<p>SAN FRANCISCO (AP) — A federal judge on Wednesday denied a motion to move the trial of a man charged in <span class="LinkEnhancement">last year’s attack</span> against former U.S. House Speaker Nancy Pelosi’s husband out of San Francisco, saying she wasn’t convinced the court wouldn’t be able to find impartial and fair jurors in the San Francisco Bay Area. </p>
<p>David DePape’s defense attorneys argued that the intense publicity the case has received means he won’t get a fair trial in the city. They had asked Judge Jacqueline Scott Corley to move the trial to Eureka, a city near the border with Oregon. The federal trial is set to start Nov. 13.</p>
<p>Federal public defender Angela Chuang said local media attention has tainted the pool of jurors. In its motion asking for the change of venue, the defense said a survey it commissioned shows many potential jurors already believe DePape is guilty of the crimes and would be unable to change their minds.</p>
<p>Judge Jacqueline Scott Corley pointed out that the case received national attention and that the defense survey also showed many people in Eureka are also familiar with the details of the case. </p>
<p>She also said it could be hard to find such a jury in Eureka because the population the court could pull from is 326,000, compared to 5.5 million in the Bay Area. </p>
<p>“I agree with you that to ensure Mr. DePape has an impartial jury, we are going to have to pull a lot of jurors and make sure we question them,” Scott Corley said. </p>
<p>“I actually think we will have a way harder time if this case is transferred &#8230; because the number of people we’re pulling from is a magnitude smaller,” she added. </p>
<p><span class="LinkEnhancement">Prosecutors say</span> DePape broke into the Pelosis’ San Francisco home on Oct. 28 seeking to kidnap the former speaker — who was out of town — and instead beat her 83-year-old husband, Paul, with a hammer. The violence <span class="LinkEnhancement">sent shockwaves through the political world</span>.</p>
<p>DePape, 43, pleaded not guilty to federal charges of attempting to kidnap a federal official and assaulting a federal official’s family member. He also pleaded not guilty to state charges, including attempted murder, burglary and elder abuse. He remains jailed without bail. The state trial hasn’t been scheduled.</p>
<p>Chuang and federal public defender Jodi Linker also said in their motion they fear potential jurors in San Francisco could be biased against DePape because Nancy Pelosi, who has represented the city in Congress since 1987, remains a popular figure in the Bay Area.</p>
<p>Eureka is in rural Humboldt County and is politically more conservative. </p>
<p>They said Bay Area media outlets have extensively covered the case and played video footage of the assault on Paul Pelosi, the 911 call, and a police interview of DePape shortly after his arrest.</p>
<p><span class="LinkEnhancement">Footage of the attack was released to the public</span> in January after a California judge denied prosecutors’ request to keep it secret.</p>

<p>SAN FRANCISCO (AP) — Prosecutors brought forward a string of law enforcement officials Monday to provide context around video that’s at the crux of their case against David DePape, the man accused of attacking former House Speaker Nancy Pelosi’s husband at the couple’s San Francisco home last year.</p>
<p>DePape has pleaded not guilty to attempted kidnapping of a federal official and assault on the immediate family member of a federal official with intent to retaliate against the official for performance of their duties. Prosecutors say DePape bludgeoned Paul Pelosi with a hammer in the early hours of Oct. 28, 2022, just days before that year’s midterm elections.</p>
<p>Federal prosecutors quickly moved through their witness list on the trial’s second day, bringing forward an FBI agent who collected the electronics DePape was carrying, a U.S. Capitol police officer who watches the surveillance cameras at the Pelosis’ home and another who has protected Nancy Pelosi since 2006, and a Bay Area Rapid Transit police sergeant. </p>
<p>Paul Pelosi was also expected to testify.</p>
<p>Some of the witnesses helped verify time stamps on footage from surveillance cameras at the Pelosis’ home, which are set to Eastern Time, and on BART trains, which were an hour behind Pacific Time.</p>
<p>Defense attorney Jodi Linker told jurors last week that she won’t dispute that DePape attacked Paul Pelosi in an encounter caught on police body camera video. Instead, she will argue that he believed “with every ounce of his being″ that he was taking action to stop government corruption and the abuse of children by politicians and actors. She said that means the government’s charges that DePape was trying to retaliate or interfere with Nancy Pelosi’s official duties don’t fit. </p>
<p>Federal prosecutor Laura Vartain Horn told jurors during opening statements Thursday that DePape started planning the attack in August and that the evidence and FBI testimony will show he researched his targets online, collecting phone numbers and addresses, even paying for a public records service to find information about Nancy Pelosi and others.</p>
<p>If convicted, DePape faces life in prison. He also has pleaded not guilty to charges in state court of attempted murder, assault with a deadly weapon, elder abuse, residential burglary and other felonies. A state trial has not been scheduled. </p>
<p>Federal prosecutors say DePape smashed his shoulder through a glass panel on a door in the back of the Pelosis’ Pacific Heights mansion and confronted a sleeping Paul Pelosi, who was wearing boxer shorts and a pajama top.</p>
<p>“Where’s Nancy? Where’s Nancy?” DePape asked, standing over Paul Pelosi around 2 a.m. holding a hammer and zip ties, according to court records. Nancy Pelosi was in Washington and under the protection of her security detail, which does not extend to family members.</p>
<p>Paul Pelosi called 911 and two police officers showed up and witnessed DePape strike him in the head with a hammer, knocking him unconscious, court records showed.</p>
<p>Nancy Pelosi’s husband of 60 years later underwent surgery to repair a skull fracture and injuries to his right arm and hands.</p>
<p>After his arrest, DePape, 43, allegedly told a San Francisco detective that he wanted to hold Nancy Pelosi hostage. He said if she told him the truth, he would let her go and if she lied, he was going to “break her kneecaps” to show other members of Congress there were “consequences to actions,” according to prosecutors.</p>
<p>DePape, who lived in a garage in the Bay Area city of Richmond and had been doing odd carpentry jobs to support himself, allegedly told authorities he had other targets, including a women’s and queer studies professor, California Gov. Gavin Newsom, actor Tom Hanks and President Joe Biden’s son Hunter.</p>

<p>The man accused of breaking into former House Speaker Nancy Pelosi’s San Francisco home, bludgeoning her husband with a hammer and seeking to kidnap her goes on trial Thursday. </p>
<p>Opening statements are scheduled in the federal trial of David DePape who prosecutors say assaulted then-82-year-old Paul Pelosi, sending shockwaves through the political world just days before last year’s midterm elections. The attack in the early hours of Oct. 28, 2022, also highlighted how conspiracy theories and misinformation that spread online can fuel political violence.</p>
<p>DePape pleaded not guilty to attempted kidnapping of a federal official and assault on the immediate family member of a federal official. Paul Pelosi is expected to testify next week.</p>
<p>DePape posted rants on a blog and an online forum about aliens, communists, religious minorities, and global elites. He questioned the results of the 2020 election and echoed the baseless, right-wing QAnon conspiracy theory that claims the U.S. government is run by a cabal of devil-worshipping pedophiles. The websites were taken down shortly after his arrest.</p>
<p>A Canadian citizen, DePape moved to the United States more than 20 years ago after falling in love with Gypsy Taub, a Berkeley pro-nudity activist well-known in the Bay Area, his stepfather, Gene DePape said. In recent years, David DePape had been homeless and struggling with drug abuse and mental illness, Taub told local media.</p>

<p>A backpack DePape was carrying had tape and a rope, in addition to zip ties, according to police.</p>
<p>The assault was captured on the officers’ body cameras. U.S. District Judge Jacqueline Scott Corley ruled last month that the jury will be allowed to see footage that shows Paul Pelosi in a pool of his own blood struggling to breathe and the police officers trying to stop the bleeding. Angela Chuang, one of DePape’s federal public defenders, had argued that the shocking footage would be prejudicial to her client. </p>
<p>Corley also ruled jurors can listen to portions of a 5-minute call DePape made in January to a television reporter in which he repeated conspiracy theories. </p>
<p>“Freedom and liberty isn’t dying, it’s being killed systematically and deliberately,” he said.</p>
<p>“The tree of liberty needs watering. He needs men of valor, patriots willing to put their own lives on the line to stand in opposition to tyranny,” he added.</p>
<p>Katherine Keneally, a senior researcher at the nonprofit Institute for Strategic Dialogue, said the attack is an example of increasing online hate, conspiracies and false narratives influencing political violence. </p>
<p>“This didn’t occur in a vacuum,” Keneally said. </p>
<p>Keneally said people who commit such conspiracy-fueled acts of violence often are struggling with mental health or other life crises, such as the death of a family member or a divorce.</p>
<p>“I can’t think of a single case where someone engaged in violent behavior where they were solely influenced by the conspiracy theory,” she said. </p>
<p>DePape, who lived in a garage in the Bay Area city of Richmond and had been doing odd carpentry jobs to support himself, allegedly told authorities he had other targets, including a women’s and queer studies professor, California Gov. Gavin Newsom, actor Tom Hanks and President Joe Biden’s son Hunter.</p>
<p>One of those targets is included in the defense’s short witness list, though their name has been redacted. The other possible witnesses are DePape, Nancy Pelosi’s chief of staff, Daniel Bernal, extremism and antisemitism researcher Elizabeth Yates, and federal public defender Catherine Goulet.</p>
<p>The prosecution’s list of potential witnesses contains 15 names, including the surgeon who operated on Paul Pelosi, federal agents, San Francisco police officers and several first responders.</p>
<p>If convicted, DePape faces life in prison. He was also charged in state court with attempted murder, assault with a deadly weapon, elder abuse, residential burglary and other felonies. He pleaded not guilty to those charges. A state trial has not been scheduled. </p>

<p>A federal judge on Wednesday denied a motion to move the trial of a man charged in last year’s attack against former U.S. House Speaker Nancy Pelosi’s husband out of San Francisco, saying she wasn’t convinced the court wouldn’t be able to find impartial and fair jurors in the San Francisco Bay Area. </p>
<p>David DePape’s defense attorneys argued that the intense publicity the case has received means he won’t get a fair trial in the city. They had asked Judge Jacqueline Scott Corley to move the trial to Eureka, a city near the border with Oregon. The federal trial is set to start Nov. 13.</p>
<p>Federal public defender Angela Chuang said local media attention has tainted the pool of jurors. In its motion asking for the change of venue, the defense said a survey it commissioned shows many potential jurors already believe DePape is guilty of the crimes and would be unable to change their minds.</p>
<p>Judge Jacqueline Scott Corley pointed out that the case received national attention and that the defense survey also showed many people in Eureka are also familiar with the details of the case. </p>
<p>She also said it could be hard to find such a jury in Eureka because the population the court could pull from is 326,000, compared to 5.5 million in the Bay Area. </p>
<p>“I agree with you that to ensure Mr. DePape has an impartial jury, we are going to have to pull a lot of jurors and make sure we question them,” Scott Corley said. </p>
<p>“I actually think we will have a way harder time if this case is transferred &#8230; because the number of people we’re pulling from is a magnitude smaller,” she added. </p>
<p>Prosecutors say DePape broke into the Pelosis’ San Francisco home on Oct. 28 seeking to kidnap the former speaker — who was out of town — and instead beat her 83-year-old husband, Paul, with a hammer. The violence sent shockwaves through the political world.</p>
<p>DePape, 43, pleaded not guilty to federal charges of attempting to kidnap a federal official and assaulting a federal official’s family member. He also pleaded not guilty to state charges, including attempted murder, burglary and elder abuse. He remains jailed without bail. The state trial hasn’t been scheduled.</p>
<p>Chuang and federal public defender Jodi Linker also said in their motion they fear potential jurors in San Francisco could be biased against DePape because Nancy Pelosi, who has represented the city in Congress since 1987, remains a popular figure in the Bay Area.</p>
<p>Eureka is in rural Humboldt County and is politically more conservative. </p>
<p>They said Bay Area media outlets have extensively covered the case and played video footage of the assault on Paul Pelosi, the 911 call, and a police interview of DePape shortly after his arrest.</p>
<p>Footage of the attack was released to the public in January after a California judge denied prosecutors’ request to keep it secret.</p>

<p>SAN FRANCISCO &#8212; A federal judge on Wednesday denied a request to move the trial of a man accused last year of assaulting the husband of former House Speaker Nancy Pelosi out of San Francisco, saying she was not satisfied the San Francisco Bay Area court could not find an impartial and fair jury.</p>
<p>Defense attorneys for David DePape argued that the intense publicity the case received meant it would not receive a fair trial in the city.  They had asked Judge Jacqueline Scott Corley to move the trial to Eureka, a town near the Oregon border.  The federal trial is scheduled to begin on November 13.</p>
<p>Federal Defense Attorney Angela Chuang said the attention of the local media affected the jury circuit.  In its motion to change jurisdiction, the defense said a poll it commissioned shows that many potential jurors are already convinced that DePape is guilty of the crimes and are unable to change their minds.</p>
<p>Judge Jacqueline Scott Corley noted that the case had drawn national attention and that the defense survey also showed that many people in Eureka were familiar with the details of the case.</p>
<p>She also said finding such a jury in Eureka might be difficult because the population the court could recruit from is 326,000, compared to the Bay Area&#8217;s 5.5 million.</p>
<p>&#8220;I agree that in order to ensure Mr. DePape has an impartial jury, we need to gather a lot of jurors and make sure we question them,&#8221; Scott Corley said.</p>
<p>&#8220;I actually think that if this case transfers, we&#8217;re going to have a much harder time&#8230;because the number of people we pull off is a lot smaller,&#8221; she added.</p>

<p class="Ekqk lqtk MTjh yuUa">In einer vorläufigen Anhörung stellt ein Richter fest, dass es genügend Beweise gibt, um wegen sechs staatlicher Anklagepunkte gegen David DePape vor Gericht zu gehen.  Zu diesen Anklagen zählen versuchter Mord, Körperverletzung mit einer tödlichen Waffe, Missbrauch älterer Menschen, Wohnungseinbruch, Freiheitsberaubung und Lebensgefahr oder schwere Körperverletzung eines Amtsträgers.</p>
<p class="Ekqk lqtk MTjh yuUa">Zum ersten Mal wurde der Notruf von Pelosis sowie ein Bodycam-Video der Polizei abgespielt.  Die Staatsanwaltschaft berief zwei Zeugen: einen Leutnant der Sonderermittlungseinheit der SFPD sowie einen der Beamten, die auf den Notruf reagierten.  Dieser Beamte demonstrierte dem Gericht, wie er sah, wie DePape Pelosi mit einem Hammer schlug.  Die Staatsanwälte spielten auch einen 17-minütigen Clip von DePapes erstem Interview mit den Ermittlern sowie Überwachungsaufnahmen der US-Kapitolpolizei, die zeigten, wie DePape das Grundstück betrat.</p>

<p class="Ekqk lqtk MTjh yuUa">Eine bundesweite Anklage wird von einer Grand Jury des Bundes gegen David DePape erhoben.  Er wird wegen versuchter Entführung sowie Körperverletzung angeklagt.  Beide Anklagepunkte zusammen ergeben eine Höchststrafe von 50 Jahren Gefängnis.  Die Anklageschrift enthüllt, dass sich die Begegnung zwischen Pelosi, DePape und der Polizei an der Haustür des Hauses, als Pelosi mit dem Hammer geschlagen wurde, innerhalb von 15 Sekunden abspielte.  Die Anklage besagt, dass DePape plante, Sprecherin Pelosi zu benutzen, um eine andere Person zu ködern, die er ins Visier genommen hatte.  Elektronische Beweise, die in DePapes Haus in Richmond beschlagnahmt wurden, zeigen, dass er eine Adresse für dieses Ziel recherchiert hatte, aber die Anklageschrift das Ziel nicht namentlich identifizierte. Und es ist so tragisch, wie es passiert ist. Aber wir müssen trotzdem optimistisch sein. Er ist von seiner Familie umgeben, das ist also eine wunderbare Sache.“</p>

<p class="Ekqk lqtk MTjh yuUa">Sechs Tage nach dem Angriff wird Paul Pelosi aus dem Zuckerberg San Francisco General Hospital entlassen.  Er wurde wegen eines Schädelbruchs operiert, erhielt eine Behandlung für Verletzungen an seinem rechten Arm sowie an beiden Händen und wird sich voraussichtlich erholen.  In einer Erklärung von Nancy Pelosi heißt es: „Paul bleibt in ärztlicher Obhut, während er seinen langen Genesungsprozess und seine Genesung fortsetzt. Er ist jetzt zu Hause, umgeben von seiner Familie, die um Privatsphäre bittet.“</p>

ICE hat gegen DePape einen Immigrationshaftbefehl erhoben. Laut den Quellen sah die Capitol Police das Aufblitzen der Polizeilichter auf der Kamera, spulte das Video zurück und sah den Einbruch.</p>

<p class="Ekqk lqtk MTjh yuUa">Pelosi sprach im Krankenwagen auf dem Weg ins Krankenhaus mit SFPD-Beamten.  Er sagte den Beamten, er habe DePape noch nie gesehen, bevor er ihn aufweckte und „erklärte, er wolle mit ‚Nancy‘ sprechen“.</p>
<p class="Ekqk lqtk MTjh yuUa">Die eidesstattliche Erklärung beschreibt ein Interview, das DePape SFPD gab: „DEPAPE erklärte, dass er Nancy als Geisel nehmen und mit ihr sprechen würde. Wenn Nancy DEPAPE die ‚Wahrheit‘ sagen würde, würde er sie gehen lassen, und wenn sie ‚lügen‘, er würde &#8216;ihre Kniescheiben&#8217; brechen &#8230; DEPAPE erklärte später auch, dass sie durch das Brechen von Nancys Kniescheiben in den Kongress gefahren werden müsste, was anderen Kongressabgeordneten zeigen würde, dass ihre Handlungen Konsequenzen haben würden.  DePape sagt, er sei mit einem Hammer durch eine Glastür in das Haus eingebrochen.  „DEPAPE hatte an diesem Morgen Kabelbinder, Klebeband, Seile und mindestens einen Hammer dabei. Die Beweise zeigen weiter, dass DEPAPE Herrn Pelosi mit DEPAPEs eigenem Hammer angegriffen hat.“</p>

Der Zeuge „sah eine Person ganz in Schwarz, die eine große schwarze Tasche auf dem Rücken trug und in der Nähe der Pelosi-Residenz ging“, und kurz darauf „hörte der Zeuge etwas, das sich anhörte, als würde er entweder gegen eine Tür oder ein Auto klopfen, und hörte dann innerhalb einer Minute die Sirenen oder zwei.&#8221;</p>

<p class="Ekqk lqtk MTjh yuUa">David DePape, der verdächtigt wird, Paul Pelosi angegriffen zu haben, wird aus dem Krankenhaus entlassen und ins Gefängnis von San Francisco eingewiesen. <p>Paul Pelosi, the husband of US House of Representatives Speaker Nancy Pelosi, is recovering from surgery after he was attacked by a hammer-wielding intruder at the couple&#8217;s home in San Francisco.</p>
<p>Mr Pelosi, 82, suffered a fractured skull and injuries to his right arm and hands.  He is &#8220;receiving excellent medical care and is expected to make a full recovery,&#8221; spokesman Drew Hammill said.</p>
<p>The attack on the spouse of the third-most senior politician in the United States has sparked concerns about political violence ahead of the midterm elections on 8 November.</p>
<p>The suspect, David Depape, 42, is said to have tried to tie Mr Pelosi up and demanded to know “where&#8217;s Nancy?”, according to reports.</p>
<p>US President Joe Biden described the attack as “despicable” and denounced a corrosive political climate for contributing to violence.  “Enough is enough is enough,” he said during a speech in Philadelphia.  &#8220;Every person of good conscience needs to clearly and unambiguously stand up against the violence in our politics, regardless of what your politics are.&#8221;</p>
<p>In the hours following the attack, the US government put out a bulletin to law enforcement across the nation warning of a “heightened threat” of domestic violent extremism against candidates and election workers driven by individuals with “ideological grievances”.</p>
<p>The attack on Mr Pelosi is being treated as attempted murder.  A motive has not yet been fully determined, but San Francisco Police Chief William Scott said the attack was &#8220;intentional&#8221; and not random.</p>

<p>Mrs Pelosi &#8211; who was on the other side of the country in Washington DC at the time of the assault &#8211; flew back to see her husband in hospital.</p>
<p>A spokesman for the senior Democrat said Mr Pelosi had been attacked in the early hours of Friday morning “by an assailant who acted with force, and threatened his life while demanding to see the Speaker”.</p>
<p>San Francisco Police are leading the investigation and are working with the FBI and US Capitol Police.</p>
<p>Ms Pelosi, the highest-ranking Democrat in Congress, was in Washington at the time of the assault, according to US Capitol Police.</p>
<p>The suspected attacker has espoused extreme right-wing views on social media, including conspiracy theories about Covid-19, the Wall Street Journal reports, citing law-enforcement officials.</p>
<p>He also allegedly posted videos from Donald Trump ally and MyPillow founder Mike Lindell, as well as theories on the 6 January attack on the Capitol.</p>
<p>DePape also posted links to YouTube videos with titles like “Democrat FARCE Commission to Investigate January 6th Capitol Riot COLLAPSES in Congress!!!”  and “Global Elites Plan To Take Control Of YOUR Money!  (Revealed)&#8221;.</p>
<p>Politicians from both sides of the political divide have condemned the attack.</p>
<p>Senate Majority Leader Chuck Schumer, a fellow Democrat, said in a statement: “What happened to Paul Pelosi was a dastardly act.</p>
<p>&#8220;I spoke with Speaker Pelosi earlier this morning and conveyed my deepest concern and heartfelt wishes to her husband and their family, and I wish him a speedy recovery.&#8221;</p>
<p>Senate Minority Leader Mitch McConnell, a Republican, said he was “horrified and disgusted” by the attack on Mr Pelosi.</p>
<p>He tweeted: &#8220;Grateful to hear that Paul is on track to make a full recovery and that law enforcement including our stellar Capitol Police are on the case.&#8221;</p>
<p>The White House said President Joe Biden was “praying for Paul Pelosi and for Speaker Pelosi&#8217;s whole family”.</p>
<p>There is mounting concern about the safety of politicians in the US almost two years after a mob of pro-Donald Trump supporters stormed the Capitol in January, 2021.</p>

<p class="fnmMv geuMB alqtB Dyur"><span>SAN FRANCISCO (KGO) &#8212; </span>In the middle of the night, a man broke into the San Francisco home belonging to Speaker of the House Nancy Pelosi and attacked her husband, Paul, with a hammer.  The suspect, identified as 42-year-old David DePape, was arrested.  The case resulted in multiple charges on both a state and federal level and a closer look at security for American politicians and their families.</p>
<p class="fnmMv geuMB alqtB Dyur">Here is a timeline of the events that began with the attack on Oct.  28, 2022.</p>

<h2 class="QPHAk mCxI alqtB gHBxs">Dec  14, 2022</h2>
<p class="fnmMv geuMB alqtB Dyur">In a preliminary hearing, a judge finds there is enough evidence to proceed to trial on six state charges against David DePape.  Those charges include attempted murder, assault with a deadly weapon, elder abuse, residential burglary, false imprisonment, and threatening the life or serious bodily harm to a public official.</p>
<p class="fnmMv geuMB alqtB Dyur">For the first time, Pelosi&#8217;s 911 call was played as well as police bodycam video.  The prosecution called two witnesses: a lieutenant from SFPD&#8217;s Special Investigations unit as well as one of the officers who responded to the 911 call.  That officer demonstrated for the court how he saw DePape strike Pelosi with a hammer.  Prosecutors also played a 17 minute clip of DePape&#8217;s first interview with investigators, as well as surveillance footage from US Capitol Police that showed how DePape entered the property.</p>

<p class="fnmMv geuMB alqtB Dyur">Nancy Pelosi mentions the attack on her husband Paul as she announces that she will not seek a new leadership role among Democrats in Congress.  In her speech, Nancy Pelosi said, &#8220;For my dear husband Paul, who&#8217;s been my beloved partner in life and my pillar of support, thank you. We&#8217;re all grateful for all the prayers and well wishes as he continues his recovery. Thank you you so much.&#8221;  Her comments were met with applause from the people gathered in the chamber.  They stood and clapped for nearly a minute.  Bay Area Representative Zoe Lofgren, seated in the front row, could be seen wiping her eyes.</p>
<h2 class="QPHAk mCxI alqtB gHBxs">Nov 15, 2022</h2>
<p class="fnmMv geuMB alqtB Dyur">David DePape pleads not guilty to the two federal charges against him, attempted kidnapping and assault.  He was brought into the federal courtroom guarded by five US Marshals and two San Francisco Sheriff Officers.  His federal court appointed attorney is Angela Chuang.  His next court appearance is scheduled for Nov. 30.</p>
<h2 class="QPHAk mCxI alqtB gHBxs">Nov 9, 2022</h2>
<p class="fnmMv geuMB alqtB Dyur">A federal indictment is handed up by a federal grand jury against David DePape.  He is charged with attempted kidnapping as well as assault.  Combined, the two charges carry a maximum sentence of 50 years in prison.  The indictment reveals that the encounter between Pelosi, DePape, and police at the front door of the home, when Pelosi was struck with the hammer, unfolded within 15 seconds.  The indictment says that DePape planned to use Speaker Pelosi to lure another individual he had targeted.  Electronic evidence seized at DePape&#8217;s Richmond home shows that he had researched an address for that target, but the indictment did not identify the target by name.  An additional target is also mentioned, but not named.</p>

<p class="fnmMv geuMB alqtB Dyur">A preliminary hearing date for suspect David DePape is set for Dec.  14 on the state charges leveled against him.</p>
<p class="fnmMv geuMB alqtB Dyur">For the first time, Nancy Pelosi speaks about the attack on her husband, in a video update posted to her Team Pelosi YouTube page.  &#8220;Thank you, thank you, thank you for your kind words, your prayers and your good wishes for Paul,&#8221; the speaker says.  &#8220;It&#8217;s going to be a long haul, but he will be well. And it&#8217;s so tragic how it happened. But, nonetheless, we have to be optimistic. He&#8217;s surrounded by family, so that&#8217;s a wonderful thing.&#8221;</p>
<h2 class="QPHAk mCxI alqtB gHBxs">Nov 3, 2022</h2>
<p class="fnmMv geuMB alqtB Dyur">Six days after the attack, Paul Pelosi is released from Zuckerberg San Francisco General Hospital.  He underwent surgery for a fractured skull, received treatment for injuries to his right arm as well as both hands, and is expected to recover.  A statement from Nancy Pelosi says, &#8220;Paul remains under doctors&#8217; care as he continues to progress on a long recovery process and convalescence. He is now home surrounded by his family who request privacy.&#8221;</p>
<p class="fnmMv geuMB alqtB Dyur">Immigration officials say the suspect, David DePape, is in the US illegally and has overstayed a visa from Canada.  ICE has lodged an immigration detainer against DePape.  The detainer is unlikely to have an immediate impact since deportations often happen after criminal cases are resolved.</p>

<p class="fnmMv geuMB alqtB Dyur">US Capitol Police had cameras outside of the home of House Speaker Nancy Pelosi, but they were not monitored, according to multiple sources familiar with the matter.  According to the sources, Capitol Police saw the flash of police lights on the camera, rewound the video, and saw the break-in.</p>
<p class="fnmMv geuMB alqtB Dyur">Former neighbors of David DePape in the city of Richmond talk about the man they knew.  They say he often worked as a handyman and describe him as quiet.</p>
<h2 class="QPHAk mCxI alqtB gHBxs">Nov 1, 2022</h2>
<p class="fnmMv geuMB alqtB Dyur">David DePape makes his first court appearance in this case in order to plead not guilty to six charges against him.  This case is heard in a San Francisco courtroom and concerns charges at a state, not federal, level.  DePape is being held without bail.  He is being represented by public defender Adam Lipson.</p>
<p class="fnmMv geuMB alqtB Dyur">A federal affidavit reveals graphic details about what unfolded inside the Pelosi house in the early morning hours of Oct.  28, 2022. It says Pelosi called 911 at 2:23 am to report a stranger inside his house.  SFPD officers arrived at 2:31 am and encountered Pelosi and DePape inside the house, each with a hand on a hammer.  &#8220;DEPAPE pulled the hammer from Pelosi&#8217;s hand and swung the hammer, striking Pelosi in the head. Officers immediately went inside and were able to restrain DEPAPE. While officers were restraining DEPAPE, Pelosi appeared to be unconscious on the ground.&#8221;</p>

<p class="fnmMv geuMB alqtB Dyur">Pelosi spoke with SFPD officers while in the ambulance on his way to the hospital.  He told officers he had never seen DePape before he woke him up and &#8220;stated he wanted to talk to &#8216;Nancy&#8217;.&#8221;</p>
<p class="fnmMv geuMB alqtB Dyur">The affidavit describes an interview DePape gave SFPD: &#8220;DEPAPE stated that he was going to hold Nancy hostage and talk to her. If Nancy were to tell DEPAPE the &#8216;truth,&#8217; he would let her go, and if she &#8216;lied,&#8217; he was going to break &#8216;her kneecaps&#8217;&#8230;DEPAPE also later explained that by breaking Nancy&#8217;s kneecaps, she would then have to be wheeled into Congress, which would show other Members of Congress there were consequences to actions.&#8221;  DePape says he broke into the house through a glass door by using a hammer.  &#8220;DEPAPE had zip ties, tape, rope, and at least one hammer with him that morning. The evidence further shows that DEPAPE assaulted Mr. Pelosi with DEPAPE&#8217;s own hammer.&#8221;</p>
<p class="fnmMv geuMB alqtB Dyur">The affidavit also mentions a witness who was working as a private security guard at a nearby house.  The witness &#8220;saw an individual in all black, carrying a large black bag on his back, walking near the Pelosi residence&#8221; and soon after the witness &#8220;heard what sounded like banging on either a door or car and then heard the sirens within a minute or two.&#8221;</p>

<p class="fnmMv geuMB alqtB Dyur">David DePape, the man suspected of attacking Paul Pelosi, is released from the hospital and booked into San Francisco jail.  He suffered a dislocated shoulder during his arrest.  He&#8217;s due in court for his first appearance Nov. 1.</p>

<p class="fnmMv geuMB alqtB Dyur">The San Francisco District Attorney&#8217;s office half announces a dozen felony charges against DePape including attempted murder, assault with a deadly weapon, elder abuse, residential burglary, false imprisonment, and threatening the life or serious bodily harm to a public official.  District Attorney Brooke Jenkins says the six felony charges carry sentences of 13 years to life in prison.  DePape also faces federal charges including assault on the immediate family member of a federal official, which carries a maximum sentence of 30 years in prison.  He was also charged with the attempted kidnapping of a federal official, which carried a maximum sentence of 20 years in prison.</p>
<h2 class="QPHAk mCxI alqtB gHBxs">october  29, 2022</h2>
<p class="fnmMv geuMB alqtB Dyur">Nancy Pelosi releases her first statement about the attack.  In a post on Twitter, the House Speaker thanks people for their concern about her husband, Paul, saying &#8220;Thank you for your prayers for my husband and our family.&#8221;  Paul Pelosi remains hospitalized.</p>
<p class="fnmMv geuMB alqtB Dyur">David DePape&#8217;s former partner talks with ABC7 News and shares her concerns about DePape&#8217;s mental health issues.  Oxane Taub, who goes by the name Gyspy, was a well-known local nudist activist who is currently imprisoned.  The two have children together.</p>

<p class="fnmMv geuMB alqtB Dyur">Paul Pelosi is attacked inside his San Francisco home and hit with a hammer.  His wife, House Speaker Nancy Pelosi, was not home at the time of the attack.  Outside their Pacific Heights house, broken glass is clearly visible by an exterior door.</p>
<p class="fnmMv geuMB alqtB Dyur">Paul Pelosi, who is 82 years old, is admitted to Zuckerberg San Francisco General Hospital and undergoes surgery to repair a skull fracture.  He also has serious injuries to his right arm and both hands.  A spokesman for Nancy Pelosi says doctors expect a full recovery.  She arrives around 4 pm after flying in from Washington, DC</p>
<p class="fnmMv geuMB alqtB Dyur">The suspect is arrested and also hospitalized.  He is identified as 42-year-old David DePape.  His current address is in Richmond, but he has past connections to the Berkeley art crowd and was involved in nude protests in San Francisco.</p>

<p>Paul Pelosi, the husband of House Speaker Nancy Pelosi, was violently assaulted inside his home Friday morning in San Francisco, according to a Pelosi spokesman and local police.</p>
<p>An assailant broke into the home and asked &#8220;Where&#8217;s Nancy? Where&#8217;s Nancy?&#8221;  according to an NBC News source.</p>
<p>Officers arrived at the home to perform a welfare check and found the suspect and Pelosi both having one hand on a single hammer.  Police then saw the suspect attack Pelosi, 82, with the hammer, San Francisco Police Chief Bill Scott said during a news conference Friday.  Scott added Pelosi was struck at least once in the attack.</p>
<p>The officers disarmed the suspect, Scott said.</p>
<p>&#8220;This was not a random attack. This was intentional. And it&#8217;s wrong,&#8221; Scott said.  &#8220;Our elected officials are here to do the business of their cities, their counties, and their states, and this nation. Their families don&#8217;t sign up for this &#8212; to be harmed. And it&#8217;s wrong.&#8221;</p>
<p>Pelosi was taken to Zuckerberg San Francisco General Hospital, where he is recovering from surgery on his head, a source at the hospital with firsthand knowledge says.  Previous reports citing a hospital source said he was undergoing brain surgery. </p>
<p>&#8220;Mr. Pelosi was admitted to Zuckerberg San Francisco General Hospital where he underwent successful surgery to repair a skull fracture and serious injuries to his right arm and hands,&#8221; Drew Hammill, spokesman for Speaker Pelosi, said in a statement.  &#8220;His doctors expect a full recovery.&#8221;</p>

<p>Secret Service agents and Capitol Police were staged at the hospital.</p>
<p>The suspect was identified as 42-year-old David Depape, and is being charged with attempted homicide, assault with a deadly weapon, elder abuse, burglary and several other felonies, Scott said.  Depape was taken to the hospital in police custody.</p>
<p>Speaker Nancy Pelosi was not at the San Francisco home at the time of the invasion and assault.  She was in Washington, DC under her protective detail, according to her office.  The speaker arrived in San Francisco just before 3:30 pm</p>
<p>According to a family member traveling with Nancy Pelosi, Depape was trying to tie up Paul Pelosi &#8220;until Nancy got home,&#8221; and when officers arrived at the scene, he said &#8220;we are waiting for Nancy.&#8221;</p>
<p>								San Francisco Police Chief Bill Scott provides an update on the Paul Pelosi attack investigation.

<p>When Depape wasn&#8217;t looking, Pelosi managed to dial 911, the family member said.  The family is hoping there is a recording of the conversation to provide more information.</p>
<p>“Early this morning, an assailant broke into the Pelosi residence in San Francisco and violently assaulted Mr. Pelosi.  The assailant is in custody and the motivation for the attack is under investigation,&#8221; read a statement from Pelosi&#8217;s office.</p>
<p>&#8220;Mr. Pelosi was taken to the hospital, where he is receiving excellent medical care and is expected to make a full recovery. The speaker was not in San Francisco at the time,&#8221; the statement read.</p>
<p>&#8220;The Speaker and her family are grateful to the first responders and medical professionals involved, and request privacy at this time.&#8221;</p>
<p>San Francisco police said it responded to the scene in the 2600 block of Broadway for a home break-in.  The Capitol Police, the FBI and San Francisco police are conducting a joint investigation into the home invasion assault.</p>
<p>Pelosi&#8217;s home was vandalized last January, just a few days before the Jan. 6 attack on the Capitol, as was the home of then-Senate Majority Leader Mitch McConnell, R-Ky.  Pelosi&#8217;s garage door was defaced with phrases including &#8220;$2K,&#8221; &#8220;Cancel rent!&#8221;  and &#8220;We want everything!&#8221;  This came several days after Congress failed to approve a measure to increase coronavirus stimulus checks to $2,000.</p>
<p>Meanwhile, politicians from both sides of the aisle took to social media to condemn the attack.</p>
<p>								Political Analyst Larry Gerston says there&#8217;s definitely a question whether the assault on Nancy Pelosi&#8217;s husband at the couple&#8217;s San Francisco home is politically motivated.
