Kris Bubic was on the mound on Sunday, it didn’t happen then either.

But it finally happened. Not quite the bludgeoning giants are capable of that, but it’s nice to shake things up every now and then (especially a day after RUF IS ON THE MOVE’s anniversary) with a mad race around the plate.

Bryce Johnson got a 2-out double from Wilmer Flores from the start. Johnson ran on the play and slipped headfirst into second before leaping onto his cleats when realizing where the ball had landed to the left. The young fielder’s speed coupled with the weekend’s overall offensive desperation, base coach Mark Hallberg waved Johnson to the tie. Michael Conforto then launched a 3-1 wiffle ball from left to deep right center by Ryan Yarbrough.

I think we can be thankful Yarbrough was in the game because there was a moment of whiplash in the 7th when things got confusing.

As far as I can tell, this is what happened:

The aide, Yarbrough, was called after RHP Carlos Hernádez showed up injured following a Brandon Crawford pop. Hernádez then started coming off the mound as Yarbrough exited the bullpen to face right Austin Wynns. But then, halfway across outfield, Yarbrough turned and headed back to the bullpen while Hernádez returned to the rubber, prompting left Blake Sabol to go into play (without Kapler’s official signal), prompting the Royals to do so , to call Yarbrough back into play Hill. After 7 minutes of being pushed around and general confusion for everyone involved, the refs pitched Yarbrough and forced Sabol to hit in a 1-run game against a tough southpaw with a baserunner on and two outs.

Experienced/manipulative coaching from the Royals? A mistake in the rules? Bad job from the referee crew? A rookie player unfamiliar with the bureaucratic nuances of MLB substitutions? Probably all of the above. The Giants bats had the last laugh so all is forgiven. Happy Easter.

Kris Bubic, a native of Cupertino, is the first left-hander the Giants have faced this year.

Accordingly, Gabe Kapler ran out the right batting move: Outfielder Bryce Johnson started at center in place of Mike Yastrzemski, Heliot Ramos, recently called up to lend his right-hand bat to the cause, recently started at left, Austyn Winns after injuring Roberto Perez was called up, along with DeSclafani behind the plate, Wilmer Flores covered first base for LaMonte Wade Jr. and JD Davis took over the role of Joc Pederson.

With RH outfielders Austin Slater and Mitch Haniger still on the injured list, the right side of the lineup is the Bruce Banner for the left Hulk – Bubic handled them easily, delivering 6 strikeouts in his first time in the lineup. (5 of them swing and miss). Giants hitters swung through big curve balls, swung over switches and chased elevated fastballs. Bubic attacked the zone, keeping every contact mostly grounded, driving through 6 innings of work with 9 K’s, 2 hits and 0 runs in front of friends and family. San Francisco’s first hit came from a single with Seeing-Eye Out of the Bat by David Villar to open the 5th. Bloodshed!

Thankfully, Anthony DeSclafani was almost as good on the other side of the hill.

In his second start of the season, Disco continued his strong start with 6.1 IP and allowed 1 run on 3 hits while hitting 7 and walking none. Over 2 games and 12 ⅓ IP: 0.73 ERA, 6 H, 1 R, 11 K, 0 BB.

The 1-run error happened quickly. The first base runner for the Royals and the first hit of the game came with 2 outs in the 4th from Vinny Pasquantino (who struggled for 11 pitches in the first before folding and doubled to put yesterday’s 9th ahead and scoring a goal in the absence of the winning run on Doval’s wildfield). Pasquantino’s double was promptly recorded by Salvador Perez.

Perez, it seems, is trying to make amends in 2014. The single was his 5th RBI in the series. I don’t know how many RBIs or game timing home runs it would take to golf in the stands to equal a single with 2 outs at the end of the 9th of Game 7. The damage he’s done this weekend is pretty annoying – like a pimple in your nostril or a mosquito bite on a knuckle – but it’s nowhere near redeeming the foul in 2014.

Does that help us feel better about what happened to us on Friday and Saturday?

[insert shrug emoji]

In a non-tandem start, San Francisco’s incredibly well-recovered bullpen put together two innings of shutout baseball. Scott Alexander took over for DeSclafani with an on and an out in 7th place. The Royals threatened a single from Matt Duffy and both runners went into goal position on a soft ground-out on the right side of the infield. Alexander doused the smoldering flame with a plumb bob below the zone Franmil Reyes couldn’t hold.

Taylor Rogers came into play at eighth as he tried to level the Royals’ 1-0 lead, handing Nicky Lopez a lead-off double. The new Rogers didn’t have a great start to his Giants career, but after the double he fanned Jackie Bradley Jr. and got MJ Melendez flying into midfield. John Brebbia came in to hit Bobby Witt Jr. to end the inning and set up the 3-run burst off offense.

After Doval served two days in a row, Tyler Rogers took over in 9th place to save and, funnily enough, trouble ensued when a catcher interfered with Sabol, who put the lead-off man in 1st place and the tie up brought the plate. The tie represented by – who else? – Salvador Perez. history repeats itself.

Much has been written about Perez’s game-changing 3-run homer after a switch from Ross Stripling. Who is today, whether that pitch – which practically bounces on the plate – had anything to do with getting hit this far, whether Stripling and Sabol should have elevated something to a low-ball bat, whether Kapler Stripling to a high- Leverage-Reliver should have pulled like Brebbia or Tyler Rogers. Everyone has an opinion on this. Nobody has a problem making hay and more hay out of it – but certainly one of Saturday’s alternate timelines could have been the submarine man and his naturally rising frisbees against the 9-iron-wielding Royals catcher. We saw what could have been on Sunday the 9th – Perez surfaced flat left on a pitch. Matt Duffy then started with a simple 4-6-3 double play to finish the game.

A much needed Phillies win.

Off to a possibly not fun 3 game series against the Los Angeles Dodgers.

Click for PDF

On February 15, 2023, the Securities and Exchange Commission (the “SEC”) passed final rule changes aimed at reducing risk in settlement and settlement for most broker-dealer securities transactions and proposed new rules that address the Advisors aim to improve the protection of client assets managed through investments.

The new final rules amend Rule 15c6-1 of the Securities Exchange Act of 1934 (the “Exchange Act”) to shorten the standard settlement cycle for broker-dealer transactions from two business days after trade (“T+2”) to one business day (“T+1”). The new rules also shorten the separate settlement cycle for firm commitment offerings, including IPOs, from T+4 to T+2, although most market participants are already using a T+2 settlement cycle for these offerings.

The rule changes also adopt Rule 15c6-2, which requires a broker or dealer to create, maintain and enforce written policies or enter into written agreements that ensure the prompt completion of the applicable allocation, confirmation or confirmation processes. In order to comply with the new rule, any such agreement or policy must ensure that allotment, confirmation or confirmation processes are completed as soon as technically feasible, but in any case no later than the end of the trading day. In addition, the new rules amend Rule 204-2 of the Investment Advisers Act, 1940 (the “Investment Advisers Act”) to require investment advisers to keep records of transactions subject to Rule 15c6-2 above. Finally, the new final rules adopt Rule 17Ad-27 of the Exchange Act and amend Regulation ST to require clearing agencies that provide a central matching service to facilitate straight-through processing and submit an annual report to the SEC via EDGAR on the straight -Through processing to forward implementation. The compliance date for these rule changes is set for May 28, 2024.

These changes are in part a response to the unprecedented volatility surrounding the so-called “meme stock craze” of 2021. Commissioner Jaime Lizárraga backed the adoption of new rules, saying it “helps mitigate some of the risks that Driven the stock price by volatility and significant margin calls” during this event. SEC Chairman Gary Gensler also supported the rule changes, stating, “Cosmo could say that this rollout will take our installations from bronze to copper. I say that taken together, these changes will make our market installation more resilient, timely, orderly and efficient.” Referring to the compliance date, he offered: “This implementation comes more than three years after key industry members first proposed the settlement cycle shorten, and in a year and a half from now, which I believe provides sufficient time for the transition.” Other commissioners have pushed back the timetable for implementation to May 2024. Commissioner Mark T. Uyeda did not support the final rules, saying he believes the SEC is “imprudently moving away from a reasonable transition date.”[.]Along with Commissioner Uyeda, Commissioner Hester M. Pierce also advocated a September 2024 settlement date. The changes also came with discussion that the SEC may seek to further shorten the settlement window. In a statement, Commissioner Caroline A. Crenshaw said the move to instant trade settlement (“T+0”) “could be both desirable and feasible in the future”.

The SEC’s proposed amendments to Rule 206(4)-2 of the Investment Advisers Act would build on the power granted by Section 411 of the Dodd-Frank Act to expand the scope and protection of assets protected by the rule. While the current rule protects “funds and securities” of clients in the care of an investment adviser, the proposed rule would include all client assets held by the investment adviser and all client assets that the investment adviser has the authority to obtain. This move would bring numerous types of physical assets and all crypto assets within the scope of the rule. Under the current regime, protected assets are covered when they are in the “custody” of an investment adviser, and the proposed changes would extend the definition of such custody to include situations where the adviser has discretion to trade those assets. While the current rule requires investment advisers to hold client assets with a qualified custodian, unless those assets are privately offered securities, the new rule would limit this exception to situations where no qualified custodian is available. Additionally, a qualified custodian would not include platforms used to trade assets such as crypto, a move that appears to have been taken to address the recent outages and problems of the major crypto asset trading platforms. The proposed rule also requires investment advisers to title or register assets on behalf of clients and avoid asset commingling, and prohibits investment advisers or associated persons from taking certain interests in client assets in the custody of the adviser without written consent. Finally, the proposed amendments would further amend Rule 204-2 to improve the record-keeping requirements in relation to covered client assets held in custody by an investment adviser. Proposed rule changes are subject to comment for 60 days after publication in the Federal Register.

Chairman Gensler said in support of the rule that “investors working with advisors would receive the proven protections they deserve for all their assets, including crypto assets, consistent with what Congress wants.” Commissioner Pierce, who was the only Commissioner to vote against the proposal, raised a number of objections and concluded that “[w]While our intent is good, the outcome may impose costs on investors that outweigh the benefits.” Commissioner Uyeda added that the proposal “appears to disguise a policy decision to block access to crypto as an asset class” resulting “from the the Commission’s longstanding neutral position on the merits of investment,” although he voted in favor of the proposal as a way to gauge public reaction.

KANSAS CITY, Mo. (KWCH) – Wichita State’s furious comeback and its bid for the Hall of Fame Classic title both fell a basket short in a 67-63 loss to San Francisco, Tuesday afternoon at the T-Mobile Center.

After cutting a 13-point deficit to two over the last five minutes of the second half, WSU (3-2) came up empty on three different opportunities to tie or take the lead. Jaykwon Walton hit 8-of-11 shots and set new career highs with 21 points and 10 rebounds.

Craig Porter Jr. scored 16 points on 5-of-20 shooting and stuffed the box score with nine rebounds, six assists, three steals and a pair of blocks in 38 minutes. Gus Okafor added 10 points and seven boards. San Francisco (6-0) shot 39.3% from the field but knocked down 12-of-34 threes. Josh Kunen was a perfect 5-for-5 from deep on his way to a team-high 15 points. Tyrell Roberts handed out seven assists in 37 turnover-free minutes.

WSU trailed 27-14 with less than 4:00 to play in the opening half after missing 21 of its first 26 shots but finished the half on a 9-0 run. Porter rebounded his own miss and hit a twisting corner three ahead of the halftime buzzer to send the Shockers into the locker room down just 27-23. USF bridged halftime with an eight-minute scoring drought before sinking five shots in a row to build its lead back to double-digits. Hawthorne hit a three for a 60-47 USF advantage with 6:22 to play in the game. WSU ramped up its rebounding and full-court pressure down the stretch and finally made some shots.

Walton and Okafor hit back-to-back threes to key a 10-0 run over a span of less than two minutes. After driving for a layup, Porter stole a pass near midcourt and fed Walton for a dunk to cut the deficit to 60-57 with still 3:20 to go. The Shockers twice missed three-pointers that would have tied the game. USF’s Kunen sank his fifth triple of the day with 1:27 to go to push the Don lead back to 63-57. Again WSU responded. Okafor put back a missed free throw with just a under a minute left to make it a two-point game, 63-61.

Following a defensive stop, the Shockers took possession with 32 seconds remaining but turned it over when a driving Walton lost his footing and the ball. USF iced the game at the free throw line.

The Shockers return to action Saturday, Nov. 26, against Tarleton State.

Veteran quarterback Jimmy Garoppolo entered the Week 18 matchup with the Los Angeles Rams knowing full well that this could have been his last game as a member of the San Francisco 49ers.

What followed was a comeback for the ages and adding at least one more game to Jimmg GQ’s career. Garoppolo trailed 17-0 at the end of the second quarter and looked utterly lost in a game they had to win. Garoppolo led the 49ers back to a 27-24 overtime win.

With the win, San Francisco heads to Big D to face the Dallas Cowboys in Sunday afternoon’s NFC Wild Card Playoffs.

Related: NFL Playoff and Super Bowl Predictions

At a meeting with the media on Wednesday, Garoppolo admitted his uncertain future has weighed on him all season.

“It’s always in the back of my mind,” Garoppolo told reporters. “It really was in mine all season. I knew what season it was, knew everything that was and wasn’t going on behind the scenes. It was a little bit different.”

Related: Brave Predictions for 49ers Cowboys NFC Wild Card Game

Jimmy Garoppolo’s future remains clouded ahead of the NFL playoffs

January 9, 2022; Inglewood, California, United States; San Francisco 49ers quarterback Jimmy Garoppolo (10) celebrates as he leaves the field after defeating the Los Angeles Rams in overtime of the game at SoFi Stadium. Mandatory Credit: Jayne Kamin-Oncea-USA TODAY Sports

A few months earlier, the 49ers had exhausted two prospective first-round picks and a third-round pick to trade for quarterback Trey Lance. You’re not trading that capital unless you expect the quarterback to start sooner rather than later.

With Garoppolo injured (thumbs) in Week 17, Lance helped the 49ers stay in the playoff race with a 23-7 win over the Houston Texans. In that game, the small-school product completed 16 of 23 passes while rushing for 280 yards on two touchdowns. For some, this may have been the beginning of “Trey Area” in Santa Clara.

In fact, many called for Garoppolo to be benched at halftime against the Rams last week before the veteran made a comeback for the ages.

Related: Bold Predictions for the NFL Wild Card Playoffs

What does this mean for the Super Bowl quarterback? It’s cloudier than ever.

On the one hand, Garoppolo has a $26.91 million cap hit for next season. San Francisco escapes by saving more than $25 million. For his part, Lance’s cap hit is just $7.75 million. From a financial and team building perspective, it makes sense for San Francisco to trade or release Garoppolo.

All of this is complicated by the fact that these 49ers with Garoppolo under center had a ton more success than other quarterbacks during the Kyle Shanahan era.

Record with Jimmy Garoppolo: 31-14

Record without Jimmy Garoppolo: 8-26

Those are some absolutely absurd splits right there.

Realistically, Garoppolo’s future could depend on what happens in Dallas on Sunday and possibly progressing in the playoffs.

Much like we saw after the 49ers’ performance in the Super Bowl in February 2020, a deep run in the playoffs would make it difficult for San Francisco to leave Garoppolo. Recall that a month after the Super Bowl appearance, the team’s leadership decided against going after Tom Brady.

As for Garoppolo, he wants to continue as long as possible.

“These guys on this team, I love this team. i love the players i love everything about it It’s a good group to be here, a fun group. We want to keep this thing going for as long as possible,” the quarterback said.

OAKLAND (CBS SF / BCN) – It’s finally here: Oakland officials say they expect to release the final environmental impact report on the proposed new stadium for the Oakland A’s at the Howard Terminal on Friday morning.

The report is expected to be posted on the city’s website at 8:00 a.m. City officials will recommend that the Oakland Planning Commission certify the report and send it to the city council for approval.

CONTINUE READING: Experimental gene therapy has been shown to be safe and effective and gives children a new chance in life

The planning commission will take up this recommendation on January 19th and the city council can approve the report in February.

“The release of the final environmental impact report is an important milestone in our journey to building a new waterfront ballpark area that will create up to 18 acres of beautiful public parks, more affordable housing and good jobs for Oaklanders,” said Oakland Mayor Libby Schaaf.

Oakland A released renders of their planned new ballpark at Howard Terminal near Jack London Square in Oakland (courtesy Bjarke Ingels Group)

“The 3,500-page document is thorough and comprehensive and ensures that the project is environmentally friendly and sustainable,” said Schaaf. “The completion of the EIR also keeps us on track to bring the 2022 project to the final vote in the city council – and brings us one step closer to keeping our beloved A’s rooted in Oakland.”

The final EIR does not contain any “material” new information and does not need to be re-circulated, thereby delaying a vote on it.

A’s proposal not only envisages a new stadium with around 35,000 seats, but also apartments, a hotel and a performance venue with 3,500 seats as well as commercial space.

The entire development would be on approximately 55 acres in the Jack London Square area.

CONTINUE READING: Man charged with threats at VTA meetings has bail set of US $ 350,000; Ordered to stay away

The approval of the overall project consists of an environmental assessment, project assessment and project agreements. The city and the A’s are well advanced in the approval process, although the A’s are considering moving the team to Las Vegas.

A’s President Dave Kaval has said it’s Howard Terminal for the A’s or they are moving out of Oakland.

The approval of the final environmental impact assessment by the city council would complete the environmental assessment process.

City officials are waiting for the A’s to revise the plans and present them to the city as part of the project appraisal process. The two now draft and negotiate the project agreements, which are of a financial nature.

A lawsuit could delay the project, but for a limited time. Assembly Bill 734 sets a limit for the duration of a lawsuit over the project.

Frequent questions raised by the draft EIR included railroad safety, parking, bridges over the railroad tracks near the proposed park, and questions about why a ballpark cannot be built at the Oakland Coliseum site. City officials answered any of the questions or concerns.

Answers to these questions were not available on Thursday, but the answers will be part of the final EIR released on Friday. More than 400 comments were made on the draft EIR.

The Oakland A’s did not immediately respond to a request for comment on the publication of the final EIR on Thursday afternoon.
