<p>May 17, 1929 &#8211; August 4, 2015</p>
<p>Passed away peacefully at his home in San Rafael surrounded by his wife, daughters, the family dog and close family friends.<br />Known as Raleigh to family and Jim in the business world, he was born May 17, 1929 in Portland, OR, son of Audrey Ewing Bates (Colonel Grahame M. &#8220;Todd&#8221; Bates) and Joseph B. Wheeler. He was raised by his Mother, Grandmother Ethel Ewing, and Sister Hyacinth of the Dominican Nuns.</p>
<p>As a young child, Raleigh moved between Portland, San Francisco, Benicia, Larkspur, Los Angeles and Ohio attending several schools including St. Catherine&#8217;s Academy, the Larkspur Corte Madera School, St. Brigid&#8217;s school, graduating from St. Ignatius College Prep in San Francisco. After high school he attended City College and USF. Drafted in the US Army in 1951 he served honorably at Ft. Ord then on the frontline in the Korean War. In November 1952 he returned to marry Magdaline Theodorelos of San Francisco a neighborhood girl whom he met at 14 yrs. of age, his wife over 62 yrs. Early in their marriage they lived in San Francisco, settling back in Marin at the home they built in San Rafael in 1962. Shortly after he started Wheeler <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="Plumbing" data-wpil-keyword-link="linked">Plumbing</a>, raised a family becoming an active member of Blessed Sacrament Parish. </p>
<p>Raleigh was an avid reader, a history buff and a world traveler always looking for a new adventure. Together with his wife, he traveled to over 50 countries, 6 continents, with the African continent at the top of his list. But it was his yearly camping trip to Yosemite with his family and his children&#8217;s friends that was his favorite adventure. Many memories were made in Yosemite including climbing Half Dome several times; packing in the high country of Tuolumne and in the 1930&#8217;s camping for a month at time with his grandmother. </p>
<p>Generous in time and support not only to his children but many of the neighborhood kids, he attended all their sporting events, readily gave advice, lived by and instilled a strong work ethic, hired those that needed work, assisted with their college tuition and in building their homes. His storytelling and sense of humor was appreciated by all that knew him.</p>
<p>Raleigh is survived by his wife Magdaline, daughters Elizabeth Wheeler Welch (Peter) and Sarah Wheeler. He was predeceased by his son Eric who died tragically in 1977. His brother J. Kelly Wheeler of Tiburon passed away on August 17, 2015. </p>
<p>The Rosary will be held at 5:00pm, Thursday, August 27, 2015 at Monte&#8217;s Chapel of the Hills, San Anselmo, CA. The Mass will be held at 11:00am, Friday, August 28, 2015 at Most Holy Rosary Chapel of St. Vincent&#8217;s School for Boys, One St. Vincent Drive, San Rafael. In lieu of flower donations in Raleigh&#8217;s memory may be made to Heartland Hospice or Guide Dogs for the Blind.<br />Assisted By Monte&#8217;s Chapel Of The Hills San Anselmo (415) 453-8440</p>

<p>Two Bay Area fires pushed smoke into San Francisco on Thursday afternoon.</p>
<p>The first fire was a prescribed burn in San Rafael’s China Camp State Park scheduled from 9 a.m. to 4 p.m., according to the Marin Fire Department. “Neighborhoods surrounding China Camp State Park may see and smell smoke due to a prescribed fire operation,” the department said.</p>
<p>In El Cerrito, firefighters battled a downhill blaze moving toward Julian Drive near the intersection of Douglas Drive and Potrero Avenue, according to a post by police shortly after 2:30 p.m. At 3:11 p.m., police said, the fire had been extinguished and advised the public to avoid the area while firefighters continued cleanup operations.</p>
<p>Potrero Avenue between Navellier Street and Julian Drive remained closed during cleanup operations.</p>

Bill was born on May 11, 1935 to William and Hilda Boitano in San Francisco.  Bill attended Marin Catholic High School, where he made lifelong friends and was a proud sophomore.  Throughout his career, Bill has worked as a buyer in the <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a> and heating industry.  He proudly served in the US Air Force where he developed a love for airplanes.  Upon returning to Marin County, Bill met and married the love of his life, Marlene, and raised two children.  He took great pride in coaching Little League baseball for many years along with his son Ken.  Bill is survived by his loving wife Marlene Boitano at sixty, his son Ken Boitano, his daughter Debbie Boitano Macchello (Gerry) and his adored only grandchild John William Boitano.  He is also survived by brother James Boitano, and his father, mother, and sister Deanna preceded him in death.  Bill was a devoted husband, father and nonno.  He was very proud of his Genoese heritage and loved all things Italian.  He and Marlene enjoyed an active social life, including attending weekly masses at St. Isabella&#8217;s Church, playing league bocce, playing sports, watching the SF Giants, family dinners, and being the family handyman who was able to fix almost anything.  Bill&#8217;s fondest memories were of his grandson&#8217;s vacations, barbecues and sporting events.  Most of all, Bill appreciated spending time with his family, who meant the world to him.  Bill is sorely missed from the many lives he touched and will never be forgotten.  A funeral service will be held on Saturday, April 29, 2023 at 1:30 p.m. at St. Isabella&#8217;s Church in San Rafael, California.  A private funeral will follow at a later date.  The family is asking for donations in Bill&#8217;s memory to a charity of their choice.</p>

<p>Almost all residents of the San Rafael RV park received eviction notices this week after the property owner lost a rental dispute in the US 9th Circuit Circuit.</p>
<p>In the Feb. 10 decision, the three-judge panel confirmed that the district court dismissed property owner Donna Chessen&#8217;s contention that the city ordinance stabilizing RV rentals constituted illegal &#8220;earnings.&#8221;</p>
<p>The ruling was the latest development in the saga that followed when the city sued Chessen and Harmony Communities, the Stockton-based property management group, in December 2021 for seeking rent increases allowed above the ordinance.</p>
<p>In the Court of Appeals ruling, the judges wrote that the Rent Control Ordinance had been in effect for 15 years before Chessen and her husband bought the property in 2006.  Additionally, the ruling states that there was a &#8220;final ruling by a state court that found the property is subject to the ordinance.&#8221; This refers to a 2004 ruling.</p>
<p>On Monday, eviction notices were delivered to approximately 40 addresses at the RV park at 742 Francisco Blvd.  west, according to local residents.  The notice says tenants have until October 31 to vacate their homes and remove them from the property, otherwise they could face legal consequences.</p>
<p>&#8220;Where can I go? How can I afford to move?&#8221; said Alexander Vernimmen, a 70-year-old resident who has lived at the park for 18 years. Vernimmen said he lives with his 96-year-old mother, and her only income are social security payments.</p>
<p>Vernimmen said he was served with a separate eviction notice from the court on Dec. 30, which gave him just two business days to respond due to the bank holiday weekend.</p>
<p>&#8220;They prey on old disabled people and poor families with children,&#8221; he said.</p>
<p>The dispute began in August 2021 when tenants were notified of the rent increases, which Harmony said would bring the average monthly rent to $650.  City officials and residents pushed back, saying the increase violates the city&#8217;s RV rental stabilization ordinance, which is designed to protect the park&#8217;s affordability.</p>
<p>The argument depends on what type of houses there are.  Harmony says they are recreational vehicles and are therefore exempt from a city rental control ordinance that covers mobile or manufactured homes.  The city and local residents say otherwise.</p>
<p>Chessen argued in court that there were only mobile homes on the site.  If a mobile home is used as a place of residence for nine months or more continuously in the same place, it is considered a mobile home under the country&#8217;s civil code.</p>
<p>Marin County Superior Court Judge James Chou in July granted a request for an injunction barring the defendants from charging rents in excess of the city&#8217;s rent stabilization ordinance for mobile homes.  The regulation caps rent increases for RV sites at 75% of consumer price index adjustments.</p>
<p>In July, the property management gave the tenants letters of intent to close the RV park, but did not give a date.  The closure of an affordable housing mobile home park requires the owner to complete a tenant impact report and take steps to move tenants or pay fair market value for eviction.</p>
<p>In the July letters to residents, Harmony staff wrote that &#8220;the park has been operating at a loss for several years and is struggling to keep this park open so that no resident has to relocate.  The reality is the land is worth a lot more than running an RV park for affordable housing.”</p>
<p>According to the property tax report, the 1.26 hectare property was built in 1952.  The property is owned by the K&#038;M Family 1997 Trust, a company controlled by Chessen.  The property has an estimated value of $2.92 million recorded in 2022.  Property taxes last year totaled $74,006.</p>
<p>Assistant City Attorney Genevieve Coyle said in an email that the city agrees with the 9th Circuit&#8217;s ruling and that the city is still pursuing its separate litigation in Marin County Superior Court to enforce the city&#8217;s ordinance.  A trial is scheduled for May.</p>
<p>&#8220;We are aware of the eviction notices and are reviewing them,&#8221; Coyle said.</p>
<p>Fabian Quezadas is one of a group of newer residents renting the mobile homes provided by Harmony.  He lives in one unit, his brother and family live in a separate one.  They both have leaks and <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a> issues, he said.  Quezadas said they pay $1,295 a month in rent for each house.</p>
<p>&#8220;These units are uninhabitable,&#8221; he said.  “In the first rainy week we had leaks, plumbing issues, I found black mold in the bathrooms and around the windows.  When I told Harmony they said I never informed them of any mistakes and now they are trying to evict me.&#8221;</p>
<p>Quezadas said the situation had gotten so bad that he was temporarily staying at a hotel.  He said he complained to a Harmony Communities president, Matthew Davies.  &#8220;He said to me, &#8216;If I don&#8217;t like it, you can move out.  We can terminate your lease.&#8217;”</p>
<p>Attempts to reach Chessen were unsuccessful.  Her attorneys, Dan Rudderow and Chris Chapman, did not respond to a request for comment.</p>
<p>Davies also did not respond to a request for comment, but Heywood Jablóm, a company spokesman, emailed a statement.</p>
<p>&#8220;This property consists entirely of RVs, which are legally exempt from city ordinance,&#8221; Jablóm wrote.</p>
<p>“The park is losing money because rents aren&#8217;t covering expenses.  The city has been told that the park will have to close because it is losing money, but the city has refused to compromise,&#8221; Jablóm wrote.  “The city wants a private landowner to single-handedly subsidize affordable housing in San Rafael, but the park is cash-strapped and losing money every month.  Since the city has refused to comply with its own ordinance, the only option is to close the park.  We expect all residents to be moving out by October and look forward to remodeling the property for higher and better use.”</p>
<p>Resident Gilbert Nicholls, who has lived there in his home since 2004, said he remains optimistic after hearing the federal ruling.</p>
<p>&#8220;You&#8217;re picking at straws,&#8221; he said.  &#8220;You won&#8217;t win.  They won&#8217;t beat us.&#8221;</p>
<p>Harmony Communities was also involved in a controversial 2018 rent increase for RV sites in San Leandro, which has no rent control.  In a case in Fresno County, residents of the Shady Lakes mobile home park filed a lawsuit two years ago, alleging the company unfairly hiked rents and harassed renters.  They are reportedly still facing rent increases.</p>
<p>Company representatives rejected the claims in both cases.  The company continues to buy affordable housing communities in low-income areas in cities like Gilroy and last year Golden, Colorado.</p>

<p>San Rafael police said this week they have apologized to residents and first responders in San Francisco after an officer drove a homeless man accused of causing a disturbance to a residential neighborhood and left him there.</p>
<p>The incident unfolded last month, when San Rafael police were called to Northgate mall around 4:43 pm on July 30 after a caller reported a man was threatening security guards at the mall, San Rafael police Lt.  Scott Eberle said.</p>
<p>The officers &#8220;determined that no crime had taken place,&#8221; and the man did not meet the threshold to be held for psychiatric evaluation, Eberle said.</p>
<p>The man whose identity has not been released was known to the police, but the department could not confirm whether he lived there or had ties to San Francisco.  He was not a resident of San Rafael&#8217;s city-run homeless camp, police said.</p>
<p>Eberle said to an officer suggested San Francisco as a destination, &#8220;and the subject said he wanted to go.&#8221;</p>
<p>Once in the city, the man allegedly tried to start a fire and began undressing in a driveway in the residential neighborhood where he was dropped off, said Jen Kwart, a spokeswoman for the San Francisco City Attorney&#8217;s Office.</p>
<p>He was transported to an area hospital “for a medical complaint,” according to the San Francisco Fire Department.</p>
<p>&#8220;It is disturbing to think another jurisdiction would drop off someone experiencing homelessness or mental health challenges in the middle of a residential neighborhood with no services or resources around,&#8221; San Francisco City Attorney David Chiu said in a statement.  &#8220;We will hold any jurisdiction accountable that is proven to engage in this behavior.&#8221;</p>
<p>A bystander noticed the San Rafael police vehicle and shot a video of police dropping the man off near 14th Avenue and Lake Street.  Eberle said the person who took the video shared it with San Rafael police, which immediately began an internal investigation.</p>
<p>Eberle said it was not the department&#8217;s practice to drive people to other jurisdictions and leave them there without notifying local authorities.</p>
<p>&#8220;This does not reflect any practices of the San Rafael Police Department,&#8221; Eberle said.  “We do not condone this officer&#8217;s actions.</p>
<p>“We devote so much time and resources and energy to helping combat the homelessness crisis that our city is experiencing, and we have hired and promoted people within the department to specialize in addressing the homelessness crisis,” Eberle said.</p>
<p>The department has a mental health liaison, Lynn Murphy, who will at times connect homeless people with resources outside the city, “but she does so in a professional manner, and just doesn&#8217;t transport somebody without gaining approval from the receiving resource or service provider,” Eberle said.</p>
<p>The officer and a supervisor who was involved in the incident remain on active duty as an internal investigation continues, Eberle said.  He declined to identify the officer or the supervisor.</p>
<p>Chiu&#8217;s office only became aware of the full scope of the incident approximately a week ago.</p>
<p>San Rafael police said the department has apologized to the city and county of San Francisco, the neighborhood where the homeless man was dropped off and the firefighters and police who responded after neighbors complained about the man&#8217;s behavior there.</p>
<p>&#8220;In my 22 years of being here, I have heard of this happening in the past, but this is not normal or routine,&#8221; Eberle said.</p>
<p>&#8220;We do acknowledge that we made a mistake,&#8221; Eberle said.  &#8220;We&#8217;re extremely apologetic to everyone who was impacted.&#8221;</p>
<p>Such incidents have occurred before.  In 2013, San Francisco south of the state of Nevada, alleging it had improperly bused dozens of psychiatric patients from the Rawson-Neal Hospital in Las Vegas into San Francisco without food, water or medication and dropped them in the city to fend for themselves.</p>
<p>That lawsuit was settled when Nevada agreed to only bring patients to California if they were going to a specific home address, medical facility or program with someone waiting for or accompanying them.  Nevada also paid $400,000 to San Francisco.</p>

<h4 class="title">The family of a young educator mourns the victim killed in the Big Rig Rigmond-San Rafael bridge crash</h4>
<p>The family of a man killed in a burning big-rig crash on the Richmond-San Rafael Bridge say the young San Francisco educator had a promising life ahead of him.  Next week he would have been 32 years old.</p>
<p><span class="dateline"><strong>SAN FRANCISCO</strong> &#8211; </span>Family members remember Michael Baroja as loving and hardworking.</p>
<p>He died after a large drill crashed into his stuck car while driving home from work.</p>
<p>The 31-year-old worked at Robert Louis Stevenson Elementary in the Sunset neighborhood of San Francisco for six years.</p>
<p>His parents and sister said he loves helping children.</p>
<p>&#8220;It really fills my heart when the kids share the pictures and the parents share with us,&#8221; said Daisy Baroja, his mother.    </p>
<p>Baroja&#8217;s parents and sister found solace in the outpouring of support from students, parents and school staff.</p>
<p>He had been a tech educator and after school teacher.</p>
<p>&#8220;I didn&#8217;t realize how much of an impact he had on the school,&#8221; Daisy said.</p>

<p>Just before 7 p.m. on the night of January 26, the California Highway Patrol said Baroja&#8217;s 1988 Toyota Supra stalled while traveling eastbound on the Richmond-San Rafael Bridge.  His car caught fire after a large drill rig hit it from behind. </p>
<p>Baroja was trapped in his car and died at the scene.  Investigators said drugs and alcohol were not factors.</p>
<p>&#8220;My heart was beating really fast. My chest felt really empty. I was really cold,&#8221; his sister Kristine said.</p>
<p>“He is a very loving child.  We are very close,&#8221; said his father Zosimo Baroja, he and his son had built the Toyota Supra involved in the accident together. </p>
<p>Working on old cars was her hobby, as was fishing.</p>

<p>The family spent a lot of time together.</p>
<p>They said Baroja was on his way home to San Pablo after work when he was killed. </p>
<p>&#8220;It&#8217;s so hard because he had everything in front of him, everything.  Everything was lined up for him,&#8221; said Kristine, her brother planning to marry his longtime girlfriend and scheduled to leave for Hawaii just two days after his death. </p>

<p>He hoped to go back to school to become a recognized teacher.</p>
<p>“Mike meant so much to us.  He was loved so much,” said retired teacher Dennis Molina, Baroja, known to his students as Mr. B, helped them with his computer skills and kindness. </p>
<p>“He delivered computers to their homes.  He was on the phone with the parents,&#8221; said Molina. </p>
<p>Her loved ones said Baroja had a short but impactful life.</p>
<p>&#8220;I wish I could see him again,&#8221; said his father Zosimo Baroja.</p>
<p>The family plans to hold memorial services for Michael Baroja on February 10 and 11 at 4:30 p.m. at the Fairfield Funeral Home </p>
<p>He would have celebrated his 32nd birthday on February 9th. </p>

<p>SAN RAFAEL (CBS SF) &#8211; Marin County authorities notified residents of widespread road flooding in San Rafael, Mill Valley and other areas and warned people to avoid certain areas due to extreme flooding on Sunday afternoon.</p>
<p id="caption-attachment-944268" class="wp-caption-text">(CBS)</p>
<p>Many roads were under 2 feet of water and impassable, San Rafael police said in a warning around 2:15 p.m.</p>
<p>&#8220;The floods are expected to worsen due to another flood in addition to the amount of precipitation from the atmospheric river,&#8221; police said in a statement.</p>
<p>San Rafael officials said the downtown flooding was concentrated in the area east of A Street.  There are road closures around the 2nd and 3rd street from the A-Strasse to the motorway entrance.</p>
<p>Shortly after 3:45 p.m., the San Rafael Office of Emergency Services tweeted images of flooding in residential areas.  Officials warned that much of downtown San Rafael was flooded and asked residents to stay at home.</p>

<p>According to city officials, there have been over 330 emergency calls for the fire brigade or police since midnight, four times the average call volume.  The San Rafael Public Works staff are also responding to calls, helping clear trees from the streets and doing what they can to keep drainage free.</p>
<p>Local residents are advised to expect additional flooding, gusts of wind, and possible power outages before the main storm system wears off around 9 p.m. on Sunday.  The rain will last through the night and into the morning.</p>
<p>Multiple blackouts are currently affecting some traffic lights and pumping stations in San Rafael and throughout the North Bay and Greater Bay Area.  PG&#038;E crews are responding to multiple reports of damage to power lines and pylons.</p>
<p>Meanwhile, the Marin County Sheriff tweeted about flooding in other areas and road closures.</p>
<p>A section of the Shoreline Highway in Olema was closed due to flooding from Sir Francis Drake / Hwy 1 to Sir Francis Drake / Hwy 1 in Point Reyes.</p>

<p>Mill Valley also saw flooding in the Sycamore Triangle neighborhood.  Residents there were told to raise their vehicles in the Mill Valley Community Center.</p>

<p>Mill Valley Police later confirmed that a number of roads were closed due to local flooding.</p>

<p>The sheriff also tweeted at around 4 p.m. that flood sirens went on in Ross, San Anselmo, and Fairfax as Corte Madera Creek reached its banks.</p>

<p>Residents have been advised to vacate the area and go to higher elevation areas if they are near streams or creeks.</p>
<p>The city administration in Sausalito declared a state of emergency on Sunday afternoon due to widespread storm damage.</p>
<p>At 3:30 p.m., more than 800 PG&#038;E customers were without power.</p>
<p>City officials also reported fallen trees and power lines and said residents of the Marinship Park tent camp had been evicted, prompting the city to ask Marin County to build housing in Southern Marin.</p>
<p>The Sausalito Library at Litho Street 420 will remain open until 9 p.m. to protect people without electricity.</p>

<p>SAN RAFAEL (KPIX) &#8211; Authorities began clearing a North Bay homeless camp located under a San Rafael freeway overpass late Monday morning.</p>
<p>Both Caltrans and city officials said they had no choice but to force those living there without shelter to flee.</p>

<p>The entire eviction process will take hours.  Crews arrived late morning to begin cleaning up the tents and huts under the US Highway 101 flyover at the intersection of Fourth and Heatherton near downtown San Rafael.</p>
<p>People who lived in tents and cars had assembled an entire neighborhood made up mostly of looted objects.  They called the dismantling of the camp a major systematic failure.</p>
<p>&#8220;This place was a good place of healing and peace for the people,&#8221; said camp resident Christian Gift.</p>
<p>After the Caltrans crews started hauling items and clearing the warehouse, the people who lived here said the workers could destroy their homes, but it wouldn&#8217;t destroy their mood.</p>

<p>In all of California, housing is only available for about 30% of the homeless.</p>
<p>“It is devastating when your community is torn apart;  what you built, what you could bring together and merge, and then the state comes and tears it to pieces, ”said Robbie Powelson of the Marin County Homeless Union.</p>
<p>San Rafael officials say local and state leaders have worked hard for the past five years to end chronic homelessness by providing services and support.  This particular camp on state property under Highway 101 has grown significantly since the pandemic began.  The city says it just got too big.</p>
<p>&#8220;The reason there are so many people under the viaduct is because when people go to San Rafael and try to pitch a tent, the SRPD snatched their tents from people,&#8221; explained Powelson.</p>
<p>Caltrans says police and fire calls in the area of ​​the camp have doubled, including calls for violent crime and theft.</p>
