<p>SAN FRANCISCO &#8212; A federal judge on Wednesday denied a motion to move the trial of a man charged in <span class="link">last year&#8217;s attack against former U.S. House Speaker Nancy Pelosi&#8217;s husband</span> at their San Francisco home, saying she wasn&#8217;t convinced the court wouldn&#8217;t be able to find impartial and fair jurors in the San Francisco Bay Area.</p>
<p>David DePape&#8217;s defense attorneys argued that the intense publicity the case has received means he won&#8217;t get a fair trial in the city. They had asked Judge Jacqueline Scott Corley to move the trial to Eureka, a city near the border with Oregon. The federal trial is set to start Nov. 13.</p>
<p>Federal public defender Angela Chuang said local media attention has tainted the pool of jurors. In its motion asking for the change of venue, the defense said a survey it commissioned shows many potential jurors already believe DePape is guilty of the crimes and would be unable to change their minds.</p>

<p>Judge Jacqueline Scott Corley pointed out that the case received national attention and that the defense survey also showed many people in Eureka are also familiar with the details of the case.</p>
<p>She also said it could be hard to find such a jury in Eureka because the population the court could pull from is 326,000, compared to 5.5 million in the Bay Area.</p>
<p>&#8220;I agree with you that to ensure Mr. DePape has an impartial jury, we are going to have to pull a lot of jurors and make sure we question them,&#8221; Scott Corley said.</p>
<p>&#8220;I actually think we will have a way harder time if this case is transferred &#8230; because the number of people we&#8217;re pulling from is a magnitude smaller,&#8221; she added.</p>
<p>Prosecutors say DePape <span class="link">broke into the Pelosis&#8217; San Francisco home on Oct. 28</span> seeking to kidnap the former speaker — who was out of town — and instead beat her 83-year-old husband with a hammer. The violence sent shockwaves through the political world.  </p>
<p>DePape, 43, pleaded not guilty to federal charges of attempting to kidnap a federal official and assaulting a federal official&#8217;s family member. He <span class="link">also pleaded not guilty to state charges, including attempted murder, burglary and elder abuse</span>. He remains jailed without bail. The state trial hasn&#8217;t been scheduled.</p>
<p>Chuang and federal public defender Jodi Linker also said in their motion they fear potential jurors in San Francisco could be biased against DePape because Nancy Pelosi, who has represented the city in Congress since 1987, remains a popular figure in the Bay Area.</p>
<p>Eureka is in rural Humboldt County and is politically more conservative.</p>
<p>They said Bay Area media outlets have extensively covered the case and played video footage of the assault on Paul Pelosi, the 911 call, and a police interview of DePape shortly after his arrest.</p>
<p><span class="link">Footage of the attack was released to the public in January</span> after a California judge denied prosecutors&#8217; request to keep it secret.</p>

<p>SAN FRANCISCO (AP) — Paul Pelosi recounted publicly for the first time Monday what happened the night he was attacked by a man in the San Francisco home he shares with former U.S. House Speaker Nancy Pelosi, recalling how shocking it was to see a man standing at his bedroom door, then how the man whacked him in the head with a hammer.</p>
<p>“It was a tremendous sense of shock to recognize that somebody had broken into the house and looking at him and looking at the hammer and the ties, I recognized that I was in serious danger, so I tried to stay as calm as possible,&#8221; Pelosi told jurors as he testified in the trial of David DePape, who is shown on video carrying out the attack.</p>
<p>Prosecutors say DePape bludgeoned Pelosi in the early hours of Oct. 28, 2022, just days before the midterm elections, and that he had rope and zip ties with him. DePape has pleaded not guilty to attempted kidnapping of a federal official and assault on the immediate family member of a federal official with intent to retaliate against the official for performance of their duties.</p>
<p>Defense attorney Jodi Linker told jurors last week that she won’t dispute that DePape attacked Pelosi. Instead, she will argue that DePape believed “with every ounce of his being&#8221; that he was taking action to stop government corruption, the erosion of freedom in the United States, and the abuse of children by politicians and actors. She said that means the government’s charges that DePape was trying to retaliate or interfere with Nancy Pelosi’s official duties don’t fit.</p>
<p>Paul Pelosi&#8217;s testimony came on the trial&#8217;s second day, after prosecutors brought forward FBI agents who collected the electronics DePape was carrying and searched the room he lives in, a U.S. Capitol police officer who watches the surveillance cameras at the Pelosis’ home and another who has protected Nancy Pelosi since 2006, a Bay Area Rapid Transit police sergeant, and a digital forensics expert.</p>
<p>Pelosi said he has not discussed the attack with anyone and has encouraged his family not to as well “because it has been too traumatic.”</p>
<p>The Pelosis&#8217; home has an alarm system with motion detectors, but Pelosi said he never put it on when he was home alone because his movements would trigger it.</p>
<p>He recalled being awakened by a man bursting into the bedroom door asking, “Where&#8217;s Nancy?” He said that when he responded that his wife was in Washington, DePape said he would tie him up while they waited for her.</p>
<p>“We had some conversation with him saying she was the leader of the pack, he had to take her out, and that he was going to wait for her,” Paul Pelosi said.</p>
<p>Earlier, prosecutors played police body camera footage showing Pelosi facedown on the floor as paramedics help him. One holds a white towel against Pelosi’s head as another puts a neck and head brace on him before several first responders help him onto a stretcher chair. Pelosi’s face and hands are covered in blood.</p>
<p>He later underwent surgery to repair a skull fracture and injuries to his right arm and hands.</p>
<p>Some witnesses helped verify time stamps on footage from surveillance cameras at the Pelosis’ home, which are set to Eastern Time, and on BART trains, which were an hour behind Pacific Time.</p>
<p>FBI Special Agent Stephanie Minor, who was in charge of the investigation, testified that video showed DePape hit Paul Pelosi at least three times.</p>
<p>DePape showed little emotion during most of the testimony, only smiling and releasing a muted chuckle when, at his attorney&#8217;s request, Minor read a list of topics that appeared on his blog. They included Communism, corruption, COVID-19, Jewish people, “Gamergate,” guns, immigrants, memes and wamon, a word used to describe a woman who does nothing but complain.</p>
<p>Minor testified DePape started gathering items for the attack two months beforehand, in August 2022, purchasing body cameras, USB memory sticks, a large backpack and a sleeping bag. She also said FBI agents found two inflatable unicorn costumes and a box of crayons but didn’t explain the purpose of those items.</p>
<p>Federal prosecutors have said the evidence and FBI testimony will show DePape researched his targets online, collecting phone numbers and addresses, even paying for a public records service to find information.</p>
<p>If convicted, DePape faces life in prison. He also has pleaded not guilty to charges in state court of attempted murder, assault with a deadly weapon, elder abuse, residential burglary and other felonies. A state trial has not been scheduled.</p>
<p>Pelosi&#8217;s testimony mirrored the series of events that prosecutors previously laid out.</p>
<p>He recounted how DePape had let him enter the bathroom, where Pelosi was able to grab his cellphone and use it to call 911 as DePape looked on, urging Pelosi to tell police that he was a friend. Pelosi said he tried to tell police what was happening without aggravating DePape.</p>
<p>Pelosi said he then suggested the two head downstairs after DePape told him he was tired and wanted to sleep. Pelosi recalled being thankful when the police arrived, only for DePape to then hit him with the hammer. He said he woke up in a pool of his own blood.</p>
<p>After his arrest, DePape, 43, allegedly told a San Francisco detective that he wanted to hold Nancy Pelosi hostage. He said if she told him the truth, he would let her go and if she lied, he was going to “break her kneecaps” to show other members of Congress there were “consequences to actions,” according to prosecutors.</p>
<p>DePape slept in a cot in a garage with no kitchen or bathroom in the Bay Area city of Richmond, according to photographs shown by prosecutors. He had been doing odd carpentry jobs to support himself and allegedly told authorities he had other targets, including a women’s and queer studies professor, California Gov. Gavin Newsom, actor Tom Hanks and President Joe Biden’s son Hunter.</p>

<p>On delivery day, the San Francisco Beekeepers Association has 2 million bees in 200 boxes to sort out.  For 20 years, Paul Koski, “the bee whisperer of San Francisco,” has been making sure people and insects are not harmed.</p>
<p>When the Bee Whisperer was &#8220;in,&#8221; as indicated by a Charlie Brown-style sign on his desk, Koski was there with a soft voice and calm demeanor that inspired confidence in the hives he could reach his hand in, without the need for a glove without being stung.</p>
<p>&#8220;Everyone in the San Francisco beekeeping community recognized Paul as the highest authority in the club,&#8221; said Marc Johnson, chief trainer and manager of the hive.  &#8220;Even the bees liked Paul.&#8221;</p>
<p>But this year the bee whisperer is &#8220;out&#8221;.  Koski died on Good Friday, April 7, a month before confinement day.  According to his son Peter Koski, he had a congenital heart defect that progressed to heart failure.  His condition deteriorated to the point where he was living in assisted living in Montara when he died.  He was 78.</p>
<p>He leaves behind the Beekeepers Association and generations of science students at Mission High and Washington High School, where he taught biology and chemistry for 40 years.  He also coached cross-country and track and field at both city schools. </p>
<p>He often trained with his team, running 3 to 5 miles three times a week, mostly at Golden Gate Park across from his house.  Beekeeping took place on the weekends, although he was on call every hour of every day to retrieve an unruly swarm that had broken loose from a backyard or rooftop beehive.</p>
<p>“Paul was very gentle with the bees.  He really cared about her well-being,&#8221; said Meredith May, author of The Honey Bus, who mentored Koski during her four-year tenure and wrote a &#8220;Beekeeper&#8221; column for The Chronicle. </p>

<p>At the time, two beehives were kept on the roof of The Chronicle food building on Natoma Street.  Then came the day when one of the hives swarmed and the bees escaped to congregate on the fence outside the adjacent Bar Tempest.  The bartender on duty called the beekeeping association, who dispatched Koski to quietly collect the swarm, mostly without gloves, which was a vote of confidence in the bees.</p>
<p>&#8220;All the bar patrons came out and watched him do it,&#8221; May said. &#8220;He was the bee Batman.&#8221;</p>
<p>Paul Arthur Koski was born on March 14, 1945 in Elizabeth, New Jersey, where his father, Carl, was a superintendent at a chemical plant.  He soon got a job at the Reichhold Chemical Plant in South San Francisco and the family moved to Donner Avenue in San Bruno.  </p>
<p>The house backed onto an open area and there were seven children who benefited from it.  After two older sisters, Paul was the eldest of five boys and the leader of the pack, overseeing back gate and wilderness adventures.  Bare arrowheads were of great value, as were red-tailed hawks.</p>
<p>  &#8220;He was very scientific, always interested in nature,&#8221; said his older sister, Ruth Dow.</p>
<p>At Capuchino High School, Koski found another outlet for his energy on the cross-country and track teams.  He worked nights as a janitor at the See&#8217;s Candy factory in South San Francisco. </p>
<p>After graduating in 1963, he enrolled at San Francisco State College, where he ran the half-mile in track and field and earned his letter.  To save money, he lived at home and commuted to school on a Honda 250 Scrambler motorcycle.  </p>
<p>He graduated from San Francisco State University in 1967 and also earned his teaching license.  As early as 1968 he was teaching and training at Mission High.  A year later, he married Lille Foster, a long-distance runner he met in State.  They lived in San Bruno and Koski was still riding the Scrambler when he was involved in a motorcycle accident, resulting in a severe fractured right ankle that required a needle to be inserted.  But he kept running, pin and all, an activity that got easier after they bought a house on Lincoln Way across from Golden Gate Park.</p>
<p>On clear nights, he placed his homemade telescope on the sidewalk in front of his house and invited passers-by to take a look at the stars and planets. </p>
<p>&#8220;He was fascinated by nature and wanted everyone else to experience his awe,&#8221; said Peter Koski, a data analyst at a law firm.  His father developed an interest in mycology.  &#8220;We went mushroom hunting in the park, but it was mostly scientific observation,&#8221; said Peter.  &#8220;He told me he once ate magic mushrooms for scientific reasons.  He gave a very dry description of its effects.  Not like Timothy Leary.”</p>
<p>As a long-distance coach, Koski was similarly dry and quiet and a reserved motivator.</p>
<p>&#8220;He was fun,&#8221; said Denise Leo, who had Koski as Washington&#8217;s head varsity cross-country and track coach in the early 1990s.  “He had a reserved way of presenting things.  When it was raining, he would say, &#8216;Go outside and run between the raindrops.&#8217;” When the words didn&#8217;t work, he would go outside and run through the rain with his team.  That inspiration brought five Washington cross-country runners, three boys and two girls, to the 1992 state convention in Fresno.</p>

<p>Leo went so far as to follow her coach to the San Francisco State cross-country and track teams, taking over the Washington cross-country team when Koski retired from coaching in 2000.  give the go-ahead.  He rarely spoke about his sideline beekeeping, but eventually word got around and a new hive at the school will be dedicated in his honor, with a plaque in his honor.</p>
<p>&#8220;Mr. Koski was the career change of my life,&#8221; said Leo, a librarian who still trains part-time in Washington. &#8220;He had confidence that I could take on the team, which I never thought possible.&#8221;</p>
<p>After the divorce in 2003, Koski had more time for the bees, who moved with him from Sunset to his new home in Ingleside.  He wrote the Code of Conduct for San Francisco Beekeeping as distributed by the San Francisco Department of the Environment.  He also helped beekeepers everywhere, including on the roof of Glide, where he kept a beehive and gave classes to community members.</p>
<p>&#8220;Keeping bees in an urban area can be a bit problematic,&#8221; he said, with typical understatement, to a Chronicle photographer who visited him.  </p>
<p>When Koski joined the San Francisco Beekeepers Association in 1993, there were 65 members.  He has since held the titles of club president and chief instructor, and at the time of his death was still an apiary manager and a member of the board.  Membership has grown to 450 and they will gather at St. John Armenian Apostolic Church on delivery day, Saturday May 6th.  </p>
<p>&#8220;There will be no one to replace the Bee Whisperer,&#8221; Johnson said, &#8220;but there will be a small team trying to replace him.&#8221;</p>

<p class="css-at9mc1 evys1bk0">Six days after Paul Pelosi, spokeswoman Nancy Pelosi&#8217;s husband, suffered a fractured skull in a vicious attack, he was released from Zuckerberg San Francisco General Hospital.</p>
<p class="css-at9mc1 evys1bk0">Mr Pelosi, 82, is resting at home recovering from injuries to his head, arm and hand.  He spent most of his time in the hospital in intensive care, according to a person familiar with the matter.</p>
<p class="css-at9mc1 evys1bk0">&#8220;The Pelosi family is grateful for the wonderful outpouring of love, support and prayers from around the world,&#8221; Ms. Pelosi said in a statement.  &#8220;Paul is grateful to the 911 dispatcher, EMTs, trauma care team, ICU staff and all medical staff at ZSFGH for the excellent and compassionate life-saving treatment he received after the violent attack at our home.&#8221;</p>
<p class="css-at9mc1 evys1bk0">She added that her husband &#8220;remains under medical care as he continues his long process of recovery and convalescence.  He is home now surrounded by his family, who are asking for privacy.”</p>
<p class="css-at9mc1 evys1bk0">A 42-year-old man, David DePape, has been charged by federal prosecutors with attempting to kidnap Ms. Pelosi and assaulting a relative of a federal agent after he broke into the couple&#8217;s San Francisco home on Oct. 28.  He also pleaded not guilty to multiple state crime charges Tuesday.</p>
<p class="css-at9mc1 evys1bk0">Mr DePape, who has subscribed to far-right conspiracy theories, beat Mr Pelosi with a hammer in front of police, according to prosecutors, telling investigators he wanted to break Ms Pelosi&#8217;s kneecaps if she &#8220;lied&#8221; and saw her as a lesson for other lawmakers &#8221; rolled into Congress&#8221;.</p>
<p class="css-at9mc1 evys1bk0">His early-morning break-in into the Pelosis&#8217; home in the upscale Pacific Heights neighborhood was described in a filing filed by local prosecutors this week as they argued that Mr. DePape should be detained without bail.  On Friday, prosecutors and Mr. DePape&#8217;s defense team will appear before a San Francisco judge who will set a date for his preliminary hearing and a bail hearing.</p>
<p class="css-at9mc1 evys1bk0">Mr DePape, who brought zip ties and two hammers, smashed down a glass door at the back of the home and confronted Mr Pelosi, who had been sleeping in his bedroom, according to two filings released by state and federal prosecutors this week.  The suspect requested to see Ms. Pelosi, who was in Washington at the time, according to authorities.</p>
<p class="css-at9mc1 evys1bk0">After some discussion, Mr. DePape allowed Mr. Pelosi to use the bathroom where Mr. Pelosi called 911 and attempted to secretly signal the dispatcher that he was in trouble while Mr. DePape listened to the call, prosecutors said.  When police officers got to the house, they saw the two men who had gone downstairs fighting for control of one of the hammers.</p>
<p class="css-at9mc1 evys1bk0">Mr. DePape pulled the hammer away from Mr. Pelosi and hit him in the head with it before being attacked and restrained by officers.  &#8220;Mr. Pelosi was unresponsive for about three minutes and awoke in a pool of his own blood,&#8221; according to the local attorney general&#8217;s filing.</p>
<p class="css-at9mc1 evys1bk0">Mr. DePape later told officers he was there on a &#8220;suicide mission&#8221; looking for Ms. Pelosi, and that he had other targets as well: a local professor and several state and federal politicians and their families.</p>
<p class="css-at9mc1 evys1bk0">&#8220;I&#8217;m sick of how many lies are coming out of Washington, DC,&#8221; Mr. DePape told officials, according to authorities.</p>
<p class="css-at9mc1 evys1bk0">Mr. DePape was raised in British Columbia, Canada and moved to California approximately two decades ago.  Mr. DePape lived for years in Berkeley, California, where he was intermittently homeless before moving into a garage in nearby Richmond about two years ago.</p>
<p class="css-at9mc1 evys1bk0">Mr. DePape was easygoing, calm, and a hard worker, according to Frank Ciccarelli, a carpenter who has employed him for the past six years.  But he also began to subscribe to political conspiracy theories and believed the 2020 election was stolen, Mr Ciccarelli said.</p>
<p class="css-at9mc1 evys1bk0">A few years ago, Mr. Ciccarelli tried to help Mr. DePape by taking him off the street and into his friend&#8217;s garage.  But Mr. Ciccarelli believed this gave Mr. DePape greater access to the internet and allowed him to become more isolated and trapped in his darkest thoughts.</p>
<p class="css-at9mc1 evys1bk0">Mr. DePape appeared to have written a blog full of tirades about the 2020 election, anti-Semitic beliefs, and QAnon conspiracy theories.  &#8220;He went down the rabbit hole,&#8221; said Mr. Ciccarelli.</p>
<p class="css-at9mc1 evys1bk0">On Tuesday, Adam Lipson, Mr DePape&#8217;s public defender, signaled that his client&#8217;s &#8220;vulnerability&#8221; to political misinformation and propaganda could be a possible strategy for his legal defense.</p>
<p class="css-at9mc1 evys1bk0">&#8220;We&#8217;ll definitely look into that,&#8221; said Mr. Lipson.</p>

Die Staatsanwälte sagen, sie warten immer noch auf Bilder von DePapes Geräten.  DePape wird am 15. März vor dem Bundesgericht erwartet, wenn darüber diskutiert wird, ob ein Verhandlungstermin festgelegt werden soll oder nicht.</p>

Präsident Biden erkennt Pelosi während seiner Rede an und sagt: „… erst vor wenigen Monaten entfesselte ein Angreifer, der von der großen Lüge aus dem Gleichgewicht gebracht wurde, politische Gewalt im Haus des damaligen Sprechers dieses Repräsentantenhauses Aufständischen, die diese Hallen durchstreiften, sangen am 6. Januar. Hier in dieser Kammer ist heute Abend der Mann, der die Narben dieses brutalen Angriffs trägt, aber so hart und stark und so widerstandsfähig ist, wie es nur geht. Mein Freund, Paul Pelosi.“  Der Präsident sagte weiter: „Aber solch eine abscheuliche Tat hätte niemals passieren dürfen. Wir müssen alle unsere Stimme erheben. In Amerika ist kein Platz für politische Gewalt.“</p>

Eric Swalwell und der Rep. Ro Khanna.  Präsident Biden erkannte die Anwesenheit von Paul Pelosis in dem überfüllten Raum.</p>

<p class="Ekqk lqtk MTjh yuUa">Bei der Anklageerhebung in San Francisco bekennt sich David DePape in allen sechs gegen ihn erhobenen staatlichen Anklagepunkten nicht schuldig.  Er verzichtet auch auf sein Recht auf ein zügiges Verfahren.  Bei seiner nächsten Gerichtsverhandlung, die für den 23. Februar 2023 geplant ist, kann ein Verhandlungstermin festgelegt werden.</p>
<p class="Ekqk lqtk MTjh yuUa">DePape hat sich bereits nicht schuldig zu den Anklagen des Bundes gegen ihn bekannt.</p>

<p class="Ekqk lqtk MTjh yuUa">In einer vorläufigen Anhörung stellt ein Richter fest, dass es genügend Beweise gibt, um wegen sechs staatlicher Anklagepunkte gegen David DePape vor Gericht zu gehen.  Zu diesen Anklagen zählen versuchter Mord, Körperverletzung mit einer tödlichen Waffe, Missbrauch älterer Menschen, Wohnungseinbruch, Freiheitsberaubung und Lebensgefahr oder schwere Körperverletzung eines Amtsträgers.</p>
<p class="Ekqk lqtk MTjh yuUa">Zum ersten Mal wurde der Notruf von Pelosis sowie ein Bodycam-Video der Polizei abgespielt.  Die Staatsanwaltschaft berief zwei Zeugen: einen Leutnant der Sonderermittlungseinheit der SFPD sowie einen der Beamten, die auf den Notruf reagierten.  Dieser Beamte demonstrierte dem Gericht, wie er sah, wie DePape Pelosi mit einem Hammer schlug.  Die Staatsanwälte spielten auch einen 17-minütigen Clip von DePapes erstem Interview mit den Ermittlern sowie Überwachungsaufnahmen der US-Kapitolpolizei, die zeigten, wie DePape das Grundstück betrat.</p>

<p class="Ekqk lqtk MTjh yuUa">Nancy Pelosi erwähnt den Angriff auf ihren Ehemann Paul, als sie ankündigt, dass sie keine neue Führungsrolle unter den Demokraten im Kongress anstreben wird.  In ihrer Rede sagte Nancy Pelosi: „Für meinen lieben Ehemann Paul, der mein geliebter Partner im Leben und meine Säule der Unterstützung war, danke. Wir alle sind dankbar für all die Gebete und guten Wünsche, während er seine Genesung fortsetzt. Danke dich so sehr.&#8221;  Ihre Bemerkungen wurden von den im Plenarsaal versammelten Menschen mit Beifall aufgenommen.  Sie standen fast eine Minute lang da und klatschten.  Zoe Lofgren, Vertreterin der Bay Area, saß in der ersten Reihe und wischte sich die Augen.</p>

<p class="Ekqk lqtk MTjh yuUa">David DePape bekennt sich in den beiden gegen ihn erhobenen Anklagen des Bundes, versuchter Entführung und Körperverletzung, nicht schuldig.  Er wurde in den Bundesgerichtssaal gebracht, der von fünf US-Marschällen und zwei Sheriff-Offizieren aus San Francisco bewacht wurde.  Seine vom Bundesgericht ernannte Rechtsanwältin ist Angela Chuang.  Sein nächster Auftritt vor Gericht ist für den 30. November geplant.</p>

<p class="Ekqk lqtk MTjh yuUa">Eine bundesweite Anklage wird von einer Grand Jury des Bundes gegen David DePape erhoben.  Er wird wegen versuchter Entführung sowie Körperverletzung angeklagt.  Beide Anklagepunkte zusammen ergeben eine Höchststrafe von 50 Jahren Gefängnis.  Die Anklageschrift enthüllt, dass sich die Begegnung zwischen Pelosi, DePape und der Polizei an der Haustür des Hauses, als Pelosi mit dem Hammer geschlagen wurde, innerhalb von 15 Sekunden abspielte.  Die Anklage besagt, dass DePape plante, Sprecherin Pelosi zu benutzen, um eine andere Person zu ködern, die er ins Visier genommen hatte.  Elektronische Beweise, die in DePapes Haus in Richmond beschlagnahmt wurden, zeigen, dass er eine Adresse für dieses Ziel recherchiert hatte, aber die Anklageschrift das Ziel nicht namentlich identifizierte.  Ein weiteres Ziel wird ebenfalls erwähnt, aber nicht genannt.</p>

<p class="Ekqk lqtk MTjh yuUa">Zum ersten Mal spricht Nancy Pelosi in einem Video-Update, das auf ihrer YouTube-Seite Team Pelosi gepostet wurde, über den Angriff auf ihren Ehemann.  „Danke, danke, danke für Ihre freundlichen Worte, Ihre Gebete und Ihre guten Wünsche für Paul“, sagt der Sprecher.  „Es wird ein langer Weg, aber es wird ihm gut gehen. Und es ist so tragisch, wie es passiert ist. Aber wir müssen trotzdem optimistisch sein. Er ist von seiner Familie umgeben, das ist also eine wunderbare Sache.“</p>
<h2 class="RxNC PvZ nIjP PMXY LmsH SfAH mNgy NMbp LBPR">3. November 2022</h2>
<p class="Ekqk lqtk MTjh yuUa">Sechs Tage nach dem Angriff wird Paul Pelosi aus dem Zuckerberg San Francisco General Hospital entlassen.  Er wurde wegen eines Schädelbruchs operiert, erhielt eine Behandlung für Verletzungen an seinem rechten Arm sowie an beiden Händen und wird sich voraussichtlich erholen.  In einer Erklärung von Nancy Pelosi heißt es: „Paul bleibt in ärztlicher Obhut, während er seinen langen Genesungsprozess und seine Genesung fortsetzt. Er ist jetzt zu Hause, umgeben von seiner Familie, die um Privatsphäre bittet.“</p>
<p class="Ekqk lqtk MTjh yuUa">Einwanderungsbeamte sagen, der Verdächtige David DePape sei illegal in den USA und habe ein Visum für Kanada überschritten.  ICE hat gegen DePape einen Immigrationshaftbefehl erhoben.  Es ist unwahrscheinlich, dass der Inhaftierte unmittelbare Auswirkungen hat, da Abschiebungen häufig nach der Klärung von Strafsachen erfolgen.</p>

<p class="Ekqk lqtk MTjh yuUa">Die US-Kapitolpolizei hatte Kameras vor dem Haus der Sprecherin des Repräsentantenhauses, Nancy Pelosi, aufgestellt, die jedoch laut mehreren mit der Angelegenheit vertrauten Quellen nicht überwacht wurden.  Laut den Quellen sah die Capitol Police das Aufblitzen der Polizeilichter auf der Kamera, spulte das Video zurück und sah den Einbruch.</p>
<p class="Ekqk lqtk MTjh yuUa">Ehemalige Nachbarn von David DePape in der Stadt Richmond sprechen über den Mann, den sie kannten.  Sie sagen, er habe oft als Handwerker gearbeitet und beschreiben ihn als ruhig.</p>
<h2 class="RxNC PvZ nIjP PMXY LmsH SfAH mNgy NMbp LBPR">1. November 2022</h2>
<p class="Ekqk lqtk MTjh yuUa">David DePape tritt in diesem Fall zum ersten Mal vor Gericht auf, um in sechs Anklagen gegen ihn auf nicht schuldig zu plädieren.  Dieser Fall wird in einem Gerichtssaal in San Francisco verhandelt und betrifft Anklagepunkte auf Landesebene, nicht auf Bundesebene.  DePape wird ohne Kaution festgehalten.  Er wird von Pflichtverteidiger Adam Lipson vertreten.</p>
<p class="Ekqk lqtk MTjh yuUa">Eine eidesstattliche Erklärung des Bundes enthüllt anschauliche Details darüber, was sich in den frühen Morgenstunden des 28. Oktober 2022 im Pelosi-Haus abspielte. Es heißt, Pelosi habe um 2:23 Uhr den Notruf 911 angerufen, um einen Fremden in seinem Haus zu melden.  SFPD-Beamte trafen um 2:31 Uhr ein und begegneten Pelosi und DePape im Haus, jeder mit einer Hand an einem Hammer.  „DEPAPE zog Pelosi den Hammer aus der Hand und schwang den Hammer, wobei er Pelosi in den Kopf schlug. Die Beamten gingen sofort hinein und konnten DEPAPE festhalten. Während die Beamten DEPAPE festhielten, schien Pelosi bewusstlos am Boden zu liegen.“</p>

<p class="Ekqk lqtk MTjh yuUa">Pelosi sprach im Krankenwagen auf dem Weg ins Krankenhaus mit SFPD-Beamten.  Er sagte den Beamten, er habe DePape noch nie gesehen, bevor er ihn aufweckte und „erklärte, er wolle mit ‚Nancy‘ sprechen“.</p>
<p class="Ekqk lqtk MTjh yuUa">Die eidesstattliche Erklärung beschreibt ein Interview, das DePape SFPD gab: „DEPAPE erklärte, dass er Nancy als Geisel nehmen und mit ihr sprechen würde. Wenn Nancy DEPAPE die ‚Wahrheit‘ sagen würde, würde er sie gehen lassen, und wenn sie ‚lügen‘, er würde &#8216;ihre Kniescheiben&#8217; brechen &#8230; DEPAPE erklärte später auch, dass sie durch das Brechen von Nancys Kniescheiben in den Kongress gefahren werden müsste, was anderen Kongressabgeordneten zeigen würde, dass ihre Handlungen Konsequenzen haben würden.  DePape sagt, er sei mit einem Hammer durch eine Glastür in das Haus eingebrochen.  „DEPAPE hatte an diesem Morgen Kabelbinder, Klebeband, Seile und mindestens einen Hammer dabei. Die Beweise zeigen weiter, dass DEPAPE Herrn Pelosi mit DEPAPEs eigenem Hammer angegriffen hat.“</p>
<p class="Ekqk lqtk MTjh yuUa">Die eidesstattliche Erklärung erwähnt auch einen Zeugen, der als privater Wachmann in einem nahe gelegenen Haus arbeitete.  Der Zeuge „sah eine Person ganz in Schwarz, die eine große schwarze Tasche auf dem Rücken trug und in der Nähe der Pelosi-Residenz ging“, und kurz darauf „hörte der Zeuge etwas, das sich anhörte, als würde er entweder gegen eine Tür oder ein Auto klopfen, und hörte dann innerhalb einer Minute die Sirenen oder zwei.&#8221;</p>

<p class="Ekqk lqtk MTjh yuUa">David DePape, der verdächtigt wird, Paul Pelosi angegriffen zu haben, wird aus dem Krankenhaus entlassen und ins Gefängnis von San Francisco eingewiesen.  Bei seiner Festnahme erlitt er eine ausgerenkte Schulter.  Er muss am 1. November zum ersten Mal vor Gericht erscheinen.</p>

<p class="Ekqk lqtk MTjh yuUa">Die Staatsanwaltschaft von San Francisco kündigt ein halbes Dutzend Anklagen wegen Straftaten gegen DePape an, darunter versuchter Mord, Körperverletzung mit einer tödlichen Waffe, Misshandlung älterer Menschen, Wohnungseinbruch, falsche Inhaftierung und Drohung mit dem Leben oder schwerer Körperverletzung eines Beamten.  Bezirksstaatsanwältin Brooke Jenkins sagt, dass die sechs Anklagen wegen Verbrechen zu Haftstrafen von 13 Jahren bis hin zu lebenslanger Haft führen.  DePape sieht sich auch Bundesanklagen ausgesetzt, darunter Angriff auf das unmittelbare Familienmitglied eines Bundesbeamten, der mit einer Höchststrafe von 30 Jahren Gefängnis bestraft wird.  Er wurde auch wegen versuchter Entführung eines Bundesbeamten angeklagt, der mit einer Höchststrafe von 20 Jahren Gefängnis bestraft wird.</p>

<p class="mol-para-with-font">That&#8217;s what accused killer Stuart Paul Anderson told a reporter about the woman he&#8217;s accused of brutally beating to death.</p>
<p class="mol-para-with-font">There was a widespread appeal for information in the days and weeks after the body of his 77-year-old neighbor Vicki Ramadan was found in her Sydenham home in Melbourne&#8217;s northwest on April 6, 2019.</p>
<p class="mol-para-with-font">&#8216;I really hope the cops catch the son of a bitch,&#8217; Anderson said in the interview with A Current Affair.</p>
<p class="mol-para-with-font">The unedited footage of that interview was played to jurors in Anderson&#8217;s Victorian Supreme Court murder trial on Tuesday.</p>
<p class="mol-para-with-font">He has pleaded not guilty to killing Mrs Ramadan sometime between March 23 and 25, 2019.</p>
<p class="mol-para-with-font">Witnesses told the jury they heard multiple arguments between them in the days before she was killed.</p>
<p class="mol-para-with-font">It was Anderson who called the police after finding her body.</p>

<p class="mol-para-with-font">He said he first met Mrs Ramadan when she knocked on his door and asked him to help her with some odd jobs.</p>
<p class="mol-para-with-font">A taxi drier saw the pair arguing about Anderson arriving late to help her with jobs on the morning of March 23, 2019.</p>
<p class="mol-para-with-font">Later another witness heard Anderson aggressively yelling at Mrs Ramadan, saying &#8216;f*** you, fix it yourself&#8217; while assembling a flat pack before heading home.  He later returned to her house.</p>
<p class="mol-para-with-font">Prosecutor Neill Hutton said there were signs of life on March 25 &#8211; a call from one of her phones to another at 9.30am and an electricity spike consistent with a hotplate at lunchtime.</p>
<p class="mol-para-with-font">Anderson told his partner he was going to check on Mrs Ramadan and pick up tools he left at her house about 9am on April 6. </p>

<p class="mol-para-with-font">He said he found her body after going through the back door, which had been kicked open.</p>
<p class="mol-para-with-font">Anderson stuck with that story during his first two police interviews but after officers became suspicious about his story he told them in August 2019 that he had lied because he actually found her body between 1.30am and 2am on April 6 after he himself knocked in her back door.</p>
<p class="mol-para-with-font">But the trouble with what Anderson told the reporter, his partner and police is that it&#8217;s false, prosecutor Neill Hutton said.</p>
<p class="mol-para-with-font">&#8216;It&#8217;s essentially a sham, a charade.  It&#8217;s false,&#8217; he said.</p>
<p class="mol-para-with-font">Mrs Ramadan was known for wearing lots of jewellery, but that and cash was still inside her home, jurors heard.</p>
<p class="mol-para-with-font">Anderson&#8217;s barrister Glenn Casement said identity was an issue in the trial.</p>
<p class="mol-para-with-font">&#8216;My client didn&#8217;t kill the deceased,&#8217; he said.</p>
<p class="mol-para-with-font">The trial before Justice Amanda Fox is continuing.</p>

<p>House Speaker Nancy Pelosi said her husband, Paul Pelosi, was released from the hospital Thursday after his treatment for injuries from a violent assault last week in which he was attacked with a hammer.</p>
<p>Pelosi said, “Paul remains under doctors&#8217; care as he continues to progress on a long recovery process and convalescence.  He&#8217;s home now.&#8221;</p>
<p>Law enforcement officers who responded to the break-in early last Friday witnessed Paul Pelosi being struck in the head with the hammer at least once, according to court documents.  Officials said the assault was captured on the officers&#8217; body cameras.</p>
<p>Pelosi was taken to Zuckerberg San Francisco General Hospital.  Speaker Pelosi said her husband was grateful to the 911 operator who directed police to the family residence, emergency responders and the entire hospital staff for &#8220;their excellent and compassionate life-saving treatment.&#8221;</p>
<p>&#8220;The Pelosi family is thankful for the beautiful outpouring of love, support and prayers from around the world,&#8221; she said.</p>
<p>Paul Pelosi&#8217;s release from the hospital comes as a federal official says the Canadian man accused of breaking into their home and attacking him should have been flagged by immigration officials and blocked from getting back into the US after overstaying his authorized entry more than two decades ago.</p>
<p>David DePape, 42, legally entered the United States in 2000 and later left the country and returned a few times, including entering in March 2008 at San Diego&#8217;s San Ysidro border crossing, said a US official who spoke on the condition of anonymity because they were not authorized to discuss the matter.</p>
<p>Most Canadians are not required to obtain a visa to enter the US as tourists and can stay for up to six months.  The official said it was unclear why US authorities admitted DePape after he overstayed his entry in 2000.</p>
<p>The Department of Homeland Security did not immediately respond to questions about DePape&#8217;s entry to the United States after he violated immigration law.  It acknowledged in a statement that DePape was allowed into San Diego from Tijuana on March 8, 2008, but didn&#8217;t address any other entries.</p>
<p>San Francisco police said DePape confronted Paul Pelosi in the family&#8217;s Pacific Heights home Oct.  28 and demanded to know where the House Speaker was.  DePape pleaded not guilty to state charges on Tuesday and was ordered held without bail.  His public defender, Adam Lipson, said he looks forward to providing him with a &#8220;vigorous legal defense.&#8221;</p>
<p>DePape faces state charges of attempted murder, burglary and elder abuse.  He also faces federal charges including attempted kidnapping of a US official.  His state case will continue Friday, though the defendant will not appear in the courtroom.  An arrangement on federal charges has not been scheduled.</p>
<p>In the state court filing, prosecutors detailed the attack in stark terms, saying Paul Pelosi, 82, was knocked unconscious by the hammer attack and woke up in a pool of his own blood.</p>
<p>DePape grew up in Powell River, British Columbia, but relocated to California to be with a girlfriend, stepfather Gene DePape told The Associated Press last week.  He has three children with two women, he said.  Gene DePape said the suspect had lived with him in Canada until he was 14 and had been a quiet boy.</p>
<p>DePape&#8217;s ex-girlfriend, Bay Area nudist activist Oxane &#8220;Gypsy&#8221; Taub, told the San Francisco Chronicle she met DePape in Hawaii in 2000. The pair lived in Berkeley and had two children during their 15-year relationship.</p>
<p>US officials have long struggled to quantify — let alone track down — people who enter the country legally and overstay visas, believed to be about 40% of the population who are in the country illegally.</p>
<p>There were 684,499 visa overstays from October 2019 through September 2020 among visitors who arrived by plane or ship — more than the population of Vermont or Wyoming – according to the Department of Homeland Security&#8217;s latest annual report.  The total number of overstays is much larger but has not been quantified because it doesn&#8217;t include how many people arrive by land, the primary way for Canadians and Mexicans to enter the United States.</p>
<p>The cost and technological hurdles to develop a checkout system at congested land crossings with Canada and Mexico are enormous.  In the 12-month period through September 2020, more than 52,000 Canadians who came to the US by air or sea had overstayed their legally authorized entry.</p>
<p>Despite the challenges, the US official said DePape&#8217;s overstay should have been noted in immigration records, which, in theory, should have prevented authorities from admitting him.</p>

<p>The San Francisco district attorney on Monday announced an attempted murder charge for the man accused of violently attacking Paul Pelosi, the husband of Speaker Nancy Pelosi (D-Calif.), in the couple&#8217;s California home last week.</p>
<p>District Attorney Brooke Jenkins announced that David Wayne DePape, 42, will be charged with residential burglary, assault with a deadly weapon, elder abuse, false imprisonment of an elder and threats to a public official and their family, in addition to attempted murder.</p>
<p>He is scheduled to be arranged on Tuesday and is facing between 13 years and life in prison, according to Jenkins.  She also said a motion to detain will be filed for DePape on Tuesday, citing the “obvious and severe public safety risk” he poses to San Francisco and the outer community.</p>
<p>The state charges were announced shortly after the Department of Justice charged DePape with federal assault and attempted kidnapping.</p>
<p>DePape is accused of breaking into the Pelosi&#8217; San Francisco home in the middle of the night on Friday and striking Paul Pelosi with a hammer, causing serious injuries, authorities said.</p>
<p>Paul Pelosi was transported to a hospital, where he underwent surgery to treat a skull fracture and serious injuries to his right arm and hands.</p>
<p>In a statement Monday evening, Pelosi, who said her family had been &#8220;deluged&#8221; with messages of concern, prayers and well-wishes, indicated that her husband &#8220;is making steady progress on what will be a long recovery process.&#8221; </p>
<p>During the news conference announcing the state charges, Jenkins disclosed new details that shed more light on the early-morning attack, and reiterated information that federal prosecutors included in their affidavit.</p>
<p>In line with previous information, Jenkins told reporters on Monday that DePape “specifically targeted the Pelosi home to confront Speaker Pelosi.”  Last week, a source familiar with the investigation told The Hill that before the attack, DePape approached Paul Pelosi and shouted “where is Nancy?  Where is Nancy?&#8221;</p>
<p>Pelosi was in Washington, DC at the time of the incident.</p>
<p>The district attorney said DePape &#8220;forced his way into the home through a rear glass door by breaking the glass,&#8221; then traveled up the stairs in the house to the second floor, where he found Paul Pelosi &#8220;sleeping in his bed&#8221; in a loose -fitting pajama shirt and boxer shorts.</p>
<p>&#8220;He woke him up confronting him about the whereabouts of Speaker Pelosi,&#8221; Jenkins said, adding that there was no security present at the time at the home.</p>
<p>She said the attack appears to be politically motivated, based on statements and comments DePape made in the house during his encounter with Paul Pelosi.</p>
<p>At some point during the encounter between the two men, Jenkins said Paul Pelosi “attempted to access the elevator in the home, which has a phone” — a detail that was not disclosed in the Justice Department&#8217;s charging document.</p>
<p>&#8220;The defendant then blocked Mr. Pelosi&#8217;s access to that elevator,&#8221; Jenkins said.</p>
<p>Federal prosecutors revealed earlier on Monday that the two men were downstairs when officers arrived on the scene, but Jenkins&#8217; account described how they made it from the second floor to the first floor.</p>
<p>“It was at some point after that Mr. Pelosi asked to go to the bathroom, which is where he was able to call 911 from his cellphone.  The defendant, realizing that Mr. Pelosi had called 911, took Mr. Pelosi downstairs near the front door of the residence,” Jenkins said.</p>
<p>She then walked through the moment DePape struck Paul Pelosi with a hammer.</p>
<p>“Two police officers arrived at the front door two minutes after that 911 call.  When that door was opened, the defendant was holding his hammer, which Mr. Pelosi appeared to be attempting to control by holding a portion of that hammer.  The defendant then pulled the hammer away from Mr. Pelosi and violently struck him in the top of his head.  The police then immediately approved the defendant,” Jenkins said.</p>
<p>She noted that DePape brought a second hammer, zip ties, rope and a roll of tape to Pelosi&#8217;s home, which the DOJ had previously disclosed.</p>
<p>Jenkins on Monday said it was “very sad to see that we are once again at a point in history where people believe that it&#8217;s okay to express their political sentiments through violence.”</p>

<p>“And so I think it really demonstrates that we have to calm things down, we have to decide that we are going to be more respectful as an American society, that it&#8217;s okay to disagree.  But it certainly is something that has unnerved us all,” she added.</p>
