Editor’s Note: This story has been updated to clarify that RK Mechanical did not design the system, only manufactured and installed it. The company said the information on its website was incorrect.

AURORA, Colo. (KDVR) – No state investigators will be involved in the investigation into the cause of the ceiling HVAC system collapse in a crowded pool area at the Gaylord Rockies Resort and Convention Center.

According to Aurora Fire Rescue, six people were injured, two of them critically, when firefighters and paramedics responded to the accident on Saturday morning. But neither Aurora Fire nor any other city agency is responsible for investigating what went wrong on private property.

‘There Were Kids Down There’: Survivor describes collapse in Gaylord Rockies that left six injured

In a statement emailed to FOX31, a spokesman for the Gaylord Rockies Resort and Convention Center said: “We are devastated by this traumatic incident. On Saturday, our top priority was to support the emergency services and provide help to those directly affected. We are very grateful to the Aurora Fire Department for their prompt intervention. Going forward, our focus is on helping our affected guests and staff, and we are working with the appropriate experts to conduct a thorough investigation.”

The spokesperson didn’t respond to follow-up questions, including who the “appropriate experts” were, but it’s likely Gaylord will have many questions for RK Mechanical.

Gaylord hired a Denver contractor for HVAC work

This is the Denver-based company that, according to its own website, “manufactured and installed the all new mechanical, hydraulic and plumbing systems for this floor plan building.” Our team acted as the sole mechanical subcontractor for the entire project, including the hotel and of the convention center.”

RK Mechanical released a video in December 2017 showcasing its work a year before the 1,500-room hotel and convention space opened to the public.

Before the air conditioner collapsed at the Gaylord Hotel, metal spinning could be heard

The company released a statement to problem solvers on Monday afternoon.

“RK Mechanical was one of the contractors who installed mechanical equipment during construction of the Gaylord Rockies Resort about five years ago,” the statement said. “We continue to work with local authorities, Gaylord and other contractors to determine the cause of this accident. In the meantime, our thoughts are with those affected by this unfortunate event and we are here to help in any way we can.”

Black fluid spurted out of broken lines in the Gaylord accident

The troubleshooters spoke to a mechanical engineer behind the scenes, who said the black liquid pouring out of broken plumbing was likely a build-up of mold and mildew mixed with water.

He surmised that the vents in the plumbing may have been poorly designed and positioned, preventing moisture from the pool area from properly venting out of the plumbing, causing the heavy liquid to accumulate over years, eventually damaging the plumbing point at which they stopped shattered and collapsed.

“Then we heard people screaming for help”: A witness to the collapse of the air conditioner is happy that her family was unharmed

A lawyer who specializes in civil engineering litigation told Problem Solvers investigators will likely focus on how moisture buildup in the pool area may have affected the stability of the plumbing above.

The City of Aurora granted the Gaylord Rockies Resort more than 60,000 inspections before opening the state’s largest hotel and convention center in December 2018.

A city spokesman told FOX31 that once permits are approved, annual inspections are generally no longer required and it is up to the private owner of the Gaylord Rockies Resort to make sure everything is working properly.

OAKLAND (KPIX) — Police in Oakland are investigating a fatal early morning stabbing Sunday in a Lake Merritt neighborhood that has seen multiple homicides in recent months.

Police said a man was stabbed multiple times just after 3 am near 1200 Lakeshore Avenue.

That makes four homicides on the same lakeside street in less than six months.

“I heard a big commotion and I came outside on the balcony and I saw, like, about five people beating up this guy,” said a woman who declined to provide her name for fear of retaliation.

She said the attackers were two women and three men.

“They just were really beating him up, beating him up and, all of a sudden, the women said ‘Oh, let’s go! Let’s go! Let’s go!’ So they all jumped into a car. The (victim) got up, then he stumbled, then he fell,” she said.

She said the victim had blood all over his chest and that there were other people standing nearby, including a security guard for her condo building. Those witnesses tried to help the victim after the attackers left.

Oakland police said it’s the fourth homicide on this long dead-end street since Nov. 2021. It is unclear what motivated the stabbing. Police said the previous homicides, involving guns, were over robberies.

“Unfortunately, not surprised because there’s been so much of it,” said Michael Ziolkowski, who lives on the block.

“It’s really discouraging sometimes. I still love the neighborhood but I don’t think I would be comfortable sitting on a bench here after dark, honestly,” said neighbor Krista Sumida.

Area residents said they are fearful to leave their home at night. In addition to the four homicides, the East Bay Times reported there have been seven non-fatal shootings in the cul-de-sac since May 2021.

“We need a greater police presence on this cul-de-sac,” Sumida said.

“If (the police) drive through with their lights flashing, that kind of makes a lot of the cars move and get out,” Ziolkowski said.

One neighbor was seen with a large moving truck on the block moving out. He said he was tired of the violence and shootings.

“We’ve had three neighbors just moved out of this building in the last eight months,” Sumida said.

The dead end stretch of Lakeshore Avenue is a popular hang-out spot for young people to park their cars and party at night. Neighbors said that makes those people easy targets for robbers and some of those parties have led to fights and shootings.

“My message to our mayor is to please step up, pull your leaders together and come up with a viable way where we can be safe,” said neighbor Colette McPherson.

Oakland police did not release the stabbing victim’s name. He was in his 30s.

Police were still looking for the suspects.

Anyone with information is asked to contact the OPD Homicide Section at (510) 238-3821 or the TIP LINE at 238-7950.

SACRAMENTO (CBS SF / AP) – Governor Gavin Newsom’s government on Tuesday tapped a former federal attorney to help investigate billions of dollars in fraudulent unemployment benefits paid by the state during the shutdown of the COVID-19 pandemic.

The Employment Development Department and Fraud Task Force of the Governor’s Office of Emergency Services have appointed McGregor W. Scott as “Special Adviser on Fraud.” Authorities said Scott will work with law enforcement to fight fraud and prosecute anyone accused of offending the government.

CONTINUE READING: 3 Indicted in the Northern California prison-based EDD fraud system

Scott was the US Attorney for the Eastern District of California under former Republican Presidents George W. Bush and Donald Trump. The district spans 34 counties from the Oregon border to Bakersfield in the Central Valley.

While US attorney Scott and several district attorneys revealed that the state had approved hundreds of millions of dollars in unemployment benefits on behalf of prison inmates, including some convicted murderers on death row.

“The state unemployment systems were attacked by sophisticated international and national organized fraud systems last year,” said Scott. “We look forward to working with EDD, Cal OES, and local, state and federal attorneys to identify, investigate, and prosecute those who stole benefits that rightly belonged in the pockets of Californians in need.”

CONTINUE READING: California EDD now requires proof of job search in order to receive unemployment benefits

California was overwhelmed by jobless claims during the coronavirus pandemic after Newsom issued the first nationwide home stay order that forced many businesses to close. As of March 2020, more than 23 million applications have been made, with the state paying $ 158 billion in benefits.

But at least $ 11 billion of that money was fraudulent, state officials said earlier this year. The state has classified an additional $ 20 billion in services as “suspicious” but has not yet said how many of these services were fraudulent.

The employment development department has put in place safeguards to help detect fraud and identity theft, including using a new identity verification tool and matching claims against Thompson Reuters law enforcement databases, the department said in a statement.

MORE NEWS: UPDATE: State Requiring Proof of Job Seeker for Unemployment Benefit; How will EDD enforce it?

“McGregor Scott has led numerous large-scale criminal investigations in his many years as a prosecutor and federal attorney – an experience that will help put criminals behind bars for defrauding the system,” said Rita Saenz, director of the division Employment development.
