A man is currently suing the Texas Pete hot sauce company and many assumed the case would be dismissed. Not so fast.

Back in October of last year, we found out about a strange lawsuit that Texas Pete Hot Sauce had filed against them. Nothing is wrong with the hot sauce itself, but a man by the Phillip White went to purchase the hot sauce in September of 2022. He was looking to buy some authentic Texas hot sauce and went to his grocery store in California. He saw the name Texas Pete, picked it up and bought the bottle for his meal. He was shocked to find out after purchasing that Texas Pete is not a Texan. Texas Pete is made in North Carolina.

They have filed the class action lawsuit on behalf of Mr. White, they released their 49 page lawsuit claiming that people believe this hot sauce is made in Texas. “By way of its false marketing and labeling, [Texas Pete] knowingly and intentionally capitalizes on consumers’ desire to partake in the culture and authentic cuisine of one of the most prideful states in America,” the complaint alleges.

Many thought this lawsuit would just go away, U.S. District Judge Maame Ewusi-Mensah Frimpong denied the motion to dismiss the lawsuit. He actually wrote a twenty page letter on why this lawsuit is moving forward. If you care to read it, it’s in full below.

Court denies motion to dism… by FOX8

“Though it is true that the imagery of the solo white star and lassoing caricature are not exclusive to the state of Texas, taking the imagery and text of the label as a whole, this argument does not discount the possibility that a reasonable consumer would believe that the products are based in or originate from Texas.”

According to the Texas Pete website, “So how is it that a tasty red pepper sauce made in North Carolina happens to be named ‘Texas Pete’ anyway?” Legend has it that, when Sam Garner and his three sons, Thad, Ralph and Harold, were trying to come up with a brand name for this spicy new sauce they had created, a marketing advisor suggested the name “Mexican Joe” to connote the piquant flavor reminiscent of the favorite foods of our neighbors to the south. “Nope!” said the patriarch of the Garner family. “It’s got to have an American name!” Sam suggested they move across the border to Texas, which also had a reputation for spicy cuisine. Then he glanced at son Harold, whose nickname was “Pete” and the Texas Pete cowboy was born.”

I guess we wait and see if Texas Pete will have to cough up some dough on their name they have been using for literal decades.

Instead, Catalano took six gold chains and two gold rings while the victims were not at home, the affidavit said. The jewelry is said to have been kept in different locations in a large bedroom closet.

MPs said after being read his rights, Catalano admitted stealing the jewelry.

Sunday’s MLB action started with a bang when Pete Alonso made a surprise return to the Mets lineup about two weeks early after suffering a wrist injury. That was the injury headliner of the day, but there’s still a lot more to come after 15 games.

MLB Injury Report: Monday, June 19

Pete Alonso (wrist), New York Mets — Well, that was quick. When Alonso was brought to the IL last week with a bruised bone and a sprained wrist, he was expected to be out for at least three weeks. But just 11 days later, the first baseman was back in the Mets’ lineup as of Sunday afternoon. He went 0-4 with three strikeouts, so there’s clearly some rust, but Alonso seems good enough to swing the racquet normally:

Julio Urias (thigh)/Daniel Hudson (knee), Los Angeles Dodgers – Finally, some good news for the Dodgers’ pitching team, who have been struggling lately, particularly during this weekend’s win over the San Francisco Giants. Urias, who has been out since last month with a thigh strain, and Hudson, who has not played at all this year while in rehab after knee surgery, are expected to rejoin the team before the end of the month:

Evan Phillips probably holds the most leverage spots, but given how much manager Dave Roberts loves to shuffle and combine based on matchups, Hudson should still have a lot of work to do in the ninth inning.

Sean Murphy (hamstring), Atlanta Braves – As expected, Murphy was absent from Sunday’s squad after leaving Saturday’s game with a hamstring injury, but there was good news nonetheless: an MRI showed only an irritation and no actual strain. The backstop may need a few more days off, but the team is hoping, at least for now, that it won’t need to be deployed to the IL.

Casey Schmitt (forearm)/Alex Cobb (oblique), San Francisco Giants – It was a bad day for batters, who were plunked when Schmitt took a pitch off his arm at Dodger Stadium. The rookie was forced to leave the game but it appears that was just a precaution – his x-rays were negative and he should be back in the line-up soon.

Cobb, meanwhile, was placed on the IL with an oblique strain. While we’ve watched this type of injury ambush pitchers for several weeks, the Giants don’t seem overly concerned. Manager Gabe Kapler told reporters the righty felt some tightness throwing a bullpen over the weekend, which the team wanted to do to ensure he had more time to get things right. It’s possible that Cobb just missed a start or two.

Ian Hamilton (groin)/Nestor Cortes (rotator cuff), New York Yankees – Not much was going well for the Yankees this weekend in Boston, but at least there was some movement on the injury front. Hamilton, who had emerged as a key midfielder, scored twice in a clean inning in his first rehab appearance at Double-A Somerset. The right-winger later told reporters he expects to need at least two more sorties but could be ready by next weekend.

As for Cortes, he’s throwing for the first time since he was sidelined with a rotator cuff tear earlier this month:

There’s still a long way to go for the left-hander — he probably won’t return to the New York rotation before the All-Star break — but it’s a start.

Tanner Houck (face), Boston Red Sox – The Red Sox issued an update on Houck a day after the right-hander was hit in the face by a line drive.

Houck did suffer some sort of facial fracture — and not just the contusion he was originally diagnosed with — and was placed on the injured list, but all things considered, the outcome could have been a lot worse. Thankfully, it looks like the right will be fine, although there’s no timeline for his return to the mound just yet. The team hasn’t revealed who might fill Houck’s place in the rotation; Nick Pivetta and Corey Kluber would be obvious candidates.

jonathan india, Cincinnati Reds – India equalized early in the eighth inning with a home run on backfield, but were forced out of the game two innings later after being knocked out by a double play. Good news for Cincy: The Reds clinched the win in their 10th game for the eighth consecutive year and their second baseman appears to be doing well.

Lars Nootbaar (back), St Louis Cardinals — We’d say Nootbaar seems ready to return to St. Louis:

Reports surfaced early Sunday afternoon that the outfielder — who started a rehab stint at Triple-A Memphis this week — could leave the IL as early as Monday, and he responded by hitting a home run a few hours later. The team won’t make a decision until they see how his sore back is reacting, but it certainly sounds like he’ll be back in the next few days.

Alejandro Kirk (Hand), Toronto Blue Jays — Kirk was another pitch hit victim on Sunday. Toronto’s loss to the Texas Rangers left hand lacerated and bruised. X-rays were thankfully negative, but it remains to be seen how long it will be before the backing can swing a racquet comfortably again. Danny Jansen has had the most starts behind the plate lately anyway.

Miguel Amaya (Wrist), Chicago Cubs – We told you that there were a lot of batters plunked on Sunday. Amayas was one of the scariest, a 96mph fastball right off his wrist that left him prone in pain for quite a while, but manager David Ross said his catcher seemed to avoid anything too serious:

The rookie has been swinging a hot racquet since his debut last month, earning more and more playing time off the record.

Jeimer Candelario (thumb), Washington Nationals — Candelario was left out of the Nats’ lineup late on Sunday, and manager Davey Martinez told reporters after the game that his third baseman suffered a bruised thumb bone during Saturday’s game. He’s under consideration on a day-to-day basis for now, but the team will likely wait until Monday or Tuesday to see how they react before making a decision on a return.

Michael A Taylor (Head), Minnesota Twins — If Amaya didn’t have the scariest HBP of the day, then Taylor certainly did. The midfielder was hit in the back of the head by a mistaken curveball by Tigers substitute Alex Lange in the eighth inning, catching him just under his batting helmet as he tried to duck out of the way. Taylor left the game with a so-called head bruise and eventually went to the coaching bench under his own steam. Manager Rocco Baldelli said initial tests showed no concussion-like symptoms. He’s already been ruled out of Monday’s game but it’s too early to tell if he’ll need a call-up for IL.

Matt Vierling (rear), Detroit Tigers — Vierling was also late and missed Sunday’s game with back spasms just days after returning from an IL stay with back pain. That doesn’t bode well, of course, although the team hasn’t offered an update yet. The outfielder has .529 hits so far this month – and even got endorsed by the Oakland Athletics Twitter account at the All-Star Game – so it would be a huge loss to be forced to miss any more time.

ST. PETERSBURG, Fla. (WFLA) — According to the Pinellas County Sheriff’s Office, a St. Petersburg man allegedly stole thousands of dollars from a client and an employer in two separate schemes.

According to an affidavit, 41-year-old David Gillispie was painting a woman’s home when, unbeknownst to her, he obtained the customer’s checkbook and credit card.

Riverview’s principal was among 18 people arrested for human trafficking. Two teenagers rescued, officials say

Officials said Gillispie forged 25 checks and made 28 credit charges on the victim’s account between October 16, 2021 and November 18, 2021. In all, he is accused of stealing $18,200.61.

Gillispie was spotted on surveillance video doing the counterfeit check transaction. According to the affidavit, his name was also on the checks as the recipient of the stolen funds.

However, the sheriff’s office said this wasn’t the first time the handyman had stolen from customers.

In a second affidavit, the PCSO stated that Gillispie illegally took payments from customers while working as a sales representative for Spray Gunner between October 2020 and May 2021.

According to officials, the thefts were discovered when the business owner noticed a sharp drop in sales and realized his customers had high balances.

New York City fires more than 1,000 workers over vaccination requirements

The victim traced the balances to Gillispie’s work computer, where the employer found an open PayPal account on the workstation.

The affidavit states that the PayPal account is a clone of Spray Gunner’s official account, but is used to send payments directly to Gillispie.

Investigators found that Gillispie used multiple accounts to receive these payments and provide customers with large amounts of credit.

MPs said goods were dispatched to these customers with no payment made to Spray Gunner.

In total, the company lost $14,539.74.

Officials arrested Gillispie on Friday and charged him with two counts of fraud (fewer than 20,000).

The Dutch Sinterklaas differs from Santa Claus in a few essential ways. His physique is slimmer (less belly under the white beard), he does not live at the North Pole, but in Madrid – and instead of driving a reindeer sleigh, he takes a boat to the Dutch coast to bring presents.

And instead of relying on helper elves, Sinterklaas is supported by a character called Zwarte Piet or Black Pete – traditionally portrayed by whites wearing black faces, Afro wigs and red lipstick.

After Prime Minister Mark Rutte long defended the character and even admitted in the past to painting his own face black, he announced in June that his views on Black Pete had changed. Although he was on the verge of calling for a ban, he said social pressures would soon force the figure to retire. He also admitted that there were “systemic problems” with racism in the Netherlands.

Rutte’s announcement came after the Minnesota police murder of George Floyd, when large crowds of protesters took to the streets of Amsterdam and other Dutch cities to protest against racial injustice.

For Jerry Afriyie, who heads an Amsterdam-based advocacy group called Kick Out Zwarte Piet, Rutte’s words were long overdue. Getting others to see Black Pete as a racist has been his mission for a decade.

Over the years, Afriyie has been pelted with beer cans and bananas and targeted with death threats for his stance on Black Pete. Last November, in The Hague, a group of masked men armed with baseball bats and fireworks tried to end a peaceful meeting between Afriyie and other activists.

Still, Afriyie (whose middle names are Luther and King) is committed to dialogue. Every Sinterklaas season he leaves his home in Amsterdam and travels to Dutch cities and villages where Black Pete is still publicly celebrated in an attempt to reach consensus that Black Pete is racist.

“You talk and talk and talk and talk until you reach a consensus”

Last year, committees in several Dutch cities agreed that Black Pete should not appear in their city’s Sinterklaas parades, but more than a dozen smaller cities affirmed the opposite: Black Pete would be welcome at their parades and school performances.

He has been told by many of Afriyie’s associates that it is impossible to reach consensus on Black Pete’s issue; the country is too divided. But consensus building has a unique place in Dutch politics and society.

Some scholars say that the Dutch value attached to collective action is built into the landscape. Much of the Netherlands would be under water if it weren’t for a system of dikes to protect the country from flooding. The Dutch “polder model” of consensus building takes its name from the Dutch word for land below sea level, which used to be the seabed.

Former Prime Minister Wim Kok used his polder consensus-building skills to legalize same-sex marriage in 2001. This made the Netherlands the first country in the world to do this.

Amma Asante, a former MP and the only black woman in office during her tenure, says the polder model means “you talk and talk and talk and talk until you reach consensus” and “it works best when we do.” are able to do so “. to put aside our strongest beliefs about how things should be done or what the world should be like. “

From Black Pete to Chimney Pete?

Black Pete first came to prominence in the 1850s when minstrel shows became popular in the United States. The Netherlands outlawed slavery in their colonies in 1863, but previously some wealthy families were bringing enslaved people from those colonies to their homes in Amsterdam for work. Black Pete’s original costume with brightly colored satin sleeves mimicked the way families dressed enslaved black children.

Yet defenders of tradition often claim that Black Pete is “dirty” simply because he came down the chimney – he’s not even Black.

Afriyie always saw the chimney explanation as a way to silence black perspectives. He, Asante and many other black Dutch people were called “Black Pete” as an insult.

“The country is telling you, ‘Try not to see it,’” says Afriyie. “As if what you see is not true.”

But he wondered if this denial of the problem might actually offer a solution. He suggested replacing Black Pete with a new character named Chimney Pete with just one soot stain on his face – someone like Bert, the chimney sweep in Mary Poppins.

Black Pete’s defenders hated the idea. Blackface is the tradition, they argued. But many Afro-Dutch thinkers also disagreed. Gloria Wekker, author of White Innocence: Paradoxes of Colonialism and Race, says Chimney Pete is “a surface solution.” Soot or blackface, tradition itself was tainted.

But Chimney Pete prevailed. In cities where Black Pete has been banned from Sinterklaas parades, Chimney Pete has taken his place. This November, the boat with Sinterklaas will again reach the Dutch coast, accompanied by an entourage of Chimney Petes.

Asante admits she doubted consensus building on racism could work, and she was surprised to see large crowds gathering in support of the Black Lives Matter movement in the Netherlands this spring. Without all the years of “poldering” and dialogue about Black Pete, she wondered if the murder of George Floyd in the Netherlands would have sparked a conversation about racism.

HomeLight, which provides a platform that provides real estate agents and their clients with expertise in the property buying and selling process, announced Monday that the location in the Westshore Concourse Center will serve as the company’s operational hub for Florida.
