Bay Properties is excited that the partnership with APE will continue the legacy of the Castro Theater and Castro neighborhood.&#8221;</p>

<p>Another Planet Entertainment is partnering with BuildOUT California, the world&#8217;s first LGBT industry association for construction and architecture, as part of the renovation and restoration of San Francisco&#8217;s historic Castro Theatre.</p>
<p>“The Castro Theater is a cathedral to the LGBTQ communities,” said Mary Conde, Vice President for Another Planet who is in charge of the overall Castro Theater Project.  “It&#8217;s absolutely expected and appropriate that we partner with LGBTQ firms as we revitalize this irreplaceable icon for future generations.  We&#8217;re thrilled to partner with BuildOUT moving forward.”</p>
<p>“Another Planet is the definition of a local company rooted in San Francisco and the Bay Area and sensitive to gay community and architectural concerns,” said BuildOUT founding member Paul Pendergast.  &#8220;There&#8217;s a lot of work to be done and we&#8217;re thrilled that LGBTQ contractors and vendors will be at the front of the line when considered for this work.&#8221;</p>
<p>Often overlooked in the fields of construction, LGBT contractors are getting renewed opportunities through the work of BuildOUT and partnerships such as the one with Another Planet.</p>
<p>“As a lifelong San Franciscan, a member of the LGBTQ community and a Latino, the Castro Theater holds a very special place in my heart,” said Nick Colina, COO of Anco Iron and Construction, a third generation San Francisco firm based in the Bayview Hunters Point.  &#8220;A very special moment in my life was when I got take my mom, Dr.  Colina, to the Gay Men&#8217;s Chorus on Christmas Eve where we celebrated family and our community!  As a gay man in the steel industry, a project like the improvements to the Castro Theater comes along once in a lifetime.  To work on a building designed by Timothy Pflueger is a tradesperson&#8217;s dream.&#8221;</p>
<p>“To be able to provide electrical construction supplies on the historic Castro Theater project would be an honor for my LGBT-owned/certified business,” stated Sandra Escalante, CEO of Laner Electric Supply.  “A building with the iconic status of the Castro Theater deserves to have safe, reliable, state of the art electrical systems throughout.  As a member of the LGBTQ community from the Philippines, my friends there had heard of the theater and have seen photographs of the Castro Theatre;  it&#8217;s famous even back home.  It would be an honor to work on this project.&#8221;</p>
<p>When the project is ready to proceed, Another Planet Entertainment will hold construction project meetings with key representatives from BuildOUT California with the express purposes of providing information outlined below:</p>
<ul>
<li>project timeline and schedule;</li>
<li>unbundled contract opportunities;</li>
<li>clearly articulate any/all insurance, bonding, and pre-qualification requirements to potential subconsultants and subcontractors;</li>
<li>and introductions to key trade subcontractors in areas where LGBTQ/allied businesses with the proper qualifications, experience, and capacity can actively compete for bid subconsultant and subcontracting opportunities.</li>
</ul>
<p>Also being considered are construction and project management, inspection services, advertising, media and community engagement, catering, event planning and production, public and neighborhood notification services, print production, and more.</p>
<p>“We&#8217;re looking forward to working with Another Planet Entertainment to make meaningful introductions between qualified subconsultants and subcontractors who have relevant experience, qualifications, and capacity to provide real value on the Castro Theater Project,” said Pendergast, noting that Another Planet has long been committed to the LGBT community and employs many members of the LGBT community.  &#8220;This is the definition of a big rainbow win.&#8221;</p>

<p>SAN FRANCISCO (CBS SF) &#8212; Bay Area concert promoter Another Planet Entertainment announced Wednesday that it is working with the owners of San Francisco&#8217;s Castro Theater to renovate the landmark and present live events at the venue.</p>
<p>The concert promoter said it will partner with Bay Properties, Inc., owners of the Castro Theater since the historic building was built 100 years ago, to both rehabilitate the building and plan the events held there.</p>

<p>In a press release posted on Another Planet Entertainment&#8217;s website, the concert promoter said it plans to implement &#8220;significant improvements to sound, lighting, production, HVAC and the theatre&#8217;s branding,&#8221; among other facets of the building.</p>
<p>Bay Properties vice president Chris Nasser Padian called the move &#8220;the next evolution of our historic theater&#8221; in the press release.</p>
<p>The publication noted the organizer&#8217;s previous work in preserving and enhancing historic buildings such as the Fox Theater in Oakland, the Greek Theater in Berkeley, and the Bill Graham Civic Auditorium in San Francisco.</p>
<p>&#8220;The Castro Theater is a beautiful building that we will be upgrading for better use in the future,&#8221; said Gregg Perloff, CEO and co-founder of Another Planet Entertainment, in the publication.</p>
<p>The press release said the venue would host a variety of events, including comedy, music and film, as well as community and private events.</p>

<p>The Castro Theater has hosted a few live concerts presented by independent show promoter FolkYEAH in recent months, but only a handful of films &#8211; including the premiere of The Matrix Resurrections &#8211; have been shown at the popular cinema since the pandemic began.</p>
<p>The website for the Castro, which used to contain the theater&#8217;s online movie schedule, now redirects to a page on the Another Planet website with a link to the official announcement and an email address for private event rentals.</p>
<p>In the past, the Castro has been a key theater for several major local film festivals, including the San Francisco International Film Festival, Frameline (the San Francisco International LGBTQ Film Festival), and Noir City.</p>
<p>Some people lamented the end of the Castro Theater&#8217;s run as an independent repertory film house on social media, including the Mission District&#8217;s Roxie Theater.</p>

<p class="rtejustify">The importance of ensuring that trademark registrations accurately reflect the trademarks used has been highlighted by the recent decision of a delegate of the trademark registry at Planet Plumbing SW Works Pty Ltd against Green Planet Maintenance Pty Ltd [2021] ATM 32.</p>
<p class="rtejustify">The Hearing Officer ordered that registrations for two “Planet Plumbing” logos be removed from the register after the owner, Planet Plumbing SW Works Pty Ltd (<strong>PP</strong>) failed to oppose a non-use registration from Green Planet Plumbing Pty Ltd (<strong>IT DOES NOT MATTER</strong>) under Section 92 of the Trade Marks Act 1995 (Cth) (<strong>The act</strong>).</p>
<p class="rtejustify">The representations of the trademarks originally registered in 1999 and 2009 were as follows:</p>

<p class="rtejustify">However, since 2010 PP has been using a different form of the logo, which was registered as follows:</p>

<p class="rtejustify">If a party requests the removal of a trademark for non-use, Section 100 of the Act requires the trademark owner to demonstrate that they used the trademark in good faith &#8220;or the trademark with additions or changes that do not materially affect its identity&#8221; on the goods or services for which it is registered.  This use must have taken place within the period of 3 years that ends one month before the submission of the request for non-use (<strong>Relevant period</strong>).</p>
<p class="rtejustify">Since PP had been using the current mark during the relevant period, PP challenged the request for non-use, claiming that the marks in question had been used with &#8220;additions or changes that do not materially affect their identity&#8221;.</p>
<p class="rtejustify">PP argued that the word element &#8220;planet sanitary&#8221; and the device elements in the controversial brands were separable, with the device elements simply adding “flavor and emphasis”.  The words “Planet Klempner” continued to be used during the relevant period, which was the use of the controversial trademarks after the appraisal.</p>
<p class="rtejustify">However, the Hearing Officer rejected this proposal and adopted the &#8220;substantial similarity&#8221; test as pronounced against Link Esso Standard Oil (Aust) Ltd (1963) 109 CLR 407 at 414 by Windeyer J in Shell Co (Aust) Ltd , the examination of whether “additions or changes” affect the “essential identity” of a mark involves a direct comparison of the mark with the alleged use.</p>
<p class="rtejustify">In a direct comparison of the controversial brands with the current brand, the hearing officer came to the conclusion that &#8220;an overall impression of dissimilarity between the respective brands arises when it matters&#8221;. [their] indispensable characteristics &#8220;. Despite some similarities between the words of the contested marks, the other elements were also considered to be essential and salient features and these elements lacked similarity.</p>
<p class="rtejustify">Since PP had clearly intended to abandon the old logos that were featured in the controversial trademarks in favor of the current trademark, the Hearing Officer ruled against any discretion in order to maintain the registrations.</p>
<h3 class="rtejustify"><strong>The central theses</strong></h3>
<p class="rtejustify">This decision underscores the importance of carefully selecting which trademarks to register and ensuring that trademark protection strategies are reviewed whenever a business is renamed.  Trademark registrations can be removed due to non-use if the trademark actually used has significant differences from the registered trademark, even if they have common word elements.</p>
<p class="rtejustify">In many cases it is advisable to aim for a separate registration of the brand name as a simple word mark.  In this case, if PP had simply registered the words PLANET <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="PLUMBING" data-wpil-keyword-link="linked">PLUMBING</a>, it might have required only a single registration instead of three and might have successfully opposed the removal of the disputed marks.  When a composite logo trademark is registered and renamed, it is sometimes possible to adapt the appearance of the trademark to the current usage.  In other cases, a new logo can justify a new registration instead.  In both cases, rebranding offers the opportunity to review and improve a company&#8217;s brand protection.</p>
