Supporters held a joint watch party in downtown Oakland Tuesday night for U.S. Rep. Barbara Lee and Lateefah Siman, who is running to replace Lee.

While Lee's campaign aides attended the party, Lee skipped them. Instead, she said she would fly back to Washington DC to work.

She was disappointed with the outcome of the race and finished in fourth place. Late Tuesday night, CBS News predicted that Lee will not advance to the November general election.

Before the polls closed, Lee joined her volunteers at her downtown campaign office to urge voters to vote for her. Before leaving the campaign office on Tuesday evening, she spoke about the challenges posed by the Senate race.

“You could see the inequality in money, I mean, come on. Establishment money is not going to a black progressive woman. But we have people, we have donors, we have recurring donors, we have people who have never donated to campaigns before,” said Rep. Lee.

She only answered two questions from the press. Reporters asked her about her future plans, to which she gave no answer.

History and local connections count in San Francisco construction — especially as the city moves past the post-pandemic meltdown of its downtown office market and aims to overcome negative coverage from national news.

Firms based in the city dominated TRD’s first-ever ranking of general contractors in San Francisco. Several have been in the same family for generations.

“We’ve got relationships that go back 30 years or more,” said Bob Nibbi, CEO of third-ranked Nibbi Bros., which was founded by his grandfather in 1950. “That’s an advantage for times like these, when things get tight.”

The pandemic and subsequent negative perceptions of San Francisco are yet another chapter in the city’s ongoing boom and bust storyline, starting with its rapid Gold Rush-era development, followed by the famously destructive 1906 earthquake and fires.

The top-ranked company on the list, Cahill Contractors, started when founder J.R. Cahill was “inspired to rebuild” the city in the wake of the 1906 earthquake, according to the company’s website. These days, Kathryn Cahill Thompson, the company’s CEO since 2016, represents the fourth generation of family leadership.

Thompson and others on the list are all operating in an era of tough financing for construction loans and slow-moving projects.

“Construction is always the last to feel a recession. We’re out there building it, and in the meantime, developers are not getting the next project ready.”
Bob Nibbi, Nibbi Brothers

San Francisco had 6,600 residential units — a staple segment for general contractors — under construction as of the first quarter of 2023, according to data from the city’s planning department. That’s down from 9,600 in the first quarter of 2020.

TRD’s rankings took a three-year view, tracking both the number of projects the firms are working on and the total cost of the projects. The construction projects did not need to be underway in order to count toward the total, and both firms were given credit for joint ventures. The data is based on San Francisco permits issued between November 15, 2020, and November 15, 2023, and only covers projects within the city limits.

Cahill has been general contractor on 10 permitted projects during that time, according to city records, with a combined value of about $600 million. All of those projects were for apartments, except for a $16 million Buddhist temple with a community center near the Polk Street corridor. Another notable project is in the Bayview, with 118 units of affordable housing accounting for $100 million of that total.

Swinerton Construction took the second-place spot, with 10 projects at a total of about $485 million in costs. Nearly half that total came from one project, a 16-story, 500-unit apartment building in SoMa.

The company recently announced that it would name president David Callis as CEO this month when current CEO Eric Foster retires. Swinerton is even older than Cahill, with more than 130 years of history in San Francisco.

Nibbi Brothers had eight projects permitted for a total of about $450 million. CEO Bob Nibbi is the third generation to run the company along with his brother, Michael, who is the vice president, and his father, Larry, who is chairman of the board.

Bob Nibbi said that affordable housing projects have been keeping his employees busy as the rest of the development pipeline dries up, with market-rate multifamily development “pretty much non-existent.”

With fewer projects to bid on, Nibbi is “aggressively competing” for GC work and as concrete subs on other GC’s projects, he said. But even if labor costs are down slightly, elevated material prices, higher interest rates and lower rents still mean that most projects outside of affordable housing and public sector work don’t pencil for developers, he added.

“Construction is always the last to feel a recession,” he said. “You’ve got work on the books and we’re out there building it, and in the meantime, developers are not getting the next project ready.”

Fourth-place Webcor Construction had three projects in the works according to permitting data, with a total value of nearly $260 million.

Two of the Webcor projects — an $84 million apartment tower on Treasure Island that broke ground in mid-2022 and a $45 million R&D building near Potrero Hill that topped out last year — are joint ventures with other construction firms, according to city records. Webcor’s only solo project, also on Treasure Island, is also its biggest: a 22-story mixed-use building with 250 apartments estimated to cost $130 million.

At 50 years old, Webcor is one of the younger companies on the list. It began on the Peninsula. Oracle’s headquarters in Redwood City, the Academy of Sciences in San Francisco and SFO’s Terminal One are among the most prominent projects in its history, according to the company.

Turner Construction was the only construction firm based outside the Bay Area to make the top five. The company is headquartered in New York City’s Hudson Yards, with a Bay Area office in Oakland.

Its work on a $231.1 million project developed by its New York landlord, Tishman Speyer, called Brannan Square, propelled the company onto the list. Turner built two of the three buildings at the 1 million-square-foot SoMa office and retail development, which centers around a one-acre park and recently began leasing.

SAN FRANCISCO – A federal jury today convicted Harlan Kelly, the former General Manager of the San Francisco Public Utilities Commission (PUC) of charges that he accepted bribes and gifts from a local businessman in a scheme to provide confidential information about the city public bidding process and steer city contracts to that person’s businesses, announced First Assistant United States Attorney Patrick Robbins, Federal Bureau of Investigation Special Agent in Charge Robert K. Tripp, and Internal Revenue Service-Criminal Investigation (IRS-CI) Special Agent in Charge Darren Lian. The verdict follows a two-week trial before United States Chief District Judge Richard Seeborg.

Kelly, 61, of San Francisco, was arrested on a criminal complaint in November 2020, and he was tried on charges contained in a May 31, 2022, superseding indictment that included charges of conspiracy to commit honest services wire fraud and honest services wire fraud. The superseding indictment also included charges of false statements to a bank, conspiracy to make false statements to a bank, bank fraud, and bank fraud conspiracy, related to a scheme to defraud Quicken Loans in connection with a $1.3 million mortgage refinance loan obtained by Kelly.

Kelly was convicted of one count of conspiracy to commit honest services wire fraud, one count of honest services wire fraud, and all four counts related to the bank fraud scheme. The jury found Kelly not guilty of two honest services wire fraud counts.

The charges against, and prosecution of, Kelly grew out of a years-long investigation into bribery and public corruption in San Francisco city government, led by the U.S. Attorney’s Office, the FBI, and IRS-CI. To date, 13 individuals have been charged in connection that larger set of investigations, including Mohammed Nuru, former director of the San Francisco Public Works department, and multiple city contractors and other facilitators of bribes and corruption.

The evidence at trial showed that Kelly, appointed in 2012 as General Manager of the San Francisco PUC, had access to confidential information about city contract bidding processes, and the ability to influence the awarding of some city contracts. Documents and testimony showed that Kelly had a close personal and professional relationship with San Francisco business owner and contractor Walter Wong, and that during the time Wong both conducted business with the city and sought additional lucrative contracts to supply the PUC with LED streetlights. While he was doing business with the city and seeking contracts, Wong provided numerous gifts, benefits, and bribes to Kelly. These bribes including discounted construction work on Kelly’s personal residence and a lavish international trip hosted by and in part paid for by Wong. Evidence showed that Wong paid travel and personal expenses for Kelly and his family during a March 2016 Kelly family vacation to Hong Kong, Macau, and China, and that Wong paid for hotel expenses and incidentals such as meals and luxury excursions. Wong has previously pleaded guilty to charges that he engaged in an honest services fraud conspiracy in connection with his interactions with Kelly and others.

The evidence at trial showed that as part of the bribery conspiracy, Kelly provided confidential information and documents about the details of bids submitted by other contractors, including proprietary pricing and cost information, and information and documents with internal notes about how city employees in the PUC were evaluating and rating the bidders. The evidence showed that Kelly delivered these documents to Wong and his associates in violation of Kelly’s fiduciary obligations to the city and its residents, and that the confidential information assisted Wong and his company in improving Wong’s chances to obtain the contract award.

Trial evidence also showed that Kelly defrauded Quicken Loans, a financial institution, in a $1.3 million dollar real estate mortgage loan provided to Kelly. The evidence at trial showed that Kelly worked with an associate, prominent city businessman and property manager Victor Makras, to mislead the bank. According to the evidence, in the application for the loan Kelly falsely represented that he had a $915,000 mortgage and concealed the true nature of his debts from Quicken. According to the trial evidence, these misrepresentations were material to the bank’s evaluation of the borrower and the loan. The outstanding debts that Kelly concealed from Quicken included a construction debt owed to the contractor, Walter Wong that amounted to about $89,000. Another debt concealed from the company was a $70,000 unsecured personal loan made by Makras to Kelly, a result of Makras directly paying Kelly’s credit card debt in order to conceal the fact that Kelly received this loan from Makras.

TOPEKA, Kan. (AP) – Transgender people born in Kansas could be barred from altering their birth certificates to reflect their gender identity if the conservative Republican prosecutor succeeds in a legal action he launched late Friday.

Attorney General Kris Kobach filed a motion in federal court asking a judge to reverse the requirement in Kansas to allow transgender people to alter their birth certificates.

U.S. District Judge Daniel Crabtree in 2019 imposed a requirement to settle a lawsuit filed by four transgender residents of Kansas against three officials at the state’s Department of Health and Human Services over a policy that critics said prevented transgender people from doing so even after the transition Make changes, legally change their name, and get a new driver Driver’s licenses and social security cards.

It wasn’t clear if Kobach’s efforts would succeed, as a 2020 U.S. Supreme Court ruling declared that a federal law prohibiting sex discrimination in the workplace also prohibits discrimination based on sexual orientation or gender identity. This year, federal judges in Idaho and Ohio overturned rules against transgender people changing their birth certificates, but on Thursday a federal judge in Tennessee dismissed a lawsuit challenging one of the country’s few remaining state measures against such changes.

Kobach’s move appears to be in line with a new, sweeping Kansas law that goes into effect July 1 and rolls back transgender rights. It was enacted by the Republican-controlled Legislature due to the veto of Democratic Gov. Laura Kelly. A memo filed electronically with Kobach’s application just before midnight cited the law as reason for a re-examination of the 2019 settlement.

The memo argued that Crabtree’s order made it “impossible” to follow the new state law and that the state health department, which administers birth certificates, was now “obligated to execute the law as written” since the legislature had “spoken.” .

Kobach had already scheduled a press conference at the Statehouse for Monday afternoon to discuss the enforcement of the new law.

Crabtree’s 2019 order blocked a policy imposed by former Republican Gov. Sam Brownback’s administration that was among the harshest anti-birth certificate changes in the United States. Kelly is a strong supporter of LGBTQ+ rights and her government agreed to settle the lawsuit less than six months after taking office.

That decision came nearly a year after Crabtree said the Kansas policy violated the constitutional right of transgender people to due process and equal treatment before the law. His order notes that federal courts in Idaho and Puerto Rico had rejected the no-change policy. Kobach’s memo called those judgments outdated.

The American Civil Liberties Union of Kansas and the LGBTQ+ rights group Lambda Legal, which represents the four Kansas residents, condemned Kobach’s move. Lamda Legal’s Omar Gonzalez-Pagan called it “unnecessary and cruel”.

Kansas ACLU executive director Micah Kubic added in a statement, “Mr. Kobach should reconsider the wisdom — and the sheer lewdness — of this attempt to weaponize his office’s authority to attack transgender Kansas just trying to get on with their lives.”

Kansas’ new law aims to prevent transgender people from using restrooms, locker rooms and other same-sex facilities related to their identity. At least nine other states have such laws, mostly focused on public schools.

Kobach said he believes Kansas’ new law will also prevent transgender people from changing their driver’s license, although the law does not provide specific enforcement mechanisms. Legislators drafted the bill so they can prevent transgender people from changing their birth certificates, except for the 2019 federal court order, without specifically mentioning birth certificates or driver’s licenses.

For weeks, a project by Kansas Legal Services, a nonprofit law firm, encouraged transgender people from Kansas to change their driver’s licenses before the new law went into effect. Kelly’s administration, which is responsible for licensing drivers, hasn’t said whether it thinks such changes would still be allowed under the new law.

Ellen Bertels, the attorney who led the effort, said that while a transgender person could sue after the law went into effect to protect people’s right to change their driver’s licenses, a lawsuit by a state official against Kelly’s government could be aimed at prevent such changes.

“That’s sort of the obvious place they would end up,” Bertels said.

As for birth certificates, the number of states that don’t allow transgender people to alter birth certificates has decreased due to challenges in federal courts like the one in Kansas. In Oklahoma, Republican Gov. Kevin Stitt is being sued over his 2021 executive order banning such changes.

According to Alex Rate, one of their attorneys, the Montana ACLU plans to challenge a rule enacted there last year that prohibits people from changing the gender on their birth certificates. The state has tightened its rules since GOP Gov. Greg Gianforte took office in 2021.

Previously, since 2017, when Democrat Steve Bullock was governor, Montana allowed transgender people to alter their birth certificates by filling out an affidavit.

Advocates of LGBTQ+ rights say that changing birth certificates, driver’s licenses and other records to reflect a transgender person’s gender identity is key to confirming their identity and often vastly improves their mental health.

Policies against altering birth certificates and other documents also have practical implications for transgender residents. For example, Kansas requires voters to show photo identification when voting or obtaining an absentee ballot.

Critics of the new Kansas law say it aims to legally exclude transgender people.

It explains that state law recognizes only two sexes, male and female, and defines them based on a person’s “biological reproductive system” at birth. A woman is someone whose system is “designed to produce eggs,” while a man is just someone with a system “to fertilize a woman’s eggs.”

The law then states that “important government objectives” to protect people’s health, safety and privacy justify the establishment of gender-segregated spaces consistent with these definitions.

The latest scandal involves 17 officers who sent the inappropriate text messages and other officers who received them – a significant percentage of a department with only about 100 officers.

Bonta said his office has been keeping tabs on the Antioch Police for some time — over concerns including the inappropriate use of force and dogs.

“We have seen data that shows an increase in excessive use of force in the Antioch Police Department more clearly than other local police departments in the vicinity and region,” Bonta said. “We have seen that excessive violence has differential effects on communities of color, including black community members.”

The investigation follows years of complaints by numerous Antioch residents of color about harmful and potentially illegal police practices, and comes amid ongoing investigations by the FBI and the Contra Costa County District Attorney’s Office into alleged misconduct within the department.

But Bonta said the recent SMS scandal has hastened the launch of his office’s investigation.

“These texts are difficult to read. You are racist. You are homophobic. They are misogynistic. And these are not just comments that have nothing to do with official duties. They are directly related to official duties, including the use of force,” Bonta said, noting that he felt an “emotional, visceral, guttural response” as he read it.

“I think almost 20% of the police force is involved in text messaging,” he added. “Almost half of the police are involved in receiving this text message.”

South San Francisco, CA April 17, 2023 Submitted by Peter Fong, SSFUSD PIO

The South San Francisco Unified School District (SSFUSD) could start selling general obligation bonds to investors as early as late April 2023.

That’s according to SSFUSD’s Assistant Superintendent of Business Services, Ted O, who broke the news to the school board during its March 23, 2023 meeting.

O said the district will sell bonds to investors in three separate series over the next few years as part of the “Measure T” bond program:

• $150 million in 2023;

• $150 million in 2026; And

• $136 million in 2029.

“Depending on how quickly the projects are completed and the funds are used up, these years can also be adjusted,” said O.

SSFUSD Facilities Advisor Bill Savidge said the district will focus on the construction priorities outlined in its Facilities Master Plan.

This includes sewer lines, drainage and electrical systems, roofs, windows, lighting, floors and heating, ventilation and air conditioning (HVAC) systems.

Meanwhile, Facility Director Wazi Chowdhury said SSFUSD’s construction requirements have become increasingly complex over time due to years of delayed maintenance.

“Ironically, if you don’t touch a building, you don’t have to upgrade a building to the newer codes,” Chowdhury said, “so we’ve been living with inferior systems, so we have to be very clear and transparent when explaining to people, that we have things to do that might not just show up – they can be underground – they can be behind the walls, but they have to be done.”

Savidge added that the district would need to hire additional staff to oversee the new construction.

“To manage a program of this size. . .We need to increase internal staff as well as hire some consulting teams like program and project management and construction management firms to help us manage these programs.”

Passed by voters in the November 2022 midterm elections, Measure T allows SSFUSD to issue up to $436 million in general commitment bonds to fund repairs and renovations of schools and buildings across the district, improve security systems, and Build affordable housing for district workers.
