Last month, the Ninth Circuit clarified that people who reject a valid shelter offering cannot be considered involuntarily homeless and, therefore, the city can enforce its laws against public sleeping and camping on sidewalks and in parks, in those cases.

In reviewing San Francisco’s appeal, Ryu asked the city to report how it trains law enforcement and street clearing crews, and to also identify which city workers have and have not been trained on the specifics of the injunction.

Regardless of the injunction, the city has been able to carry out most of its street cleaning and public safety operations, and can enforce many of its laws governing street and sidewalk activity. For example, under the injunction, the city can still clear encampments for accessibility, such as in the case of an emergency or providing room for a wheelchair passage, if they give 72 hours notice. The injunction does not impact law enforcement around health and safety codes, including drug use, and the city can still clear encampments for certain health or safety reasons.

Gov. Gavin Newsom — formerly the mayor of San Francisco — meanwhile has also criticized the judge’s rulings in San Francisco’s homelessness lawsuit, as well as similar cases and rulings that have provided the basis for Ryu’s decisions.

Those cases include Martin v. Boise and Johnson v. Grants Pass (PDF), which both have directed cities not to force unhoused residents to move unless they are offered shelter.

On Friday, Newsom issued an amicus brief (PDF) asking the U.S. Supreme Court to review the Grants Pass, Oregon case and urging the court to give cities more freedom to clear encampments.

“While I agree with the basic principle that a city shouldn’t criminalize homeless individuals for sleeping outside when they have nowhere else to go within that city’s boundaries, courts continue to reach well beyond that narrow limit to block any number of reasonable efforts to protect homeless individuals and the broader public from the harms of uncontrolled encampments,” Newsom said in a press announcement. “It’s time for the courts to stop these confusing, impractical and costly rulings that only serve to worsen this humanitarian crisis.”

Breed wrote on Monday on Medium that “over the next few weeks we will be reiterating and updating [city workers’] training and making sure they understand what they can and cannot do in line with the injunction and Ninth Circuit’s recent clarification.”

Shroff, the plaintiffs’ attorney, said that there’s never been any dispute over the definition of involuntarily homeless, and agreed the city can enforce sit-lie laws when someone rejects an appropriate shelter option.

He disagreed, however, with the idea that shelter is commonly rejected. Instead, he argues that the city has continued to sweep encampments without following protocols outlined in the city’s own policies, which include to offer shelter and to “bag and tag” personal belongings rather than disposing of them.

“The shelter system is at capacity every single day of the year because there is such a high demand for shelter and because for decades the city has failed to meaningfully invest in affordable housing for vulnerable residents of the city during the time of a tech boom and unprecedented and skyrocketing rents,” Shroff said. “They’re clearly seeking some justification for their continuing enforcement operations.”

SAN FRANCISCO – Among all the potential Father’s Day gifts out there, a broom ranks among the tackiest.

It’s exactly the present manager Bruce Bochy wanted anyway, but Oracle Park remains a sweep-free zone in series of at least three games for the Giants.

After taking the first two games of a three-game weekend set from the first-place Milwaukee Brewers, the Giants failed to break out the brooms in a 5-3 loss on Sunday.

“We would have loved to finish it off today and we could have, we had our chances,” Bochy said.

The defeat halted the Giants’ longest win streak of the season at four and prevented them from earning their first sweep in a three-game series this year. Bochy’s club hasn’t earned a three-game sweep since taking three from Arizona from June 29-July 1, 2018, and hasn’t picked one up at home in over a calendar year.

“I like the way we’re pitching, we’re keeping it close and we are creating those chances, that’s what you need to do,” Bochy said. “If you do enough of it, the odds are, somebody is going to come through for you.”

Giants starter Jeff Samardzija gave up a run in the first, second, fourth and fifth innings and his offense failed in its best opportunity to complete another dramatic comeback win. The Giants overcame a four-run deficit to win 8-7 on Saturday, but scored just once after loading the bases with no outs in the fifth inning of Sunday’s loss.

Catcher Buster Posey struck out against Brewers reliever Matt Albers with the bases loaded before Brandon Belt drove in pinch-hitter Pablo Sandoval with a sacrifice fly. A walk by Evan Longoria loaded the bases again for the Giants, but one of Saturday’s heroes, Brandon Crawford, popped out in foul territory to end the scoring threat.

The only thing swept away in Sunday’s game was Belt’s 18-game on-base streak, which began on May 23 and featured 17 walks.

Also, Bochy found two innings of work for both Derek Holland and Dereck Rodríguez after neither had pitched since June 8.

The first batter Holland faced, pinch-hitter Jesus Augilar, launched a 412-foot home run halfway up the left field bleachers to extend the Brewers’ lead to 5-3. Rodríguez finished the game for the Giants and tossed two perfect innings in relief, rebounding from a disastrous outing against the Dodgers in which he allowed two hits and two walks without recording an out.

“I liked the way he put that behind him and went out there against some good hitters and made some great pitches,” Bochy said. “I thought that was important for him.”

Samardzija needed to labor to finish off five innings Sunday as he threw 113 pitches while giving up nine hits and four earned runs.

“I know my numbers against some of those guys aren’t too great,” Samardzija. “So I knew I was going to have to go out there and have to battle and that we did, but that was about it.”

Milwaukee hitters consistently ran long counts and racked up 22 foul balls against Samardzija, who has had trouble pitching deep into games this season. The veteran starter owns a respectable 3.96 ERA, but he’s completed six innings in just three of his 14 outings in 2019.

“It was a gutty effort, he ended up giving up four, a lot of pitches and he had to work hard to get through it,” Bochy said. “But he kept us there and gave us a chance. We just didn’t cash in enough.”

After throwing 200 innings in five straight seasons from 2013-2017, diminished velocity and a shift in the Giants’ pitching philosophy has forced Samardzija to change his approach. Through 14 starts this year, Samardzija has now thrown 73 2/3 innings, putting him on pace to finish with roughly 160-to-170 innings in the penultimate season of a five-year contract he signed in December, 2015.

The anime feature “Poupelle of Chimney Town,” the first directorial film from Yusuke Hirota, takes place in a metropolis where the sky is always dark from smoke. The residents are policed by cloaked officials called inquisitors, who make it their business to suppress dissenters, particularly civilians who propose that there might be a world beyond the nearby ocean or the blotted-out firmament.

In this dystopia, animated in a way that suggests a steampunk Chutes and Ladders, Lubicchi (voiced by Antonio Raul Corbo), a lonely boy who works as a chimney sweep, makes his first friend: a garbage man — that is, a creature made out of trash — whom he names Poupelle (Tony Hale). (The name is similar to “poubelle,” which is French for trash can.) Poupelle’s origins are murky, but in a pre-title sequence, he appears to arrive from the stars, where Lubicchi’s father (Stephen Root), who disappeared, always urged his son to look.

Adapted by Akihiro Nishino from his picture book of the same name, the story evokes familiar touchstones: “The Wizard of Oz” (in Poupelle’s Scarecrow-like headwear and the climactic deployment of a hot-air balloon); “E.T.” (boy-alien friendship); and “WALL-E” (the landfill aesthetic). The allegory is semi-coherent but intriguing. Effectively, this movie asks what would happen if the existence of a self-devaluing currency caused radical libertarians to create Big Brother to protect people from a central bank.

Trying to get a read on the film — while admiring its palette and off-kilter character details (Lubicchi has an odd vampire overbite) — keeps “Poupelle” fun for a while. But the film ultimately shies away from its most disturbing ideas, falling back on a comforting sentimentality.
