<p>Douglas Stewart has spent the last 15 years making his space at the Oakland Cannery into a home with artwork on every free space of the walls and vinyl records covering the tabletops.
</p>
<p>Stewart is a man of many titles, including teacher, activist, advocate and above all, artist. He’s worked in arts preservation, poetry and has helped in juvenile justice centers and prisons to support vulnerable communities dealing with mental health and wellness issues.
</p>
<p>The Oakland Cannery is more than a residence for Stewart and its other tenants, it’s also their workspace. However, after 47 years, the residents have been issued a 120-day eviction notice.
</p>
<p>Problems at the Cannery began in 2016 when Green Sage, a Colorado-based cannabis cultivation company, acquired the property at 5733 San Leandro St. Their plan was to use this and other similar sites in the area for large-scale cannabis production.
</p>
<p>“Unfortunately, however you want to look at it, Green Sage took over as landlords right around the time that the licenses and the Oakland Cannery got deemed as a ‘green zone’. And that’s when they started kicking out the commercial tenants below us and really started activating the space for cannabis operators and operations,” Stewart said.
</p>
<p>Stewart and Alistair Monroe, son of the late painter Arthur Monroe who is responsible for the Cannery’s transformation into Oakland’s first live-work residence, claim their homes became unlivable due to the property owners’ neglect.</p>

<p>Both told stories of poor <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a>, electrical problems, lack of security and maintenance workers entering their homes unannounced. Despite numerous complaints and maintenance, requests, the property owners failed to address the problems.
</p>
<p>“They had a lawless mentality to say that we were not residential use, we were commercial use, and we had to do as they say,” Monroe said.
</p>
<p>Stewart supports safe cannabis cultivation and equal market opportunities. He is critical of Green Sage for saturating the market and hindering local business growth in Oakland.
</p>
<p>Holding a micro-license for distribution and sales, Stewart benefits from an equity program that aids Oakland residents impacted by the War on Drugs with permits, grants and interest-free loans.
</p>
<p>Stewart tried to use the Cannery’s commercial space for his license but was denied by the property owners. His efforts to rent other city spaces also ended in eviction.
</p>
<p>“I can’t really afford to find a new place for my business license to hang up after being displaced by my last business operations location and then also having to try to juggle and figure out where I’m gonna be laying my head within the next three months after the Ellis Act eviction,” Stewart said.
</p>
<p>Three years into their ownership, Green Sage defaulted on a $55 million loan from a Canadian private commercial mortgage lender, Romspen. The managers of Green Sage have since disappeared.
</p>
<p>In September, Ellis Act evictions were served to residents of the Oakland Cannery enabling the landlords to take their properties off the market and remove all tenants.
</p>
<p>According to Wikipedia, the Ellis Act is a 1985 California state law that allows landlords to evict residential tenants to “go out of the rental business” in spite of desires by local governments to compel them to continue providing rental housing.
</p>
<p>Mark Mersel, an attorney who represents Romspen, states that after Green Sage defaulted on their loan, the mortgage company had to foreclose on the property.
</p>
<p>He stated that many, if not all, of the current tenants at the Oakland Cannery had not paid rent or did not have valid leases with the property, and that they are all “basically squatters.”
</p>
<p>“All Romspen is trying to do is get this property to operate, not be a blight on the neighborhood, and operate it for its industrial intended purpose,” Mersel said.
</p>
<p>Monroe suspects the evictions were retaliation for lawsuits and complaints about unlivable conditions in the building and says he saw this coming from a mile away.
</p>
<p>“The first day the landlords were on site they just openly said ‘we’re going to be removing you guys,’” Monroe said.
</p>
<p>Eddie Ytuarte from the Oakland Tenants Union asserts that under the Ellis Act, unless the tenants were given relocation payments at the time of the notice, the eviction is invalid.
</p>
<p>“A lot of things that landlords refuse to do are actual code violations,” Ytuarte stated. “For instance, if the plumbing is no good, or if the heat is insufficient, it’s breaking city codes and if the tenants are under rent control, they could petition for lower rents or they could sue in small claims court.”
</p>
<p>Neither Stewart nor Monroe received relocation payments, only copies of checks via email.
</p>
<p>Ytuarte suggested that tenants looking to fight eviction should seek pro-bono legal services or find an attorney who will take on the case for a much lower rate.
</p>
<p>Monroe said that they tried those options, but to no avail. In other efforts, he and Stewart have hosted events to bring in city officials, like Mayor Sheng Thao and almost every Oakland City Council member to plead their case and find support from their resources.
</p>
<p>A City of Oakland’s public information officer (PIO) wrote in an email to the Post that they have attempted to connect local developers who want to preserve the live-work space to the property owner, but the property owner has not shown any interest.
</p>
<p>“The City has been working to protect the Oakland Cannery and other live/work communities from displacement pressure due to cannabis for many years. In 2018, the City adopted legislation prohibiting any type of cannabis business in live/work spaces. Then in 2023 it went further, prohibiting cannabis cultivation on any part of a property that contains work/live spaces,” said the PIO.
</p>
<p>“Unfortunately, no local protections can prevent landlords from filing an eviction under the Ellis Act, as that is California State law,” the PIO concluded.
</p>
<p>Councilmember Kevin Jenkins, who represents District 6 where The Cannery is located, stated that beyond moral support, there’s not much else that his office can do to help the residents.
</p>
<p>“I think displacement has been a big issue in the last 15 to 20 years. We are losing a large share of our African American population from Oakland. A lot of them are being displaced and being forced to move outside of the county and outside the state,” Jenkins said.
</p>
<p>Monroe and Stewart stopped paying rent in response to the mistreatment of Green Sage and the COVID-19 pandemic. The eviction moratorium protected tenants from eviction due to unpaid rent during the pandemic.
</p>
<p>City ordinance states that in order for a property owner to terminate residency, they have to provide a good or just cause. The Ellis Act is considered a just cause.
</p>
<p>Ultimately, it’s not about the buyout price for Monroe or Stewart. They want The Cannery to remain an affordable live-work space for artists.
</p>
<p>“It’s more than just having a place to lay my head. It’s a place of advocacy. It’s a place for art to be preserved. For a culture to be preserved and for a community to be lifted,” Stewart said.

<p>CINCINNATI (AP) — For the first time all season, Joe Burrow found his top form against the San Francisco 49ers last week for the Cincinnati Bengals.</p>
<p>Just in the nick of time.</p>
<p>The franchise quarterback had struggled through much of the early season because of a calf injury that had sidelined him for the entirety of training camp. One of the NFL&#8217;s best signal-callers just wasn&#8217;t at his best.</p>

<p>An uneven 17-13 win over Seattle on Oct. 15 pushed the Bengals to a manageable 3-3 before their bye week.</p>
<p>“Joe is Joe, man,” said safety Micah Hyde whose Buffalo Bills (5-3) will face the Bengals on Sunday night in Cincinnati. “Last week was a big indication of what they’re able to do on offense with the weapons he has around him. We know that’s their team, that’s their offense, and they go when Joe goes.”</p>
<p>In the previous meeting of the teams, Burrow threw two touchdown passes and Cincinnati’s defense swarmed quarterback Josh Allen on snow-slicked field in Orchard Park, New York, as the Bengals prevailed 27-10 in an AFC divisional playoff game Jan. 22.</p>
<p>The most recent time Buffalo played at Cincinnati&#8217;s Paycor Stadium, during “Monday Night Football” last Jan. 2, is seared in the memory of everyone who was there because of a terrifying incident that brought the game to a halt.</p>
<p>Hamlin recovered and is back with the Bills, although he is not expected to play on Sunday night.</p>
<p>“I think what happened is in the past,” Burrow said when asked about it this week. “I think everybody remembers it, but is not going to dwell on it. I know he&#8217;s not dwelling on it, either.&#8221;</p>
<p>Allen has been bothered by a sore shoulder, but his 71.7% completion rate leads the league. His favorite option, Stefon Diggs, averages 93.5 receiving yards per game.</p>
<p>HAMLIN EXPECTED TO BE INACTIVE ON SUNDAY</p>
<p>As much as he’d like to play, Hamlin told The Associated Press he has no problem with having been inactive for seven of Buffalo’s first eight games this season.</p>
<p>“Since I first got drafted by the Buffalo Bills, I think the first interview that I did, with whomever I spoke to, I told them I don’t care if I had to carry the water,” Hamlin said. “I just want to do my part to win games. &#8230; A team is never ‘I.’ It’s always ‘we.’ So that’s my mission.”</p>
<p>The third-year player’s only game this season was against Miami on Oct. 1, and he was limited to special teams.</p>
<p>The Bills shored up their roster this week by acquiring cornerback Rasul Douglas in a trade with Green Bay and signing free agent defensive tackle Linval Joseph. It’s unclear whether they’ll be available to play on Sunday, though Douglas is a likely candidate to suit up against the Bengals.</p>
<p>Douglas, who had 10 interceptions during the past two-plus seasons with the Packers, is taking over the starting spot for Tre’Davious White (torn right Achilles tendon). And Joseph, who has 13 seasons of NFL experience, will fill in for DaQuan Jones, who is out indefinitely with a torn pectoral muscle.</p>
<p>Buffalo also signed running back Leonard Fournette to their practice squad with backup Damien Harris on injured reserve with a neck injury.</p>
<p>WANTED: AN AFC WIN FOR BENGALS</p>
<p>The Bengals beat the two top teams in the NFC West in consecutive weeks, but haven&#8217;t managed to beat an AFC team yet. They opened the season by losing to AFC North rivals Cleveland and Baltimore. It was in the Ravens game that Burrow aggravated his calf injury. Then they lost to Tennessee in Week 4 before winning the past three straight against NFC teams.</p>
<p>“There’s a lot of guys on this team who have experienced continued success before, and they know how hard it is,” Bengals coach Zac Taylor said. “And so they’re not going to be fooled by having a big road win and thinking, ‘Oh, we’ve arrived, here in a Week 8.’ Not even close. And so that is the benefit of having the team that we have. They know how hard it is going to be going forward to continue this, and I know that they’re willing to put in the work for it.”</p>

<p>NEW YORK — Luis Urias become the first Red Sox player to hit grand slams on consecutive pitches and the first in 80 years to hit slams in consecutive games in leading Boston to an 8-1 victory over the fading Yankees Saturday, sending New York to its seventh straight loss.</p>
<p>Urias cleared the bases in his last at-bat against Washington reliever Robert Garcia on Thursday night and the ninth-place hitter stunned Yankees ace Gerrit Cole in the second inning with a blast to left center.</p>
<p>After allowing the catcher’s seventh homer, Cole (10-4) stared blankly toward right field in disbelief. Cole tied a season high by allowing six runs for the third time and gave up seven hits.</p>

<p>OAKLAND, Calif. (AP) — Ryan Mountcastle singled in Adam Frazier with the go-ahead run as part of a five-run 10th inning, and the AL East-leading Baltimore beat Oakland.</p>
<p>Frazier began the 10th at second base and advanced to third when Adrián Martínez (0-1) threw a wild pitch. Mountcastle’s hit bounced up the middle into center field as Frazier scored for the Orioles. Jordan Westburg added a sacrifice fly and another run was scored on a fielder’s choice grounder by Hays. McCann followed with a two-run single.</p>
<p>Aledmys Díaz homered twice for the last-place A’s, who have lost nine of 11 and own the worst home winning percentage (.295) in the majors.</p>
<p>Felix Bautista (8-2), the fourth of five relievers used by Orioles manager Brandon Hyde, retired three batters for the win.</p>

<p>Miami wasted a terrific performance by Eury Pérez in the first game as the 20-year-old struck out 10 while pitching six innings of two-hit ball.</p>
<p>Ryan Yarbrough (6-5) pitched two perfect innings for the win, and Evan Phillips got three outs for his 19th save.</p>
<p>James Outman drew a one-out walk against David Robertson (4-4) and moved to third on Kiké Hernández’s single. Outman scored the tying run on Austin Barnes’ sacrifice bunt as first baseman Josh Bell’s throw from the side of the mound went past catcher Jacob Stallings.</p>
<p>In the night game, Julio Urías (11-6) allowed just one run — a solo homer to Josh Bell in the first inning — and five hits in seven innings, striking out five. Brusdar Graterol had an eventful ninth, allowing two singles, before getting out of the jam to earn his sixth save.</p>

<p>ANAHEIM, Calif. (AP) — Harold Ramírez had a career-high four hits, Isaac Paredes added three hits, including a three-run homer in the sixth inning, and Tampa Bay routed Los Angeles for a doubleheader split.</p>
<p>Brandon Drury had three hits, including a solo homer, to help the Angels win the first game 7-6.</p>
<p>Zach Eflin (13-7), the American League wins leader, allowed one run and four hits in six innings.</p>
<p>Tampa Bay had a 2-0 lead before breaking it open with four runs in the fifth. Angels starter Patrick Sandoval (6-10) appeared to retire the Rays in order, but Randy Arozarena’s fly ball popped out of Angels center fielder Jordyn Adams’ glove to extend the inning.</p>
<p>The Rays took advantage with four straight hits, including Paredes’ RBI single, a two-run double by Curtis Mead and Osleivis Basabe’s run-scoring double.</p>
<p>In the earlier game, Randal Grichuk drove in two runs for the Angels, who won for just the fifth time in 17 August games. Grichuk also made a leaping catch at the wall in the second inning to rob Yandy Diaz of a home run.</p>
<p>Griffin Canning (7-5) got the win and Reynaldo Lopez pitched a scoreless ninth for his sixth save.</p>
<p>Rays starter Tyler Glasnow (6-4) took the loss.</p>
<p>BREWERS 6, RANGERS 1</p>
<p>ARLINGTON, Texas (AP) — Willy Adames was 4 for 4 with two RBIs and Carlos Santana homered for the second consecutive day to lead Milwaukee over Texas.</p>
<p>After striking out five consecutive Rangers in the first two innings, Brewers starter Freddy Peralta (10-8) threw 40 pitches during a hectic third in which he allowed a run on two singles and two walks.</p>
<p>Rangers starter Dane Dunning (9-5) allowed three runs on seven hits and a walk in five innings. He struck out four.</p>
<p>Martin Perez replaced Dunning and the Brewers greeted him with a double and RBI single by Andruw Monasterio to build a 4-1 lead. Perez allowed three runs on eight hits and two walks over four innings of relief.</p>
<p>MARINERS 10, ASTROS 3</p>
<p>HOUSTON (AP) — Julio Rodríguez set a major league record with his 17th hit in four games, Dylan Moore homered twice, Logan Gilbert registered his 14th quality start of the season and Seattle won its fifth straight.</p>
<p>Gilbert (11-5) surrendered just two runs on eight hits, struck out three and walked one in six innings.</p>
<p>Jose Altuve in the fifth inning became the newest member of the 2,000-hit club. Altuve lined a 2-2 pitch from Gilbert into the left field corner.</p>
<p>Rodriguez, with a single to left field in the seventh inning, broke a major league record set in 1925 by Milt Stock of the Brooklyn Robins. The previous record was 16 hits in four games. Rodriguez finished 4 for 6, giving him his fourth-consecutive four-plus hit game.</p>
<p>Houston starter Framber Valdez (9-9) gave up six runs on 10 hits, striking out five and walking two in five innings.</p>
<p>The Astros three runs came off solo homers by Alex Bregman, his 20th of the season, Yainer Diaz and Mauricio Dubón.</p>
<p>BLUE JAYS 4, REDS 3</p>
<p>CINCINNATI (AP) — Davis Schneider hit a tiebreaking solo homer and Jordan Romano worked out of a jam in the ninth inning, sending Toronto over Elly De La Cruz and Cincinnati.</p>
<p>Chris Bassitt pitched six efficient innings as Toronto rebounded from a stretch of five losses in seven games. All-Star Bo Bichette hit an RBI single in his first big league game since July 31.</p>
<p>Schneider went deep against Brandon Williamson (4-3) with one out in the fifth, giving Toronto a 4-3 lead. It was Schneider’s third homer of the season.</p>
<p>Bassitt (12-6) was charged with three runs, two earned, and three hits. He struck out six and walked one.</p>
<p>PHILLIES 12, NATIONALS 3</p>
<p>WASHINGTON (AP) &#8212; Trea Turner hit two home runs in an eight-run eighth inning and Philadelphia went deep five times, rallying past Washington.</p>
<p>Nick Castellanos, Jake Cave and Bryson Stott also homered for Philadelphia, which had lost four of five.</p>
<p>Riley Adams drove in two runs for Washington, which had won six of its last seven overall and 15 of 18 at home since July 8.</p>
<p>Cory Abbott (1-2), pitching for the first time since Aug. 11, took the loss.</p>
<p>Seranthony Domínguez (3-3) pitched a scoreless seventh and earned the win. He allowed three runs, two earned, in six innings while striking out five.</p>
<p>BRAVES 6, GIANTS 5</p>
<p>ATLANTA (AP) — Eddie Rosario had four hits, including a go-ahead, two-run homer in the eighth inning, and Atlanta Braves earned its fifth straight win.</p>
<p>Marcell Ozuna hit a two-out single off Tyler Rogers (4-5) in the eighth. Rosario followed with his 19th homer, a first-pitch blast that carried 441 feet to center field.</p>
<p>LaMonte Wade Jr. had two hits, including a homer on the game’s first pitch, but the Giants were handed their third straight loss.</p>
<p>Logan Webb allowed four runs on nine hits in six innings for San Francisco.</p>
<p>Kirby Yates (7-0) pitched a scoreless eighth. Raisel Iglesias earned his 23rd save with a perfect ninth.</p>
<p>PIRATES 7, TWINS 4</p>
<p>MINNEAPOLIS (AP) — Mitch Keller pitched six strong innings and Pittsburgh broke through late against Sonny Gray to beat Minnesota.</p>
<p>Gray (6-6) was perfect through five innings before Liover Peguero had an infield single with one out in the sixth. Andrew McCutchen had a two-run single as part of a three-run sixth for Pittsburgh and added a three-run homer in the ninth.</p>
<p>Keller (10-8) gave the offense time to solve Gray with another quality start. He gave up two runs and seven hits and struck out 12 — one short of matching a career high he set earlier this season.</p>
<p>David Bednar surrendered a run but got the last four outs for his 26th save.</p>
<p>CUBS 6, ROYALS 4</p>
<p>CHICAGO (AP) — Cody Bellinger homered twice and Justin Steele pitched six effective innings, helping Chicago beat Kansas City.</p>
<p>Ian Happ and Seiya Suzuki each hit a sacrifice fly for Chicago, which had dropped three of four. The Cubs are fighting for playoff positioning in the crowded NL standings.</p>
<p>Steele (14-3) allowed two runs and six hits. He struck out seven and walked none while improving to 5-0 in his last six starts. Adbert Alzolay worked the ninth for his 17th save in 18 chances.</p>
<p>Bobby Witt Jr. had three hits for Kansas City, and Salvador Perez went 2 for 3 and scored two runs. Brady Singer (8-9) was charged with six runs — four earned — and nine hits in 3 2/3 innings.</p>

<p>SAN DIEGO (AP) — Gabriel Moreno hit a grand slam and drove in five runs to lead Arizona over San Diego for a sweep of a day-night doubleheader.</p>
<p>Tommy Pham hit a two-run homer and tripled to lead the Diamondbacks to a 6-4 victory in the opener.</p>
<p>Padres ace Yu Darvish (8-9) took the loss in the second game, going five innings and giving up three runs and nine hits while striking out seven. It was Darvish’s ninth outing this season throwing 100 or more pitches.</p>
<p>Diamondbacks starter Scott McGough made it 2 1/3 innings and was removed in favor of reliever Bryce Jarvis (1-0), who made his third appearance of the season. Jarvis pitched 3 2/3 innings, giving up one run and two hits.</p>
<p>In the first game, Diamondbacks starter Merrill Kelly (10-5) gave up three runs and five hits in 5 1/3 innings for the win. Paul Sewald earned his 26th save by blanking the Padres in the ninth despite giving up two walks and hitting a batter.</p>
<p>The Padres recalled knuckleballer Matt Waldron (0-2) from Triple-A El Paso to make a spot start. It was Waldron’s second career big league appearance. He lasted five innings, giving up five runs, five hits and striking out five.</p>
<p>TIGERS 4, GUARDIANS 3</p>
<p>CLEVELAND (AP) — Kerry Carpenter hit a three-run homer and Javier Báez had a solo shot as Detroit handed Cleveland rookie Tanner Bibee his first loss in more than two months.</p>
<p>Carpenter connected in the first inning off Bibee (9-3), who had won his previous seven decisions and was unbeaten since June 13. Báez homered in the seventh off Nick Sandlin to put the Tigers ahead 4-2.</p>
<p>Matt Manning (5-4) held the Guardians to one run and five hits in six innings. The right-hander came in 0-2 with a 17.61 ERA in two previous outings at Progressive Field.</p>
<p>Cleveland had its chances.</p>
<p>Detroit’s Alex Lange worked out of a bases-loaded jam in the seventh, Andrew Vasquez escaped a mess in the eighth and Jason Foley retired the Guardians’ 1-2-3 hitters in the ninth for his seventh save.</p>

<p>ST. LOUIS (AP) &#8212; Francisco Lindor had four hits and stole home, Daniel Vogelbach hit a grand slam and New York won its fourth straight game.</p>
<p>DJ Stewart and Pete Alonso also homered. Kodai Senga (10-6) allowed one run on two hits, walked two and struck out five batters in seven innings to become the first rookie in the major leagues this season to win 10 games.</p>
<p>Nolan Arenado hit his 26th home run of the season in the bottom of the fourth, and Miles Mikolas (6-9) allowed seven runs on seven hits and walked two batters in 4 2/3 innings as the Cardinals dropped their fourth straight game.</p>
<p>ROCKIES 11, WHITE SOX 5</p>
<p>DENVER (AP) — Kyle Freeland pitched five innings for his first win in three months, and Colorado earned its second straight win.</p>
<p>Elehuris Montero had three hits and four RBIs, and Brendan Rodgers and Nolan Jones also had three hits apiece.</p>
<p>Freeland (5-13) was charged with four runs and eight hits in his first win since May 14 against Philadelphia. The veteran left-hander went 0-9 with a 6.19 ERA in his previous 14 starts.</p>
<p>Luis Robert Jr. hit his 33rd homer for the White Sox, who have dropped six of seven. Elvis Andrus continued his hot stretch with two hits and a steal of home in the first inning.</p>
<p>Colorado scored three runs in the first and two more in the second off Jesse Scholtens (1-6).</p>

<p>FARGO — Doug Burgum is about to enter a crowded field of candidates vying for the Republican presidential nomination as an unknown figure on the national political stage.</p>
<p>But one early job on Burgum’s resume could help the dark-horse candidate stand out: chimney sweep.</p>
<p>While attending North Dakota State University, Burgum hired himself out as a chimney sweep. The unusual occupation was featured in the student newspaper, with a photo of Burgum, in top hat and tuxedo on a snowy roof, and was picked up by a wire service.</p>
<p>The admissions office at Stanford University saw the article — and Burgum was admitted to its master’s of business administration program.</p>
<p>There, he met Steve Ballmer, who would go on to become CEO of Microsoft and an influential business adviser for Burgum.</p>
<p>After a stint as a consultant at McKinsey &#038; Co., Burgum mortgaged a quarter section of farmland homesteaded by his grandfather to invest $250,000 in a fledgling business software firm called Great Plains Software in 1983.</p>
<p>Burgum, having bet a good part of his inheritance, was unnerved to learn that the business software industry then in its infancy was crowded with competitors, but was able to distinguish his firm with top-notch customer service, a lesson learned from his family’s grain elevator business in Arthur.</p>
<p>The willingness to take a big risk — moderated by working assiduously to improve his odds of success — would prove to be an attribute that would help define Burgum’s rise in business and his later career as a politician.</p>
<p>“Betting the farm,” as Burgum later would describe his source of startup capital, would prove to be a good wager. When Great Plains broke ground at its south Fargo campus, Burgum harnessed a horse-drawn plow to mark the occasion.</p>

<p>In 2001, less than two decades after Burgum tied his future to Great Plains, with Ballmer at its helm, Microsoft bought Great Plains for $1.1 billion. Burgum stayed on as a Microsoft senior vice president until 2007, then turned his focus to serving as an investor and director on the corporate boards of early-stage software companies.</p>
<p>Freed of the responsibilities of running a company, Burgum also took his business chops in a new direction, real-estate development, which would allow him to indulge his interest in architecture.</p>
<p>He had formed a company, Kilbourne Group, named after his mother’s maiden surname. When Burgum was a boy, his mother took him on walks through downtown Fargo, pointing to notable buildings and telling him their background — a history lesson that helped to inspire what would become a major private downtown renewal project.</p>
<p>Kilbourne Group bought and renovated many distinctive downtown landmarks, including the Black Building, and built the 23-story RDO tower.</p>
<p>It became Fargo’s tallest building, although deliberately shorter than the skyscraping state Capitol, striking a note that was audacious and restrained at the same time.</p>

<p>One of the buildings Kilbourne Group acquired and renovated, the former St. Mark’s Lutheran Church, became the Sanctuary Event Center, where on Wednesday, June 7, Burgum will take the stage to announce his candidacy for the Republican nomination for president.</p>
<p>As a real estate developer, Burgum preached the virtues of dense, downtown development as a way to enliven communities, prevent urban sprawl and save money by avoiding the need to extend expensive public infrastructure and services to the city’s fringe.</p>
<p>Later, as governor, he would promote the same themes through his Main Street initiative, saying that communities must offer attractive amenities to attract workers.</p>
<p>Burgum has made philanthropic contributions, including his family’s support of the Plains Art Museum and his donation of the former Northern School Supply building to his alma mater, NDSU, which became Renaissance Hall, which houses the university’s visual arts department and much of its architecture department.</p>
<p>Although a campaign contributor, Burgum was never visibly active in politics until he entered the 2016 governor’s race after Jack Dalrymple announced that he wouldn’t seek a second term, leaving an open seat.</p>

<p>But a major obstacle stood in his way: Wayne Stenehjem, who had served more than 20 years as attorney general and was the presumptive Republican nominee.</p>
<p>Burgum entered the race trailing by almost 50 points. He sought the endorsement at the party convention, not expecting to win, he said, and finished third.</p>
<p>During the convention, Burgum played up to his outsider image by lecturing the delegates, many of them state legislators, whom he criticized for allowing state government spending to balloon unsustainably on their watch.</p>
<p>His strategy all along was to win the GOP primary, and he made a point of visiting every community in the state with at least 1,000 people, often talking to very small gatherings, especially at first, and filling notebooks with ideas from his encounters with voters.</p>

<p>Burgum roared back from his drubbing at the convention with a convincing victory over Stenehjem, taking 60% of the vote in the primary — and cruising on to beat his Democratic rival by capturing more than 76% in the general election.</p>
<p>Some of Burgum’s famous friends from his time at Microsoft were among his prominent financial supporters during his first campaign for governor. Microsoft founder Bill Gates contributed $107,000 and Satya Nadella, who succeeded Ballmer as Microsoft CEO and who had worked under Burgum at Microsoft’s Fargo campus for 5½ years, donated $10,000.</p>
<p>During the campaign, Burgum ran as an entrepreneur and businessman, with a pitch that he was the right person to apply his tech savvy to reinvent state government through greater efficiency, and to help diversify the economy, too reliant on energy and farm commodities subject to whipsawing price swings.</p>
<p>Once in office, Burgum sometimes clashed with the Republican-dominated Legislature. Although he pledged party unity after winning the divisive primary contest with Stenehjem, Burgum didn’t shy away from tangling with those in his own party.</p>
<p>Burgum showed himself willing to dip into his personal fortune to fund a political group that worked to defeat fellow Republicans who had resisted his initiatives, most prominently former Rep. Jeff Delzer, R-Underwood, who had been the powerful chairman of the House Appropriations Committee, who was at odds with some of Burgum’s spending priorities.</p>
<p>During the 2022 election cycle, records showed Burgum gave at least $935,000 to the Dakota Leadership PAC, which ran an advertising blitz against Delzer, who lost the GOP primary endorsement. Burgum spent much more in 2020, bankrolling the group&#8217;s ad campaign with contributions of more than $3.2 million.</p>
<p>Burgum’s internecine quarrels rankled some of his fellow Republicans, some of whom were legislators who were in a position to make their displeasure known, but Burgum didn’t alter course.</p>
<p>As governor, Burgum has championed energy policy. Unusual for a Republican, he set a goal of using innovation and incentives to achieve carbon neutrality in North Dakota by 2030, exploiting North Dakota’s policy and geological advantages in storing carbon dioxide deep underground.</p>

<p>He boasted that as of 2021 companies had responded by pouring $25 billion of investments into energy initiatives in the state.</p>
<p>In contrast to many of his fellow Republican governors, Burgum’s response to the public health threat posed by the COVID-19 pandemic included support for vaccination and, in the early days of the pandemic, targeted business shutdowns and a mask mandate as measures to prevent hospitals from being overrun with cases.</p>
<p>Chafing at the state interventions, the Republican-dominated Legislature responded in 2021 by passing a law allowing legislators to call a special session, with the power to “terminate, extend, or modify” a state of disaster or emergency declared by a governor.</p>

<p>Burgum’s drive for efficiencies in state government draws upon his background in technology and business.</p>
<p>He sounds like the McKinsey consultant he once was when he makes the case for better cash management of state funds, and he sounds like a former software executive when he rhapsodizes about the need for information technology upgrades that are more consumer friendly.</p>
<p>Burgum has never emphasized socially conservative positions and has generally refrained from joining the “culture war” debates that animate many in a party dominated by Donald Trump. In 2020, Burgum said the state Republican Party’s position on LGBTQ issues was “divisive and divisional.”</p>
<p>Still, in the recently completed legislative session, Burgum signed a near-total abortion ban bill as well as several laws restricting transgender rights. Earlier, in 2021, he signed a law banning the teaching of critical race theory in North Dakota public schools.</p>
<p>North Dakota leaders shouldn’t forget that the state is in constant competition for capital and for talent — skilled workers — and be seen as welcoming both, he has said.</p>
<p>Burgum has twice been endorsed by Trump, and has endorsed the former president he now is challenging for the nomination. He has said he would vote for Trump if he is the Republican nominee in 2024, a choice he regards as preferable to President Joe Biden, the likely Democratic nominee.</p>

<p>In seeking the nomination, Burgum is betting that what he has called a “silent majority” of voters who shun the ideological fringes would welcome a pragmatist over a divisive ideologue. He knows that he will have to overcome his underdog status as a governor of a small, rural state who is unknown in national politics.</p>
<p>“There’s a value to being underestimated all the time,” Burgum said, recalling that he had no endorsements in his first race. “That’s a competitive advantage.”</p>

<p>One of the biggest storylines of the preseason is the San Francisco 49ers quarterback battle. Brock Purdy, a 2022 seventh-round pick, appears poised to start. But he’s recovering from offseason elbow surgery. Former No. 3 picks Trey Lance and Sam Darnold are in the mix, as well. </p>
<p>With Purdy out for the team’s first preseason game, the 49ers elected to start Trey Lance against the Las Vegas Raiders. </p>

<p>Lance took two sacks on San Francisco’s opening drive, leading to a three-and-out punt. Second drive, similar result. Run play, short completion, incompletion, punt. Two drives, six plays, three total yards. </p>
<p>Third drive, you know the drill. Trey Lance incompletion, short scramble run for Lance, then a sack. Three-and-out, punt. Three drives, nine plays, 1 yard. Two of the drives netted negative yardage. </p>
<p>Terrible start for Lance in his quest to regain the San Francisco 49ers starting quarterback job. </p>
<p>But after the 49ers’ defense forced a turnover-on-downs, the offense came to life. </p>
<h2 id="h-trey-lance-san-francisco-49ers-offense-finally-get-something-going-against-the-raiders">Trey Lance, San Francisco 49ers offense finally get something going against the Raiders</h2>
<p>Lance and the San Francisco offense started on their own 39-yard line. </p>
<p>Finally, they started to get something going. A good mix of run and pass had the offense quickly moving down the field. </p>
<p>Lance made a few nice throws, including one where it looked like he was going to scramble, but at the last second completed a pass for a first down inside the Raiders 10-yard line. </p>
<p>From the 9, Lance made a play-action fake and rolled out to his left. He stopped, turned, and fired the ball over the middle and into the end zone … right into the hands of Raiders defensive back Duke Shelley. </p>
<p>Except, Shelley couldn’t corral the pass. And, he batted it into the air. Where it fell right into the hands of 49ers tight end Ross Dwelley. </p>
<p>A terrible decision by Lance to throw the ball across his body, late, and over the middle. What should have been an interception and the fourth-straight empty drive for Lance and the offense turned into seven points. </p>
<p>On the team’s next drive, Lance made a great throw on a third-and-10 for a first down. But the offense stalled yet again, this time failing to convert on a later fourth-down attempt. </p>
<p>Can’t think the 49ers coaching staff is too excited with the performance of Trey Lance so far in the team’s first preseason game. </p>

<p>FREMONT, CA — A stretch of shoreline in Alameda was ready for summertime visitors after a Fremont teen, Faye Lin, led a cleanup that included more than 50 students and adults. Together, they collected over 350 pounds of trash.</p>
<p>&#8220;Their efforts were especially important right now as the endangered least terns are back in the area. They, along with many other sea birds, are at high risk from consuming plastics or becoming entangled in debris,&#8221; according to Ms. Liz Taylor, president of Deep Ocean Explore Research (DOER) Marine.</p>
<p>The group gathered on April 23. At the time, Lin was completing her junior year at Mission San Jose High School, but she reached beyond her immediate circle of friends to gather students from eight schools: Decoto School of Independent Study, James Logan High, J.F. Kennedy High, Washington High School, Mission San Jose High, Quarry Lane High School, Robertson High, Thomas Russell Middle School, and William Hopkins Junior High School.</p>
<p>May Guo told Patch that the conservation effort was moving, &#8220;It was inspiring to see so many different school students come together for a shared cause.&#8221;</p>
<p>A second cleanup is planned for Saturday. Both students and adults are invited to participate. You must register in advance. Read about details of the cleanup, and then sign up.</p>
<p>Lin has long been inspired by the ocean, becoming an open water scuba diver in Monterey Bay at just 12. Since then, she has conducted two award-winning science projects that focused on California giant kelp and sea star wasting disease. She is so passionate about the ocean that she started a chapter of a non-profit organization called AquaMeridian US earlier this year.</p>
<p>According to Gao, Lin&#8217;s goal is &#8220;to educate and inspire her peers about ocean conservation and how to take action to make a positive impact on the global community.&#8221;</p>
<p>Lin was a 2022 Regeneron International Science Fair finalist and two special awards winner.</p>

<p>Bottom line: The San Francisco Giants are playing the Los Angeles Dodgers after Brandon Crawford scored four goals against the Dodgers on Saturday.</p>
<p>Los Angeles is 22-13 at home and 39-32 overall.  The Dodgers have a 24-11 record in which they hit at least two homers.</p>
<p>San Francisco has a 20-15 record away from home and a 38-32 record overall.  The Giants batsmen have an overall on-base percentage of .330, the third-ranked percentage in the Netherlands.</p>
<p>Sunday&#8217;s duel is the sixth meeting of these teams this season.  The Giants have a 3-2 lead in the season series.</p>

<p>Bottom line: The San Francisco Giants meet the St. Louis Cardinals after Joc Pederson scored four in Sunday&#8217;s 13-3 win over the Cubs.</p>
<p>St. Louis is 13-18 in home games and 27-39 overall.  The Cardinals are third in the Netherlands with a total of 90 home runs, averaging 1.4 per game.</p>

<p>SAN FRANCISCO (AP) &#8212; Bryan Reynolds hit three runs and made a jump catch against the wall that helped the Pittsburgh Pirates beat the San Francisco Giants 9-4 and climb back above .500 on Wednesday.</p>
<p>Former Giants Andrew McCutchen and Connor Joe were each 3-4 with an RBI, while the Pirates (28-27) won straight games after falling below .500 for the first time since going 1-2.  Pittsburgh is 8:19 after a 20-8 start.</p>
<p>Mitch Keller (7-1) went 4-0 in his last five starts, allowing four runs and ten hits in six innings with eight strikeouts.  It was his seventh consecutive appearance with at least eight strikeouts.</p>
<p>Alex Wood (1-1) allowed six runs, eight hits and three walks in 4 1/3 innings for a season-high as the Giants fell to .500 at 28:28.</p>
<p>Pittsburgh defeated San Francisco 14-12.</p>
<p>Reynolds hit a two-run single in the fourth and an RBI grounder in the sixth two-run.  He made a spectacular jump catch atop the left field wall with two hits in the sixth round and pinned Casey Schmitt on a sacrificial flight.</p>
<p>Patrick Bailey&#8217;s RBI single put San Francisco ahead in the second set, but Pittsburgh took a 4-1 lead in the third when McCutchen hit an RBI double and scored with Rodolfo Castro&#8217;s single, and Ke&#8217;Bryan Hayes a three made across the left field line and scored the ball third when San Francisco left base exposed.</p>
<p>Wilmer Flores had a broken bat RBI single in the bottom half.</p>
<p>Keller threw a run-scoring wild pitch in the fifth round that cut Pittsburgh&#8217;s lead to 6-3.  Joe had an RBI double in the sixth.</p>
<p>LONG-AWAITED DEBUT</p>
<p>Right-hander Luke Jackson hit a scoreless seventh inning with two strikeouts in his Giants debut after Tommy John&#8217;s surgery in April 2020 at Atlanta.  In January, he signed a two-year, $11.5 million contract with San Francisco and was reinstated off the 60-day injured list.</p>
<p>TRAINING ROOM</p>
<p>Pirates: 1B Carlos Santana missed his third straight game due to muscle strains in his lumbar spine.</p>
<p>Giants: OF Michael Conforto was scheduled to undergo an MRI and X-ray after leaving Tuesday&#8217;s game with a bruise to his left heel.</p>

<p>Pirates: RHP Roansy Contreras (3-4, 4.33 ERA) opens a three-game home series against St. Louis and RHP Jack Flaherty (3-4, 4.81) on Friday night.</p>
