<p>				Cruise stopped its driverless operations nationwide last week.  But the New York Times reports on the company&#8217;s moves since then&#8230;</p>
<p>&#8211; Cruise hired the law firm Quinn Emanuel to investigate its response to a San Francisco incident involving a pedestrian, &#8220;including its interactions with regulators, law enforcement and the media.&#8221;<br />&#8211; A separate review of the incident is being doncuted by Exponent, a consulting firm that evaluates complex software systems.<br />&#8211; The company&#8217;s rivals &#8220;fear Cruise&#8217;s issues could lead to tougher driverless car rules for all of them.&#8221;<br />&#8211; &#8220;Cruise employees worry that there is no easy way to fix the company&#8217;s problems, said five former and current employees and business partners.&#8221;</p>
<p>Company insiders are putting the blame for what went wrong on a tech industry culture — led by 38-year-old [Chief Executive Kyle] Vogt — that put a priority on the speed of the program over safety. In the competition between Cruise and its top driverless car rival, Waymo, Mr. Vogt wanted to dominate in the same way Uber dominated its smaller ride-hailing competitor, Lyft.  &#8220;Kyle is a guy who is willing to take risks, and he is willing to move quickly. He is very Silicon Valley,&#8221; said Matthew Wansley, a professor at the Cardozo School of Law in New York who specializes in emerging automotive technologies. &#8220;That both explains the success of Cruise and its mistakes.&#8221;</p>
<p>When Mr. Vogt spoke to the company about its suspended operations on Monday, he said that he did not know when they could start again and that layoffs could be coming, according to two employees who attended the companywide meeting.  He acknowledged that Cruise had lost the public&#8217;s trust, the employees said, and outlined a plan to win it back by being more transparent and putting more emphasis on safety. He named Louise Zhang, vice president of safety, as the company&#8217;s interim chief safety officer and said she would report directly to him&#8230;</p>
<p>With its business frozen, there are concerns that Cruise is becoming too much of a financial burden on G.M. and is hurting the auto giant&#8217;s reputation&#8230;  The shutdown complicates Cruise&#8217;s ambition of hitting its goal of $1 billion of revenue in 2025.  G.M. has spent an average of $588 million a quarter on Cruise over the past year, a 42 percent increase from a year ago. Each Chevrolet Bolt that Cruise operates costs $150,000 to $200,000, according to a person familiar with its operations.</p>

<p>In the wake of California withdrawing Cruise&#8217;s permit to operate self-driving cars in the state, the company announced that it&#8217;s suspending all U.S. robotaxi operations.</p>
<p>The move comes after the California Department of Motor Vehicles alleged that Cruise withheld from regulators video footage of a Cruise robotaxi dragging a person down a city street.</p>
<p>The future for the company is uncertain. Its parent company, General Motors, has lost $1.9 billion on Cruise so far this year, including a $732-million loss in the third quarter, according to its latest earnings report. Competitor Ford shut down its Argo robotaxi unit in 2022, concluding that the possibility of far-off profits weren&#8217;t worth the enormous cash drain.</p>
<p>The California DMV gave two reasons for suspending Cruise&#8217;s license this week: concerns about safety and claims that the company withheld from regulators video footage that showed a Cruise robotaxi drag an already injured woman 20 feet across street pavement before emergency workers could reach her.</p>

<p>“The most important thing for us right now is to take steps to rebuild public trust,” Cruise said in a statement online Thursday night. &#8220;Part of this involves taking a hard look inwards and at how we do work at Cruise.”</p>
<p>Cruise vehicles with humans behind the wheel will continue to operate. Until this week, the company had been operating driverless services in San Francisco, Phoenix, Miami, Houston and Austin, Texas.</p>
<p>Cruise needs to be &#8220;extra vigilant when it comes to risk, relentlessly focused on safety&#8221; as it rebuilds public trust, a spokeswoman told The Times.</p>

<p>The incident marks a dark chapter in the emerging history of the automated vehicle industry. Whether Cruise&#8217;s actions will harm the industry&#8217;s reputation, or only its own, remains to be seen.</p>

<p>Robotaxi companies claim that autonomous vehicles are already safer than cars driven by humans. Officials in San Francisco say they&#8217;re having trouble getting these companies to provide adequate data to prove that. But Cruise is dealing with more than safety in this case — it&#8217;s dealing with allegations that it misled regulators and the media in ways that might erode public trust.</p>
<p>On Oct. 2, a car with a human behind the wheel hit a woman who was crossing at the intersection of 5th and Market streets in San Francisco against a red light. The pedestrian slid over the hood and into the path of a Cruise robotaxi, with no human driver. She became pinned under the car, and was later taken to a hospital.</p>
<p>Cruise quickly called the crash tragic but said that the robotaxi stopped as it was supposed to and that a human driver couldn’t have reacted as quickly.</p>

<p>What Cruise did not say, and what the DMV revealed Tuesday, is that after sitting still for an unspecified period of time, the robotaxi began moving forward at about 7 mph, dragging the woman with it for 20 feet.</p>
<p>Cruise had shown a video of the incident to reporters but barred them from posting it publicly. (Because of that restriction, The Times turned down Cruise’s offer.) The video shown to reporters ended with the robotaxi sitting motionless, but did not include the vehicle dragging the woman.</p>
<p>The DMV said Cruise showed it the same abbreviated video, and only later did the agency see the full version. The two sides are fighting about that version of events. Cruise told reporters it showed the DMV the full video from the start.</p>
<p>In response to a request for comment, a spokesperson for the DMV said it stands by the facts outlined in the orders of suspension.</p>

<p>Controversy has surrounded the company for months, after San Francisco’s fire chief lit into Cruise and another robotaxi company, Waymo, for interfering with firetrucks and emergency workers. Police said robotaxis were getting in their way too.</p>
<p>Dozens of such incidents have been reported, including robotaxis blocking an ambulance from exiting a firehouse, driving onto fire hoses and parking themselves there, bursting through police tape and getting tangled in downed utility wires. Cruise robotaxis sometimes gather together up to a dozen at a time to block pedestrians and other cars at busy intersections, a phenomenon whose cause remains a mystery, at least to the public.</p>
<p>Nonetheless, the California Public Utilities Commission, which regulates taxi fares, voted to allow a massive expansion of robotaxi service across San Francisco. Cruise Chief Executive Kyle Vogt soon started talking about big plans for explosive growth, including the introduction next year of a six-passenger pod-like vehicle with no steering wheel called the Origin. &#8220;The goal is to get to scale as quickly as we can in terms of the total number of AVs to make this business profitable and sustainable,&#8221; he said at the TechCrunch Disrupt conference in September.</p>

<p>Waymo, owned by Google parent Alphabet, is also planning to grow its fleets and move into new cities. It has already launched in Santa Monica and will soon expand to Los Angeles. Los Angeles officials are trying to get a close look at company plans, but are stymied by state law that gives cities little authority over robotaxi operations.</p>
<p>Other robotaxi companies are also gearing up to expand, including Zoox and Motional. Those companies are likely to draw more scrutiny in the wake of Cruise&#8217;s setback, said Bryant Walker Smith, an automated vehicle law expert at the University of South Carolina.</p>
<p>Alain Kornhauser, who heads the autonomous vehicle engineering program at Princeton, said the dragging incident is indeed tragic but it&#8217;s something that can be fixed. &#8220;The problem is, I don&#8217;t think anybody who&#8217;s writing code thought about a person being trapped under the car,&#8221; he said. &#8220;Now they can do something like mount a camera to make sure there&#8217;s no one under the car before it moves.&#8221;</p>
<p>People will be forgiving of odd robotaxi behavior if they trust the companies involved, he said. &#8220;But this covering-up business and not being forthright&#8221; does long-term damage to public acceptance, he said. &#8220;Didn&#8217;t we learn from Watergate that the coverup can be worse than the crime? They could be apologetic. They could say, &#8216;We&#8217;re not going to do that again.'&#8221;</p>

<p>LOS ANGELES — Los Angeles city officials are recommending the removal of a bankruptcy trustee who was tasked with rehabilitating 29 derelict buildings owned by the defunct Skid Row Housing Trust and overseeing the well-being of about 1,500 low-income tenants.</p>
<p>With the bankruptcy administration facing a financial collapse, the Los Angeles Housing Department also recommended that the City Council approve a $10 million loan to maintain and repair the buildings and pay bankruptcy costs for several more months.</p>
<p>Ann Sewill, director-general of the Housing Department, recapitulated a series of disputes with bankruptcy trustee Mark Adams over his alleged lack of progress and inability to obtain credit on reasonable terms, and said the loan should be made conditional on Adams being recalled becomes.</p>
<p>&#8220;The city has been considering possible alternatives to address the unfortunately disappointing performance of the current receiver,&#8221; Sewill wrote.</p>
<p>The recommendation is due to be heard by the city council&#8217;s budget and finance committee on Monday and could be presented to the full council as early as Tuesday.  A spokeswoman for prosecutor Hydee Feldstein Soto, who selected Adams for receivership, said she agrees with the recommendations.</p>
<p>However, the city cannot independently replace Adams because he was appointed by a Los Angeles Superior Court judge at the city&#8217;s request.  Instead, Judge Mitchell Beckloff would have to seek a motion to dismiss Adams and appoint a new receiver.  Beckloff gave Adams a clear endorsement at the final hearing on the case.</p>
<p>&#8220;I appointed you because I believe you are the right person for the job,&#8221; he said during the June 15 hearing.  &#8220;I still think you&#8217;re the right person for the job.&#8221;</p>
<p>In the report released on Friday, Sewill also gave a sober assessment of the difficult road ahead.  She wrote that some of the buildings may be &#8220;damaged beyond repair&#8221; and should be demolished, and that repairs and maintenance of underwater properties will likely cost well in excess of $10 million for an unknown amount of time.</p>
<p>Conditions inside the buildings have deteriorated in recent years as cash flow problems caused the nonprofit to default on maintenance and cut staff and security.  Nearly 800 of the trust&#8217;s 2,000 units have been foreclosed on rent subsidy due to unlivability.  Residents complain of dirt, clogged pipes, pest infestations and the constant intrusion of street dwellers who use drugs, set off fire alarms and sleep in hallways.</p>
<p>&#8220;We know that to attract responsible, experienced, supportive homeowners, the city and other government partners need to increase loan amounts to fund repairs, replenish reserves and (pay) all bankruptcy obligations,&#8221; Sewill wrote.</p>
<p>These costs could be borne in part by the limited partners who own some of the buildings at the Housing Trust.  But the non-profit organization, which collapsed financially earlier this year, is the sole owner of 12 of the buildings.  Then the city would likely have to bear all the costs, possibly with the help of government housing programs.</p>
<p>The report says the $10 million is necessary to ensure sufficient funding for at least four to five months.  At this point, more than half of the properties are expected to be taken out of receivership and taken over by other not-for-profit general partners.</p>
<p>But the remaining buildings, generally the oldest and most expensive to maintain, could run monthly deficits as high as $700,000.</p>
<p>Beckloff has approved the release of six properties to be acquired by PATH Ventures and one by LA Family Housing, both non-profit organizations that provide homeless services and develop and operate housing.  A further seven are expected to be released in late fall once permanent funding can be secured to replace the building loans used for construction or refurbishment.</p>
<p>However, these buildings are the most financially profitable in the portfolio.  They have been built or remodeled in recent years and still have limited partners who bear part of the cost.</p>
<p>Dissatisfaction with Adams had grown since his provisional appointment in April.  City officials, including Mayor Karen Bass, slammed him earlier this month after the property management company he hires sent eviction notices to hundreds of rent-arrearing tenants.  The terms of his appointment prohibit him from terminating a tenant for non-payment.  Adams said he did not approve the eviction notices and sent out letters withdrawing them.</p>
<p>The city&#8217;s confidence in Adams further soured when it learned that he had agreed to pay 15% interest on loans for costs he estimated were already up to $1.7 million for collateral was included.  The city claims that the terms of his appointment put a 10% cap on any loans.</p>
<p>During the June 15 hearing, Assistant District Attorney Alia Haddad Beckloff said the city was in talks with a possible replacement.</p>
<p>Sewill&#8217;s report elaborated on the city&#8217;s concerns.</p>
<p>Aside from being unable to secure adequate funding, she wrote, &#8220;he has not hired, and perhaps more importantly, has, sufficient staff to secure and operate the properties and make the necessary repairs.&#8221; he failed to submit the court-ordered reporting and accounting.&#8221; City and other authorities require.&#8221;</p>
<p>Adams, she wrote, has made insufficient progress on &#8220;resolving major code violations,&#8221; including repairing the fire/life safety systems, fixing <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a> issues in communal toilets, and restoring units that were broken for minor code violations were called for rehabilitation.  ”</p>
<p>Adams told the Los Angeles Times that he will respond to the city&#8217;s report in court next week.  He also cited Judge Beckloff&#8217;s support.</p>
<p>A review of Adams&#8217; filing by the Times, published shortly after his appointment last month, found that at some properties where Adams served as liquidator, tenants were at risk of eviction, owners lost their homes and several judges concluded that he had overstated his fees by six-figure amounts.  Additionally, in two cases comparable in size and scope to the Skid Row Housing Trust case, Adams left years before they were resolved, omitting key facts about his involvement in the court filings.</p>
<p>Feldstein Soto told The Times that she chose Adams based on a recommendation and did not conduct an extensive background check.</p>
<p>To replace Adams, the report said the city conducted an extensive search that identified Kevin Singer, the founder and president of Receiver Specialists, as the top candidate.</p>
<p>According to the report, Singer served as an insolvency practitioner for 23 years and previously owned a property management company that managed 75 buildings.</p>
<p>He received strong support from the mayor and city attorney of San Francisco for his performance as the liquidator of 11 properties owned by a woman who became known as the city&#8217;s cruelest landlady.</p>

<p>Citing a slew of issues and a loss of confidence, the LA prosecutor is now recommending that the person she was hired by a judge a few months ago remove control of the troubled Skid Row Housing Trust.</p>
<p>In a memo Friday, prosecutor Hydee Feldstein Soto and the city&#8217;s housing director expressed their support for asking the judge to replace Mark Adams as bankruptcy trustee &#8212; and for the city to loan up to $10 million to fix housing problems permit.</p>
<p>To motivate the judge to replace him, the city would offer the soft loan on the condition that Adams be replaced.  City council members are expected to take up the recommendation at a budget committee meeting on Monday.  Committee chairman Bob Blumenfield told LAist Friday afternoon that he supports the move to replace Adams.</p>
<p>&#8220;All of these red flags evolve from red flags to flashing red lights that say, &#8216;Be careful,'&#8221; Blumenfield said.</p>
<p>“We really must do everything we can to prevent a human tragedy from getting worse and also look after the public money.  Because that&#8217;s very much at stake,&#8221; he added. </p>
<p>WHAT IS A RECEIVER?</p>

<p>A liquidator is someone hired by a court to take control of a property and fix problems.  You essentially become the landlord, under the supervision of a judge and the city.  According to the city attorney, the Skid Row Housing Trust case is by far the largest court-ordered receivership in LA history.</p>

<p>Back in late March, Feldstein Soto had petitioned a court to give Adams control of the trust&#8217;s 29 properties, which house about 1,500 formerly homeless people &#8211; after the non-profit housing trust fell apart financially and many of its homes were deemed healthy and safe .</p>
<p>But in a shift in confidence, Feldstein Soto, along with LA Housing Department head Ann Sewill, recommended replacing Adams with Receivership Specialists&#8217; Kevin Singer for &#8220;some or all&#8221; of the properties.</p>
<h2>&#8220;Disappointing&#8221; progress</h2>
<p>&#8220;[Adams’] “The progress made in addressing serious violations of the regulations, such as  B. repairing the fire/life safety systems, fixing <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a> issues in communal toilets, and restoring units cited by HACLA for minor sanitization violations were disappointing,&#8221; the memo to the city council said .</p>
<p>“In addition, the property management only placed an order a few weeks ago [Adams] sent out three-day eviction notices to hundreds of tenants, which were then withdrawn, but which should never have been sent out.”</p>
<p>Feldstein Soto previously told the Los Angeles Times that the 451 eviction notices were illegal under the city&#8217;s Tenant Protection Act and violated his promise not to evict anyone for rent arrears alone.</p>
<p>The memo also said Adams did not hire enough staff to repair and secure the properties, and he failed to provide the court-ordered reporting and accounting that the city and other agencies require.</p>
<p>&#8220;It turned out that the bankruptcy administration could be better served with another bankruptcy administrator,&#8221; it says.</p>
<p>Adams did not respond to LAist&#8217;s request for comment Friday morning, and a spokesman for the prosecutor said they had not commented.</p>
<p>When he recommended Singer as Adams&#8217; replacement, officials wrote that Singer had worked on nearly 500 bankruptcy administrations nationwide &#8212; more than Adams&#8217; approximately 300 &#8212; and that San Francisco officials praised his work in the city, which included &#8220;a very challenging one.&#8221; Bankruptcy Administration&#8217; in the Tenderloin owned district.</p>
<p>When asked if Singer received more prosecution reviews than Adams, Blumenfield said he and others asked and &#8220;we were assured there were significantly more reviews.&#8221;</p>
<h2>What happens next</h2>
<p>The motion to extend city loans up to $10 million &#8212; assuming the court replaces Adams &#8212; will now go to the City Council Budget Committee for a decision.  This meeting is scheduled for Monday at 2 p.m</p>
<p>&#8220;One way or another, the public is being held accountable,&#8221; Blumenfield told LAist, saying he believes if the Housing Trust implodes, many of the residents will end up back on the streets with no other choice.</p>
<p>“An ounce of prevention is worth a pound of cure.  We need to be smart about this and get involved as early as possible to prevent a major catastrophe, which will also end up costing us a lot of money – and that&#8217;s why we are.&#8221; committing your own tax money.”</p>
<p>As part of the loan, Blumenfield said, the city will impose stricter requirements on the new recipient to bring the city up to speed &#8212; and consequences if it doesn&#8217;t.</p>
<p>Blumenfield said the city cannot require this at this time because receivership is a court-controlled process and the city is not a lender.</p>
<p>Ultimately, it will be up to LA Superior Court Judge Mitchell Beckloff to decide whether to replace Adams.  His support for Adams may be waning — last week, during a tense downtown LA court hearing, Beckloff removed seven properties from receivership and questioned Adams&#8217; efforts to improve the properties.  Still, the judge expressed his support for Adams, saying he felt he was the right person for the job.</p>
<p>It&#8217;s unclear the status of prosecutors&#8217; investigation into Adams&#8217; performance, which it revealed last week.  Her spokesman declined to comment on Friday.</p>
<p>The key to the future, Blumenfield said, is for the units to be renovated quickly so that they become financially stable.  Currently, hundreds of the housing units are ineligible for federal housing credits because the city has said they violate quality of life standards, including when it comes to issues like fire safety.</p>
<h2>Past Issues</h2>
<p>The move comes after wrongful eviction orders and reports by the LA Times and LAist of several judges finding problems with his previous receiverships, including significant overcharges for his company&#8217;s services.</p>
<p>LAist also reported earlier this month that a company Adams founded to serve as a bankruptcy trustee has been banned by the state from doing business since 2015 for unpaid taxes.  Adams told us he was looking into the matter and said his current business is in good shape.</p>

<p>Skid Row Housing Trust is a non-profit organization founded in the late 1980s and is the largest provider of subsidized housing in Skid Row, LA&#8217;s premier community for homeless people. <li>April 7: Judge Mitchell Beckloff of the Los Angeles Superior Court approves the prosecutor&#8217;s motion and appoints Adams as the bankruptcy trustee.  &#8220;We see the train falling off the cliff here,&#8221; a lawyer in Feldstein Soto&#8217;s office told the judge about the urgency of the situation.</li>

<li>June 15: Beckloff relieves Adams of control of seven of the properties after being at times frustrated with Adams&#8217; reactions.  Adams said the move could affect its ability to raise much-needed working capital.</li>
<li>June 23: The city attorney who originally recommended Adams for the job joins a senior city housing official in recommending replacing Adams and giving the city a loan of up to $10 million to redevelop the trust properties to grant.  The decision to replace Adams rests with the judge, and the credit decision now rests with the city council.</li>

<p>City officials said the stakes are high at the housing foundation.  For decades it has been one of the largest providers of affordable housing for the homeless in LA.  But the buildings have fallen into disrepair in recent years as the non-profit owner went bankrupt and faced financial ruin, the memo and Times reporting said.</p>
<p>On April 5, just before Adams took over, three people were found dead in a Skid Row Housing Trust building of suspected drug overdoses.</p>
<p>When Feldstein Soto announced in late March that she would seek receivership, which gave Adams control of the properties, she said the 1,500 people who live in the buildings are extremely vulnerable.</p>
<p>&#8220;[These] are among our most marginalized and vulnerable populations,” Feldstein Soto told reporters.  &#8220;If they lose their homes, there is little doubt that they will spread to our streets.&#8221;</p>

<p>Aber im Jahr 1980, im Alter von 28 Jahren, kehrte Mr. Halsey nach Hause zurück und fand ein „Zu verkaufen“-Schild vor der Farm neben seinem Elternhaus.  Es war seit 10 Generationen in der Familie seines Nachbarn, aber als die Eltern, denen das Haus gehörte, starben, mussten ihre drei Kinder eine damals enorme Erbschaftssteuer von 2,2 Millionen Dollar zahlen. <p>Zu dieser Zeit sahen sich Ackerland in den Vereinigten Staaten einem beispiellosen Entwicklungsdruck ausgesetzt, und Familien sahen sich aufgrund der Wertsteigerung ihres Landes mit Erbschaftssteuerproblemen konfrontiert.  Land Trusts wurden im ganzen Land entwickelt, um diese Probleme anzugehen, und 1982 wurde eine Organisation namens Land Trust Exchange gegründet. </p>
<p>Audrey und Charlie Raebeck, damals die Co-Direktoren der Gruppe für South Fork (jetzt die Gruppe für das East End), stellten Herrn Halsey dem Gründer der Land Trust Exchange, Andy Johnson, vor, der an der Erhaltung von Ackerland in Pennsylvania gearbeitet hatte.  Mr. Johnson, der einen Long Islander heiratete, war hier ein häufiger Besucher und brachte Mr. Halsey mit den Organisatoren von Land Trusts im Nordosten in Kontakt.</p>
<p>Herr Halsey, der einen Master-Abschluss in Planung und Organisation von der School of Social Welfare der UC Berkley hat, wusste aufgrund seiner Arbeit in Kalifornien bereits einiges über Non-Profit-Management, und diese neuen Verbindungen brachten den Peconic Land Trust auf den Markt richtiger Weg.</p>
<p>„Die frühzeitige Erschließung der Land Trust Community hat unsere Demonstrationsprojekte beschleunigt“, sagte er über die Organisation, die damals keine Mitarbeiter hatte und heute etwas mehr als 30 Mitarbeiter hat. „Unser erstes Stipendium war ein Startstipendium von die Long Island Community Foundation für 5.000 $.  Dadurch konnten wir etwas Platz aus dem Gästezimmer herausholen, in dem ich lebte.“</p>
<p>Herr Halsey verdiente sich seinen Lebensunterhalt, indem er auf Gurden Ludlows Farm in Bridgehampton Melonen pflückte und Kartoffeln sortierte, als er 1983 an der Gründung des Peconic Land Trust-Vorstands arbeitete. </p>
<p>Eines seiner ursprünglichen Vorstandsmitglieder, Deborah Light, besaß 230 Morgen landwirtschaftliche Felder und Wälder in Amagansett, und ihre Bereitschaft, am ersten Naturschutzexperiment des Land Trust teilzunehmen, brachte den Land Trust auf den Weg zum Erfolg.</p>
<p>„Sie sagte: ‚Okay, ich werde Ihr Versuchskaninchen sein, aber das bedeutet nicht, dass ich tun werde, was Sie sich ausdenken&#8217;“, sagte Mr. Halsey.  „Sie wusste nicht, dass der Plan auf ihren Zielen, Bedürfnissen und Umständen basieren würde.  Wir brauchten ihren Input, um etwas zu erschaffen, das für sie Sinn machte.“</p>
<p>Das Grundstück hätte leicht 200 Wohngrundstücke umfassen können, sagte Herr Halsey, aber zu Beginn ihrer Gespräche dachte Frau Light daran, 15 Grundstücke zu unterteilen und den größten Teil des restlichen Grundstücks der Bewirtschaftung zu überlassen.  Aber als sie mit Vorstandsmitgliedern immer wieder über das Grundstück ging, wurde ihr klar, dass sie keine neuen Häuser auf dem Grundstück sehen wollte.  Am Ende ihrer Diskussionen hatte sie beschlossen, drei Grundstücke aufzuteilen, deren Entwicklungsrechte an Suffolk County verkauft wurden, um die Verwaltung des Landes zu unterstützen. </p>
<p>Heute dient Quail Hill zusammen mit dem Landwirtschaftszentrum des Land Trust auf der Charnews Farm in Southold als Inkubator für neue berufstätige Landwirte im East End.</p>
<p>Quail Hill wäre auch der Beginn eines jahrzehntelangen Projekts, um mit einzelnen Landbesitzern zusammenzuarbeiten, wie sie ihre Vision für ihr Land verwirklichen können.</p>
<p>„Sie sind alle unterschiedlich, und man muss manchmal über den Tellerrand hinausschauen, um Lösungen zu finden“, sagte Mr. Halsey.  „Diese Herausforderungen führen manchmal zu neuen Tools, die wir zuvor noch nicht verwendet haben. <p>Die Schalentierzüchter Katie Marino, Karen Rivara und Melanie Douglass (lr) im Shellfisher Preserve des Land Trust, wo sie 2020 widerstandsfähige Jakobsmuscheln aus der Peconic Bay züchteten. </p>
<p>Unten auf der Bayview-Halbinsel in Southold befindet sich das Shellfisher Preserve, ein weiteres frühes Land Trust-Projekt, das ins Leben gerufen wurde, nachdem Paul Stoutenburgh, Vorstandsmitglied des Land Trust und bekannter North Fork-Umweltschützer, Herrn Halsey John Plock vorgestellt hatte, der die Shelter Island Oyster Company auf dem Gelände gründete im Jahr 1935.</p>
<p>„Diese Anlage war auf dem neuesten Stand der Technik, als sie gebaut wurde“, sagte Herr Halsey.  „Sie schufen eine Lagune mit einem Kanal, der eine Quonset-Hütte über dem Kanal hatte, was das ganze Jahr über einen Gezeitenstrom in und aus der Lagune erzeugte. <p>Herr Halsey erinnert sich, dass das Anwesen auf den Stufen des Rathauses von Southold versteigert wurde, nachdem die Familie Plock mehrere persönliche und geschäftliche Rückschläge erlitten hatte.  Er war bei dieser Auktion, wo niemand ein Gebot abgegeben hat.  Der Familienanwalt von Plock sah ihn dort und fragte: „John, hast du dein Scheckbuch mitgebracht?“</p>
<p>Der Peconic Land Trust arbeitete schließlich eine Vereinbarung aus, die es der Familie Plock ermöglichte, vier Wohngrundstücke zu entwickeln, aber die 14 Morgen, die die Schalentierzucht umfassten, schützte.  Sie ermöglichten den Eigentümern der neuen Baugrundstücke den Zugang zu den dortigen Dockflächen.</p>
<p>Der Land Trust schloss daraufhin eine Vereinbarung, dass die Cornell Cooperative Extension of Suffolk County, die ein nahe gelegenes Meereszentrum in Cedar Beach betreibt, das Grundstück verwaltet und den Schalentierzüchtern einen Ort gibt, an dem sie ihre Geschäfte erweitern können. </p>
<p>„Es war eine wirklich großartige Partnerschaft, die zur Restaurierung einer sehr einzigartigen Einrichtung führte“, sagte Herr Halsey.  „Es war ein klassischer Fall – es hat 10 Jahre gedauert, seit ich Mr. Plock vorgestellt wurde, bis er uns schließlich übergeben wurde.“</p>

<p>Herr Halsey sagte, dass der Land Trust dieses Jahr keine große Anzahl von Feierlichkeiten plant, außer um den Menschen zu danken, die ihre Arbeit unterstützt haben, bei ihrer jährlichen freiwilligen Dankeschön-Veranstaltung, dem Peconicinic, und bei ihren jährlichen Through Farms und Fields Gala, die am 6. August im Hafen der vermissten Männer in der Nordsee stattfindet.  Bei der Gala wird der Land Trust den Unterstützer Howard Marks von Oaktree Capital Management ehren, der mehr als ein Jahrzehnt lang Mitglied des Trustees Council der Gruppe war und maßgeblich dazu beigetragen hat, das Broad Cove-Projekt zu verwirklichen.</p>

<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">In art and beyond, money is fundamentally based on trust.  Our economic system works on the basis of society&#8217;s trust and enables cooperation and exchange.  However, if we trust money itself, why is art philanthropy so largely lacking in trust in artists?  The limited nature of many forms of grantmaking—such as project-based support—implies that we lack confidence in an artist&#8217;s ability to direct how they allocate funds to support their practice. </span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">Enter trust-based philanthropy – a style of support characterized by reciprocity, transparency and unconditional funding.  This is a model that has gained popularity throughout the philanthropic sector, but has not yet caught on in art.  However, it offers a promising solution to artist trust and offers a model for deeper, more meaningful support. </span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">Artists have been asking sponsors this question of trust for years, a dialogue that has significantly shaped the development </span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">the Rainin Scholarship</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">&#8211; an annual program we created with United States Artists to honor four anchor artists in the San Francisco Bay Area with $100,000 in unrestricted grants and additional support.  The Fellows can spend the money on anything they see fit.  This approach recognizes that artists&#8217; individual needs are different and they are the best experts on how to improve their practices.  Whether they choose to spend the money on housing, healthcare, or future projects, our approach emphasizes autonomy and real impact, values ​​consistent with the trust-based philanthropy model. </span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">The Rainin Fellowship embodies trust-based philanthropy and is rooted in the work of </span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">Trust-Based Philanthropy Project,</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">  A</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">    Five-year peer-to-peer funding initiative and platform addressing the inherent power imbalances between foundations and nonprofits.</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">    At the heart of this model is listening and learning.  In establishing the Rainin Fellowship in the Bay Area, we worked with both national and local partners to better understand the needs of artists in our communities.</span></p>

<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">Our research partners at Helicon</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">– a consultancy that works with artists, cultural leaders, philanthropists and other sectors to help mobilize the power of culture and creativity for an equitable and sustainable future</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">— found that the top four concerns expressed by artists in the region across all disciplines and age groups were housing costs and displacement;  the rising cost of living;  a brain drain as artists move out of the region in greater numbers;  and structural difficulties faced by artist-run organizations that struggle to recruit and retain staff.</span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">Given longstanding issues relevant to the Bay Area&#8217;s arts ecosystem, the program was designed to address the changing needs of artists.  Working across generations, practices, spaces and communities, each of our artist groups has different needs.  Trusting them, communicating their experiences, breaking down funding barriers and giving them the space to offer new perspectives is crucial.</span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">While this artist-centric approach emerged organically in our conversations with anchor artists in that particular region, we&#8217;ve found it resonates with larger conversations and shifts in the philanthropic landscape.  Through the lens of trust-based philanthropy, we have discovered ways of emphasizing reciprocity and the redistribution of power in our relationships with artists, reimagining the traditional patron-artist dichotomy and transforming it into a partnership and amplifying values, which are noticeably absent from our current social framework. </span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">These values ​​emerge at all levels of our community, beginning with the selection process.  Through community nominations and peer and field review panels, decision-making for the community is decentralized and collaborative, harmonizing both local and national perspectives.  United States Artists, which administers the program, provides applicants with detailed feedback and constructive criticism from the reader and panel reviews, allowing for transparency around the process itself.  Finally, by providing unrestricted funding as well as complementary, tailored support – such as partnerships with web designers, videographers, financial planners, mentors, PR and communications experts, and archivists – the grant opens up an infinite realm of generative possibilities for further artists&#8217; practices and furthers artists&#8217; careers.</span></p>

<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">This year&#8217;s Rainin Fellows explore the region&#8217;s history, amplify diasporic narratives, highlight systemic injustices, and honor and advance the Bay Area&#8217;s activist legacy.  Through our close partnership with them, we have learned more about their process-centric work and see further evidence why project-based funding is not the only answer to artists&#8217; structural challenges.</span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">For example, the work of Public Space Fellow Related Tactics</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">—</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">an artistic collaboration founded in 2015 between artists and creators Michele Carlson, Weston Teruya and Nathan Watson—</span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">foreground </span><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">transdisciplinary exchange and collective art-making, which has led to the group&#8217;s projects and conversations taking place across multiple timelines.  Theater grantee Sean San José is also committed to the organic processes of collaboration and longstanding creative partnerships across Magic Theater that don&#8217;t necessarily follow a linear timeline.  Similarly, film grantee Mohammad Gorjestani and dance grantee Joanna Haigood develop projects that are site-specific, iterative and engage members of their community.  Whether collaborating with the Public Defender&#8217;s Office or with aspiring dancers at Zaccho Dance Theatre, the continuous and multifaceted nature of their practices requires flexible schedules.</span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">Confidence in the artists&#8217; unique processes, the methods they choose, and the longevity of their collaboration is a central pillar of the Rainin Fellowship.  Through unlimited funding and additional support, we recognize that their impact lies not only in the individual projects they exhibit and execute, but also in the enduring legacy of their pioneering creative frameworks.</span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">The very architecture of our grantmaking process is deeply rooted in what we have learned from artists and the cultural field in general &#8211; lessons about emotional intelligence, empathy and the tremendous impact that holistic support can have on artists&#8217; lives.  We believe the bursary&#8217;s trust-based model could serve as a blueprint for other cultural funders, demonstrating how meaningful support of individual artists can strengthen our local and regional arts networks as a whole.</span></p>
<p><span class="amp-wp-inline-f62a86b1328cd4134bec55ddf6de989a">If society&#8217;s relationship to money is one of trust, it is imperative for us as art patrons to also base our support of artists on trust.  We challenge other funders in this space to reconsider how we can fuel creative innovation and enable artists to truly thrive by trusting artists—not only with unrestricted funding, but also by allowing them to share how we do can best support them.</span></p>

Diese Nicht-GAAP-Kennzahlen stellen keine Beträge dar, die dem Management aufgrund von Kapitalersatz oder -erweiterungen, Schuldendienstverpflichtungen oder anderen Verpflichtungen und Unsicherheiten zur Verfügung stehen, noch sind sie ein Hinweis auf Mittel, die zur Deckung des Barbedarfs des Unternehmens verfügbar sind, einschließlich seiner Fähigkeit, Ausschüttungen vornehmen.</p>
<p>Die Darstellung des prognostizierten EBITDA des Hotels und des prognostizierten Nettobetriebsergebnisses nach Kapitalrücklage durch die Gesellschaft sollte nicht als Alternative zum Nettogewinn (berechnet nach GAAP) als Indikator für die finanzielle Leistung des Hotels angesehen werden.
