SAN FRANCISCO (AP) — Paul Pelosi recounted publicly for the first time Monday what happened the night he was attacked by a man in the San Francisco home he shares with former U.S. House Speaker Nancy Pelosi, recalling how shocking it was to see a man standing at his bedroom door, then how the man whacked him in the head with a hammer.

“It was a tremendous sense of shock to recognize that somebody had broken into the house and looking at him and looking at the hammer and the ties, I recognized that I was in serious danger, so I tried to stay as calm as possible,” Pelosi told jurors as he testified in the trial of David DePape, who is shown on video carrying out the attack.

Prosecutors say DePape bludgeoned Pelosi in the early hours of Oct. 28, 2022, just days before the midterm elections, and that he had rope and zip ties with him. DePape has pleaded not guilty to attempted kidnapping of a federal official and assault on the immediate family member of a federal official with intent to retaliate against the official for performance of their duties.

Defense attorney Jodi Linker told jurors last week that she won’t dispute that DePape attacked Pelosi. Instead, she will argue that DePape believed “with every ounce of his being” that he was taking action to stop government corruption, the erosion of freedom in the United States, and the abuse of children by politicians and actors. She said that means the government’s charges that DePape was trying to retaliate or interfere with Nancy Pelosi’s official duties don’t fit.

Paul Pelosi’s testimony came on the trial’s second day, after prosecutors brought forward FBI agents who collected the electronics DePape was carrying and searched the room he lives in, a U.S. Capitol police officer who watches the surveillance cameras at the Pelosis’ home and another who has protected Nancy Pelosi since 2006, a Bay Area Rapid Transit police sergeant, and a digital forensics expert.

Pelosi said he has not discussed the attack with anyone and has encouraged his family not to as well “because it has been too traumatic.”

The Pelosis’ home has an alarm system with motion detectors, but Pelosi said he never put it on when he was home alone because his movements would trigger it.

He recalled being awakened by a man bursting into the bedroom door asking, “Where’s Nancy?” He said that when he responded that his wife was in Washington, DePape said he would tie him up while they waited for her.

“We had some conversation with him saying she was the leader of the pack, he had to take her out, and that he was going to wait for her,” Paul Pelosi said.

Earlier, prosecutors played police body camera footage showing Pelosi facedown on the floor as paramedics help him. One holds a white towel against Pelosi’s head as another puts a neck and head brace on him before several first responders help him onto a stretcher chair. Pelosi’s face and hands are covered in blood.

He later underwent surgery to repair a skull fracture and injuries to his right arm and hands.

Some witnesses helped verify time stamps on footage from surveillance cameras at the Pelosis’ home, which are set to Eastern Time, and on BART trains, which were an hour behind Pacific Time.

FBI Special Agent Stephanie Minor, who was in charge of the investigation, testified that video showed DePape hit Paul Pelosi at least three times.

DePape showed little emotion during most of the testimony, only smiling and releasing a muted chuckle when, at his attorney’s request, Minor read a list of topics that appeared on his blog. They included Communism, corruption, COVID-19, Jewish people, “Gamergate,” guns, immigrants, memes and wamon, a word used to describe a woman who does nothing but complain.

Minor testified DePape started gathering items for the attack two months beforehand, in August 2022, purchasing body cameras, USB memory sticks, a large backpack and a sleeping bag. She also said FBI agents found two inflatable unicorn costumes and a box of crayons but didn’t explain the purpose of those items.

Federal prosecutors have said the evidence and FBI testimony will show DePape researched his targets online, collecting phone numbers and addresses, even paying for a public records service to find information.

If convicted, DePape faces life in prison. He also has pleaded not guilty to charges in state court of attempted murder, assault with a deadly weapon, elder abuse, residential burglary and other felonies. A state trial has not been scheduled.

Pelosi’s testimony mirrored the series of events that prosecutors previously laid out.

He recounted how DePape had let him enter the bathroom, where Pelosi was able to grab his cellphone and use it to call 911 as DePape looked on, urging Pelosi to tell police that he was a friend. Pelosi said he tried to tell police what was happening without aggravating DePape.

Pelosi said he then suggested the two head downstairs after DePape told him he was tired and wanted to sleep. Pelosi recalled being thankful when the police arrived, only for DePape to then hit him with the hammer. He said he woke up in a pool of his own blood.

After his arrest, DePape, 43, allegedly told a San Francisco detective that he wanted to hold Nancy Pelosi hostage. He said if she told him the truth, he would let her go and if she lied, he was going to “break her kneecaps” to show other members of Congress there were “consequences to actions,” according to prosecutors.

DePape slept in a cot in a garage with no kitchen or bathroom in the Bay Area city of Richmond, according to photographs shown by prosecutors. He had been doing odd carpentry jobs to support himself and allegedly told authorities he had other targets, including a women’s and queer studies professor, California Gov. Gavin Newsom, actor Tom Hanks and President Joe Biden’s son Hunter.

The suspect, accused of using a metal pipe to attack a former San Francisco fire officer, was released from custody on Thursday and is scheduled to appear in court for a preliminary hearing at the end of May.

Former San Francisco Fire Department Commissioner Don Carmignani suffered serious injuries after he was attacked with a metal pipe by a suspect outside his mother’s San Francisco home in early April, according to prosecutors. According to the prosecutor, Carmignani was therefore unable to testify in the preliminary hearing on Thursday.

The judge on the case granted the prosecution’s request to postpone the hearing to May 23 and released suspect Garret Doty, whom San Francisco police had charged with assault with a deadly weapon, from prison.

Kleigh Hathaway, Doty’s public defender, claims her client was not the attacker in the incident but rather protected himself from the former firefighter, who she says attacked several homeless people with bear spray, including Doty.

Hathaway also released surveillance video, which she says showed Carmignani attacking Doty with bear spray minutes before Carmignani was attacked with the metal pipe.

On April 5, Carmignani called 911 to report three homeless people at a camp outside his mother’s home in the affluent Marina neighborhood, he said in a statement to CNN.

“That evening I arrived at my mother’s house and told these individuals to leave,” Carmignani said in the statement. “The incident culminated in one of the people pulling out a piece of metal pipe and hitting me on the head several times.”

Carmignani was hospitalized and underwent emergency surgery, his statement said.

Carmignani’s attorney, Samuel Ray, said in a statement that the San Francisco Police Department did not respond to the morning call about people camping outside his client’s home and that “no one from the SFPD or the DA’s office ever conducted an interview or attempted to conduct an interview.” Don on his version of events.”

CNN questioned SFPD about Ray’s allegation. The District Attorney says the SFPD has requested an interview on multiple occasions.

Other homeless victims, says the public defender

Video from outside a gas station shared by Camignani’s lawyer appears to show the former firefighter trying to defend himself while being hit by a man with a metal pole. The video does not show the moments before the altercation.

A separate video, also provided by Carmignani’s lawyer and apparently taken from a nearby building, shows the former city official running down the street with Doty at his heels, swinging his rod at Carmignani’s head as he flees .

Doty’s public defender told reporters Wednesday the case was a self-defense case, in part because she says there appears to be a repeating pattern of someone matching Carmignani’s description allegedly walking within a four-block area between November 2021 and his attacked homeless people with bear spray and January 2023, based on police reports provided to her by prosecutors and police.

“In all of them the victims are not housed, the victims are either sleeping in their tents, sitting on a bench and minding their own business,” Hathaway said, citing police reports of eight separate attacks on homeless people included in discovery evidence that she has received. “Luckily, one of them was caught on video.”

CNN has requested the police reports but has not yet received them.

Carmignani has denied being the person in the videos of the bear spray attacks and says he did not commit any of the attacks.

A copy of the video provided by the San Francisco Public Defender’s Office shows an apparently homeless man sleeping outside on a sidewalk. According to Hathaway, the video was recorded in November 2021 on the same street as Carmignani’s residence.

“He goes and sprays a giant can of bear spray – the same gun that was used in the Doty incident – he sprays this bear spray on the homeless. Don’t just walk by, focus on the victim’s face for at least a few seconds and then walk away,” she says.

“This man is described as 5’10”, 6’1″, 280, 300 pounds, gray hair, brown hair. Very similar and apt to what Mr. Carmignani looks like,” she said.

“I am confident that my client was aware of his (Carmignani’s) past violence,” Hathaway said, captioning an April 5 video that appears to show the first confrontation between Carmignani and her client. In that video, Hathaway says Doty can be seen running away, and the “first thing he does” is crouch down and cover his head with this coat, “implying that he’s experiencing the violence of the bear spray.” knows and has been exposed to this violence in previous incidents.”

When asked why Carmignani wasn’t charged in connection with the homeless attack, San Francisco District Attorney Brooks Jenkins told reporters Wednesday, “Nothing has been submitted to our office by the police requesting that they do anything for their purpose.” the indictment.”

Jenkins stated that she viewed a video, but that “it’s just an allegation at the moment as to who it is” and that further investigation is needed.

Jenkins added that prosecutors will continue to focus on the April 5 incident. “I am concerned about the incident that brings us to court today,” she said. “So this specific incident and what was happening at that point in time is what is primarily relevant at this point.”

According to Jenkins, Carmignani has not yet given an interview to the San Francisco Police Department, although he did do a sit-down interview with CNN affiliate KPIX.

SAN FRANCISCO (CRON) — Don Carmignani, a former San Francisco fire department commissioner, attacked homeless people in the city’s Marina neighborhood with bear spray, according to lawyers speaking in court on Wednesday.

Defense attorneys were speaking on behalf of a 24-year-old unprotected man, Garret Allen Doty, who is being held in prison without bail. Doty is accused of attacking Carmignani and hitting him with a metal pipe. The April 5 pipe banging was captured on surveillance video footage obtained by KRON from Nexstar.

However, new surveillance footage recently emerged that appears to show that 53-year-old Carmignani provoked the incident when he allegedly attacked Doty with bear spray, Doty’s defense attorneys said.

Doty’s defense team said a man matching Carmignani’s description is suspected of targeting homeless people in at least eight separate incidents since November 2021, including some incidents involving the use of bear spray as a weapon. According to the defense, some of the victims were attacked while they were sleeping or in tents. Before the April attack, another unprotected person was attacked just a block from Carmignani’s home in January.

Unprotected people set up camp in front of the house of the mother of a former fire commissioner in the Marina district. (Photo courtesy of Samuel Ray of Colla & Ray LLC)

Doty was initially arrested and charged with assault with a deadly weapon, aggravated assault and assault.

Prosecutors turned over Doty’s attorney surveillance video Monday, showing the initial interaction between Doty and Carmignani. The video shows Carmignani walking up to Doty, spraying him with bear spray and walking away.

Carmignani previously told KRON Doty was part of a group of three aggressive, unprotected individuals who refused to move. The former fire commissioner said he called 911 after seeing the trio’s camp. The homeless people stayed outside his mother’s house all day, doing drugs and being “extremely aggressive” towards passers-by, he said.

Carmignani wrote: “Both my mother and I called 911 to report that three homeless people had set up camp at the entrance to their apartment. My family has had previous interactions with these individuals who have repeatedly threatened my family members with violence. As a result, my mother did not feel safe leaving her home. Neither the SFPD nor any of the city’s various homeless services responded to our 911 calls that morning. Throughout the day, my mother and my friend informed me that these individuals were still standing outside their home, openly using drugs and being extremely aggressive towards passers-by.”

Carmignani said when he asked people to leave later that day, Doty took out the whistle and attacked him “countless” times. The pipe attack can be seen in the video above.

Carmignani was hospitalized with a fractured skull.

Now the former fire commissioner said he feared prosecutors would drop all charges against Doty and instead frame Carmignani as the attacker. So far no charges have been dropped. Doty’s preliminary hearing is scheduled for Thursday and Carmignani will be called in to testify about what happened at the marina.

Carmignani’s lawyer sent a statement to KRON on his behalf Monday night. The statement said: “Unfortunately, we have been informed by the District Attorney’s Office that they have decided to drop the charges against Don Carmignani’s attacker, Garret Doty, and release him back onto the city streets with impunity. According to prosecutors, the attack on Don was “self-defense.” Prosecutors have also informed us that Don could be prosecuted for using pepper spray. We truly believe that instead of threatening Mr. Carmignani, they should focus on pursuing the individual who terrorized the Marina and taking Don to the hospital after brutally beating him with a metal rod.”

District Attorney Brooke Jenkins said her office still considers Carmignani a “victim” and charges are still pending against Doty.

Jenkins said Carmignani was supposed to appear in court on Wednesday, but he did not appear. If he again fails to appear for Thursday’s preliminary hearing, the court will have to release Doty from jail, she said.

Last year, a San Francisco art gallery owner was criminally charged after hose-spraying an unprotected woman because she refused to leave his gallery in posh Jackson Square. Collier Gwin was caught on a witness’ phone camera spraying the woman and yelling, “Move! Move! Move!”

Officials in the city of San Francisco cannot legally compel unprotected men and women to move away from public places, such as sidewalks. That’s because a judge ruled in favor of a lawsuit brought by homeless advocates.

Judge Donna Ryu’s decision was issued Dec. 23 in response to a lawsuit, Coalition on Homelessness v. City and County of San Francisco filed in the United States District Court for the Northern District of California.

Ryu’s order prohibits San Francisco from enforcing the “sit, lie, and sleep laws” against “involuntarily homeless individuals” as long as the number of homeless people exceeds the number of available emergency shelters.

Shortly after he was attacked, Carmignani told KRON that Doty and Doty’s friends are “known criminals with a well-documented history of drug use, resident harassment and vandalism at the marina. One of my attackers was seen near the crime scene, carrying my hat as a trophy, which fell off my head. This is unacceptable.”

Carmignani said he’s a lifelong resident of the Marina District and he believes the city needs to protect the safety of its residents from violent drug users.

He wrote: “I strongly believe that the city must promote the safety of its law-abiding citizens from those who have chosen to do drugs and commit acts of violence on our streets. I am confident that this unfortunate incident will lead to policy changes to better protect the interests of San Francisco residents.”

Paul Pelosi, the husband of House Speaker Nancy Pelosi, was violently assaulted inside his home Friday morning in San Francisco, according to a Pelosi spokesman and local police.

An assailant broke into the home and asked “Where’s Nancy? Where’s Nancy?” according to an NBC News source.

Officers arrived at the home to perform a welfare check and found the suspect and Pelosi both having one hand on a single hammer. Police then saw the suspect attack Pelosi, 82, with the hammer, San Francisco Police Chief Bill Scott said during a news conference Friday. Scott added Pelosi was struck at least once in the attack.

The officers disarmed the suspect, Scott said.

“This was not a random attack. This was intentional. And it’s wrong,” Scott said. “Our elected officials are here to do the business of their cities, their counties, and their states, and this nation.
Meanwhile, politicians from both sides of the aisle took to social media to condemn the attack.

Political Analyst Larry Gerston says there’s definitely a question whether the assault on Nancy Pelosi’s husband at the couple’s San Francisco home is politically motivated.

Their families don’t sign up for this — to be harmed. And it’s wrong.”
