The Tuolumne County Board of Supervisors voted 4-0 Tuesday to continue a public hearing until December about abatement actions on an illegal cannabis grow where faulty equipment allegedly sparked a wildfire on Mount Knight in late July.

The board decided to continue the hearing after they heard from residents of Mount Knight who disputed county Code Compliance’s parcel numbers and identification of owners in the case. The board had to hold the hearing to determine if destruction of 667 cannabis plants on the property where the fire started was justified under county ordinance code. The owner was invoiced $5,594.96 for administrative and investigative costs.

“I live up in Mount Knight,” a man named William Dunlavy Jr. told the board and county staff in a scheduled public hearing Tuesday afternoon. “You’ve got the parties wrong, and you’ve got the parcel wrong. We reported the fire. We have 20 acres, and the fire was on the 20 acres below us. Right below us. The fire started out of a water pump that malfunctioned at 2:45 in the morning.”

Dunlavy said growers were present on a different parcel, not the one named in paperwork by the county. New property owners were being wrongly impugned by the county, he said, and the grow where county Code Compliance cut down 667 cannabis plants was on a different parcel.

“You have the wrong people,” Dunlavy continued. “I can attest to that. I just met the new owners here today. They haven’t even been on the property. I’m telling you, you’ve got the wrong party.”

Dunlavy’s wife said she knows who hired workers to work on the illegal grows in Mount Knight, and she knows they were seen on game cameras leaving the area when the Knight Fire broke out July 29.

Sharrol Dunlavy said she had photos from a game camera and a neighbor’s game camera showing employees of the owner of the property where the cannabis plants were located leaving in “great excitement” when the fire started.

“All of us up here from Mount Knight know it was his crew who started the fire,” Sharrol Dunlavy said. “These other people are innocent.”

A man named Kurt Wagoner told Code Compliance staff, “I live in Mount Knight. You’re wrong . . . . We’ve been complaining about it for years. It’s not the property you guys are saying it is.”

Another man offered a business card with a surveyor’s name. District 4 County Supervisor Kathleen Haff, the board chair, asked him to share the card with the board clerk. Two people offered to share parcel maps with the county.

District 2 County Supervisor Ryan Campbell said he’s been talking to people in Mount Knight for the past year and a half, he’s been up there at least once and the July 29 fire was a wakeup call.

“This has been a problem for our community for a long time and the only way to address it is code compliance,” Campbell said. “Which is too bad, because we’re not talking about this as the criminal actions they are. If it were not for the work of the people living in Mount Knight working to put that fire out, it could have made the national news. We need to make sure we are going after the correct people who are responsible. If we’re hurting someone who is not the perpetrator, that does not help our cause at all.”

Campbell moved to continue the hearing until 1:30 p.m. Dec. 19. It was seconded by District 1 County Supervisor David Goldemberg. 

Brandon joined Haff, Campbell, and Goldemberg in voting 4-0 to continue the hearing. District 3 County Supervisor Anaiah Kirk, who was present earlier for part of the hearing, had to leave before the board voted to continue.

County staff prepared a background report for the hearing, which included the following:

• On July 31, county Code Compliance investigators and the U.S. Forest Service went out to a parcel located in the Mount Knight area of the county. The parcel in question has no legal address. Its parcel number is APN: 023-490-029 in the Twain Harte zip code 95383.

• This parcel was identified to be the location of a wildland fire — the Knight Fire — that occurred on July 29 and was stopped at about 5.4 acres.

• During the July 31 inspection, multiple violations of county code were found on the premises, including unpermitted cultivation of 667 cannabis plants; structures and equipment used for cultivation, processing, or storing of cannabis for personal use that did not comply with building, electrical, mechanical, plumbing, and fire code regulations of the county or state; violations of county, state, and federal environmental and water regulations related to water usage, stormwater management, and fertilizer, pesticide, herbicide, and rodenticide storage and use; and unlawful disposal of solid waste.

An earlier hearing focused on another case of illegal cultivation of cannabis which was appealed by Irene Jiayi Ouyang, owner of a property at 19279 Second Garrote Ridge Road, Groveland.

The property was among several where authorities seized a combined 2,277 pounds of cannabis worth an estimated $3.7 million, three assault rifles, 11 other firearms, and $6,000 in cash during raids in Groveland, Big Hill, and Columbia on Sept. 19-20.

At the property on Second Garrote Ridge Road in September, state Department of Cannabis Control Law Enforcement Division personnel seized 1,296 plants and a total weight including cannabis flowers of 661 pounds, estimated to be worth $1.01 million.

“One subject booked after evading capture,” a DCC detective wrote in an after-action report. “Located across ridge and picked up by CHP (PC148). Structure red tagged.”

Quincy Yaley, director of the county Community Development Department that handles county Code Compliance, said in September that other cannabis enforcement activities had previously taken place at the property when investigators with county Code Compliance went there in June.

Ouyang appealed the county’s actions in June, and its abatement order that she pay $120,246, but she did not appear at the Tuesday hearing, and neither did her interpreter, Vivien Choy.

“I purchased the property around May of 2019, it has been rented out since,” Ouyang wrote in her request for a hearing. “I live in San Francisco, I am neither involved nor aware of the marijuana cultivation inside the house. I already contacted a licensed contractor, he will help to bring the property into compliance as soon as possible.”

Haff said the property has been on her radar since she took office in January 2021. She said she was surprised the monetary penalty was only $100 per plant.

“That’s at least how long this has been going on,” Haff said. “So I’m glad we finally mustered the forces that we needed to scope the situation out. I have found these violations to be true and accurate. The owner is responsible. The penalties, I don’t think they’re enough but, there they are, I think they are just. I find all of the allegations are true.”

The board voted 5-0 finding violations at the property existed.

THE family of an Irishman who has been missing abroad for almost a week are becoming increasingly concerned for his safety.

Galway man James Gleeson has been missing from California, in the USA, since Thursday, September 28.

James has been missing from the Parkside area of San Fran since September 28

The 35-year-old was last seen five days ago in the Parkside area of San Francisco wearing a maroon flannel jumper, a high-vis vest and carrying a backpack.

He has been described by worried family as of a slim build, approximately 6ft 1in with light brown hair and brown eyes.

James, who is originally from Dunmore, recently moved to San Francisco in California.

In the days since he has gone missing, family have become increasingly concerned about his whereabouts.

One person said: “Please God you will be found safe and well.”

Another added: “Please be found safe and well James. If anyone knows people over there please keep a massive look out.”

Police in the US have issued an appeal for his whereabouts and a notice reads: “Missing: James Gleeson, last seen in the Parkside/Sunset area near Sloat.

“Wearing a maroon checkered flannel jumper with a reflective vest carrying a backpack. Irish male, ‘6″1, light brown hair, brown eyes, 35 years.

Separately, the devastated mum of a teenager missing for nine days has appealed to the public to help find her son, saying: “I want my boy back.”

Worried Kelly Smith urged anyone with information about the whereabouts of her 18-year-old son Josh Markey to contact her or the police immediately. 

She told in a poignant Facebook post that she has suffered nothing but torment and despair over the past week after Josh vanished off the face of the earth from the Rathmullen Park housing estate in Drogheda.

Gardai have categorised his disappearance as “high risk” and believe his life could be in danger.

There are unconfirmed reports that he may have been abducted.

The heartbroken mother said: “All these days gone and not one single person has heard or seen my son. 

“Someone knows something. He didn’t just walk into the middle of Rathmullen and a UFO came down and beamed him up Scottie.

“Someone knows something, I want my boy back.

“I am begging anyone that knows anything about my son or his whereabouts whether it is good or bad news, please tell me.”

VISALIA (AP) – A three-year-old girl has died after her mother left her in a car for several hours while she worked in a marijuana grower in the San Joaquin Valley, police said.

The doors were closed and the windows were up and the outside temperature was around 100 degrees when rescue workers were dispatched to the parked vehicle on Thursday, the Visalia Police Department said in a statement.

Family members as well as a police officer and paramedic attempted to resuscitate Jessica Campos, but she was pronounced dead after she was rushed to the hospital.

Detectives conducted interviews and learned that Eustajia Mojica Dominguez, 28, was handling an illegal marijuana cultivation while her child was in the car for up to 3 hours, police said.

They later searched Mojica Dominguez’s home and found 125 pounds of marijuana plants and approximately 425 pounds of processed marijuana. Four other children, aged 15.11 years and two aged 9 months, who lived in the house, were placed in the care of the youth welfare office, the police said.

Four adults in the house were arrested and booked to investigate child risk.

Mojica Dominguez was held in the county jail for negligent homicide. It is not immediately clear whether she has hired a lawyer to speak for her.

VISALIA (CBS / CNN) – A three-year-old Visalia girl died after police said her mother left her in an unventilated car for almost three hours in nearly 100-degree heat on Thursday.

Investigators said the mother, identified as Eustajia Dominguez Mojica at the age of 28, left her daughter in the car while she tended a marijuana grow at a house on 100 block on Perez Avenue in Visalia.

Police told CBS Fresno subsidiary KSEE that the child identified as Jessica Campos had been in the car for up to three hours before anyone spotted them. According to the investigators, the outside temperature at this time was at least 100 degrees.

Police found 150 plants outside the house and 475 pounds of processed cannabis inside.

Four other adults were at home and all were arrested on child risk because four children were found in the penitentiary. The children were handed over to youth welfare, including two 9-month-old babies.

Mojica is also charged with child endangerment and negligent homicide because of her daughter’s death.

OAKLAND (CBS SF) – The sound of illegal fireworks has become a nightly soundtrack for many people in the San Francisco Bay Area, but authorities say complaints about high explosives started earlier than usual this year.

Nightly fireworks have become a regular occurrence on the streets of Oakland. They were in the middle of Grand Ave. launched during a celebration on June 19th.

Illegal fireworks shows have also become more common in San Jose, the Peninsula, and San Francisco. It is a phenomenon that is being featured on social media across the county.

“We just got here to get a couple of beers and dinner and we just heard a bang, bang, bang and bang – we thought it was gunfire,” said Alex of San Francisco, who refused to take his Surname to be indicated.

The noise didn’t just scare people.

In San Francisco’s Hayes Valley neighborhood, someone posted a sign asking who will set off fireworks at night to please stop.

“All of our dogs are freaking out and they’re scared of the loud noises,” read the sign.

For some, fireworks can be boring. For others, they have become part of rallies and protests for social justice or an act of defiance towards the police.

“I think people are obviously outraged and trying to express that, so I think you want you want and show how you want,” said a woman identified as Joey in San Francisco.

Oakland Councilor Noel Gallo says the problem is the worst he has seen in his life. He grew up in East Oakland.

“Ordinarily we’d celebrate July 4th and shoot the fireworks for three or four days, but now it’s become a habit for you to hear the fireworks every night from 9 a.m. to 3 a.m.,” Gallo said. “But now people are shooting from their guns.”

He picked up cartridge cases when he volunteered for street cleaning in Oakland this weekend.

“The reality is that our police and firefighters have their hands free right now, but we are at the beginning of the fire season,” said Gallo.

The Alameda County Sheriff’s Office reported an increase in complaints about fireworks Monday and suggested calling the department’s non-emergency number to report incidents.

South San Francisco’s population could grow by 44,000 and the local employment base could double in the next 20 years, according to the guiding principles of a master planning update recently approved by city officials.

Planning officers unanimously voted during a meeting on Thursday, October 22nd, to recommend that South San Francisco City Council adopt revised development standards for downtown, the El Camino Real corridor, the Lindenville neighborhood and areas east of Highway 101.

Politics could cause the city to expand from 64,000 to 108,000 residents. This emerges from a presentation in which the total number of jobs in the city also increased from 57,000 to 104,000 by 2040. The vote sets an important decision by the council members to approve the preferred development alternatives for the update of the general plan, the requirements for an upcoming environmental review and the expected adoption of a master development policy in the next year.

Planning Commissioner Robert Bernardo praised the vision promoted by the plan, which he believed positioned South San Francisco for healthy growth for years to come.

“I appreciate the balancing act these preferred land use alternatives are trying to do,” he said. “There will always be competing interests when it comes to zoning design.”

The main forces driving the diverse interests are opportunities for residential and business growth, as recognized by officials, who hope the new general plan will address the city’s growing imbalance between available jobs and housing.

To that end, the city currently has 64,000 residents living in 22,000 housing units, while South San Francisco has 57,000 jobs, which equates to roughly 2.6 jobs for each housing unit. The current general plan would allow the city’s population to grow to 85,000 residents in 26,000 units with 96,000 jobs, increasing the imbalance to 3.7 jobs per unit.

The revised plan allows the population to grow to 108,000 residents and 40,000 units with 104,000 jobs, while maintaining the balance between 2.6 jobs and housing.

“This plan reflects the exciting development of our city,” said Bernardo, who broadened his perspective by asking planners to allow flexibility to accommodate additional, unexpected changes in the future.

Commissioner Norm Faria agreed to support the growth vision while calling for the plan to remain malleable.

“You need to have that flexibility because we know how much has changed in South City in the last 20 years,” he said. “What do we expect for the next 20 years?”

According to Faria, officials must also ensure that adequate amenities are in place to support the expected development.

“We need to really look into the infrastructure that is needed to support this growth,” he said. “And I think that’s something we should really get into.”

To that end, Faria said the Bayshore area east of Highway 101 is a critical area for transportation and other capital projects to focus on.

The updated master plan targets much of the city’s significant development in the area east of Highway 101 to support expected growth in the biotech sector and also to enable residential development near the Caltrain line.

Housing construction in the area, usually reserved for industrial and life science companies, marks a new direction for South San Francisco. However, the officials worked to ensure that residential construction does not hinder the expansion of the life science industry or displace existing industrial companies.

In Lindenville, officials see an opportunity to move from industrial companies in the southeastern part of the city to the burgeoning residential core of the inner city. Looking ahead, officials hope to step up housing development and introduce more diverse businesses while leaving room for current residents.

For the city center and the El Camino Real corridor, the plan offers space for more dense residential development – an ongoing trend towards the construction of mixed-use projects around public transport hubs such as the Caltrain and BART stations.

Commission chair Alan Wong noted that additional outreach will be included as the plan goes through the public planning process and expressed appreciation for the direction the city is headed as part of the new vision.

“I think this is a good first step,” he said.
