Helen Byrne, 94, has called the same San Francisco apartment for more than eight decades, having moved in with her father and sisters when she was 12.

Her Mission District neighborhood looks a lot different these days, but Byrne's apartment is practically a time capsule from a bygone era.

She still sleeps in her childhood room, where she now spends most of her time after a fall last year. She said she wanted to spend the rest of her life here, surrounded by her long-time friends and neighbors.

But Byrne's life was turned upside down when the four-unit building was purchased in 2020 by real estate investors operating through an LLC.

Now she and the building's other decades-long tenants are trying to fend off an eviction attempt they never expected, and they could potentially be evicted from their homes within weeks.

“It was a surprise to me, a shock to me actually, that I had to move away from here,” Byrne said. “Where should I go? I’m so used to this place.”

Byrne outlived the rest of her family and lives alone, but her neighbor Cecilia Matias helps look after her.

“Right now she is strong because of this building,” Matias said. “This apartment alone makes her feel at home.”

Matias has lived in the building herself for 40 years – the first apartment her family moved into after leaving the Philippines. She and Byrne have grown close over the years, almost like a family, they say.

“She was very good to me,” Byrne said. “She’s like a daughter to me.”

Cecilia's sister also lives in the building. This also applies to Anthony Martin, who lives with his wife and son, an Iraq war veteran. Because all of the tenants have lived in the rent-controlled building for decades, their rent is much lower than San Francisco's sky-high market rates.

This is also the reason why their new landlords have been trying to get them out of their apartments since they took over the building more than three years ago.

NBC Bay Area reviewed emails that Daniel Mytels, the manager of the LLC, sent to his lender as part of the eviction case, which outlined plans to clear the building from its inception, either through buyouts or evictions.

In a 2020 email, Mytels called the building “an almost unbelievably good value,” adding that the property is “encumbered with four long-term tenants paying a total of only about $3,800 in total rent per month.” So he outlined plans to lure tenants out and rent out the apartments at higher prices. Or, if necessary, sell the empty building.

By phone, Mytels told NBC Bay Area it was a terrible situation, but said tenants' current rent cannot cover the building's operating costs.

According to letters reviewed by NBC Bay Area, landlords initially offered tenants severance packages — essentially cash for keys — in the range of $70,000 to $85,000 per unit. Even more so when everyone in the building accepted the offer, but every tenant rejected it.

“I want to stay here for the rest of my life,” Byrne said. “I have all my friends and neighbors living here with me.”

Four months after the takeover bid was rejected, tenants were bombarded with notices saying the building's owners were invoking the Ellis Act, a law that allows landlords to evict their tenants if they leave the property for at least five Take years off the rental market. In the notices of termination they were given a notice period of four months plus a legally permissible extension of one year due to the age of the tenants.

“His goal here was speculation, pure speculation,” said Steve Collier, managing attorney for the Tenderloin Housing Clinic, a San Francisco nonprofit that combats the displacement of low-income residents.

In an email, the landlord's attorney, Raymond M. Yetka, said the owners were aware of the difficulties posed by the eviction, adding: “The owner initially attempted to award significant amounts of money to the tenants for the eviction pay. However, when all tenants refused, the landlord’s only option was to terminate the lease under the Ellis Act.”

Collier said the tenants didn't want to give up the fight, in part because Byrne had nowhere else to go.

“[The Ellis Act] is often used by speculators to empty buildings and then sell them at a higher value because the long-term rent control tenants are not in the building,” Collier said.

However, the owners' lawyer defended the move.

“The Ellis Act was created to address unintended consequences of local rent control laws and allow landlords to exit the rental market when rental prices make it impossible to function as a housing provider,” Yetka wrote in an email.

Instead of moving out, however, the tenants turned to the Tenderloin Housing Clinic for help. Their Ellis Act exit window has expired and they are now fighting an eviction lawsuit in court.

“I do not want [Byrne] to go somewhere else,” Matias said. “I told her, 'You think you don't have a family, but you do.' It's me. No matter what happens, I'll take care of you.' Even though we’re not related by blood, I feel like we’re closer.”

Even their neighborhood priest, who has known Byrne and the building's other residents for more than a decade, is there to help them.

“People are not just numbers to be discarded,” Father said. John Jimenez, priest of the Archdiocese of San Francisco. “It is wrong that this is happening. You shouldn’t have to lose the house that you’ve lived in all your life, paid your rent and done all the responsible things.”

When asked about future plans for the building, Yetka said, among other things: “…The most likely outcomes are a sale of the vacant property as a whole or conversion of the units into Tenants-in-Common-Interests (TIC) for sale to owner-occupiers.” “

Collier said the fate of Byrne and her neighbors could be decided in court soon, possibly in the next few days.

“She’s 94,” Matias said. “She has already lived her life. But let her be happy…in peace.

La Golondrina, a long-standing Mexican restaurant on Olvera Street, is engaged in a dispute with the city concerning plumbing problems, deferred rent, and eviction threats resulting from the COVID-19 pandemic. Questions around the restaurant’s future reopening persist, raising concerns among the current owners and the long-standing community who regard it in high esteem, according to LAist.

COVID-19 forced La Golondrina, founded in 1930, to shut its doors in March 2020. The Gomez family, who has deep roots on Olvera Street, took over the restaurant in 2021. Despite significant hindrances to reopening, including a $242,000 overdue rent bill issued by the city commission, the family matriarch Bertha Gomez remains hopeful, as reported to ABC7. Failure to settle the payment within a 30-day schedule threatens their lease agreement.

The restaurant, housed in an old 166-year-old building, is also dealing with complex plumbing complications—an ongoing crisis between the Gomez family and the City of Los Angeles. The question of who is ultimately responsible for the repairs is currently making its way through the legal system, as per ABC7 news. The delay in reopening, due to these unresolved matters, is starting to affect nearby businesses on Olvera Street, which are heavily dependent on the foot traffic the iconic restaurant brings.

After the Board of Commissioners of El Pueblo de Los Angeles Historical Monument’s 30-day eviction notice, David Gomez indicated an intention to legally sue against the city, while also expressing hope for a resolution that would finally permit the reopening of the restaurant. Adjacent business owners, such as Mike Mariscal, assert the closure is not only hurting their businesses but also “silencing the street.”

By Magaly Muñoz

Post Staff

Douglas Stewart has spent the last 15 years making his space at the Oakland Cannery into a home with artwork on every free space of the walls and vinyl records covering the tabletops.

Stewart is a man of many titles, including teacher, activist, advocate and above all, artist. He’s worked in arts preservation, poetry and has helped in juvenile justice centers and prisons to support vulnerable communities dealing with mental health and wellness issues.

The Oakland Cannery is more than a residence for Stewart and its other tenants, it’s also their workspace. However, after 47 years, the residents have been issued a 120-day eviction notice.

Problems at the Cannery began in 2016 when Green Sage, a Colorado-based cannabis cultivation company, acquired the property at 5733 San Leandro St. Their plan was to use this and other similar sites in the area for large-scale cannabis production.

“Unfortunately, however you want to look at it, Green Sage took over as landlords right around the time that the licenses and the Oakland Cannery got deemed as a ‘green zone’. And that’s when they started kicking out the commercial tenants below us and really started activating the space for cannabis operators and operations,” Stewart said.

Stewart and Alistair Monroe, son of the late painter Arthur Monroe who is responsible for the Cannery’s transformation into Oakland’s first live-work residence, claim their homes became unlivable due to the property owners’ neglect.

TrendingUniverSoul Circus Coming to National Harbor

Both told stories of poor plumbing, electrical problems, lack of security and maintenance workers entering their homes unannounced. Despite numerous complaints and maintenance, requests, the property owners failed to address the problems.

“They had a lawless mentality to say that we were not residential use, we were commercial use, and we had to do as they say,” Monroe said.

Stewart supports safe cannabis cultivation and equal market opportunities. He is critical of Green Sage for saturating the market and hindering local business growth in Oakland.

Holding a micro-license for distribution and sales, Stewart benefits from an equity program that aids Oakland residents impacted by the War on Drugs with permits, grants and interest-free loans.

Stewart tried to use the Cannery’s commercial space for his license but was denied by the property owners. His efforts to rent other city spaces also ended in eviction.

“I can’t really afford to find a new place for my business license to hang up after being displaced by my last business operations location and then also having to try to juggle and figure out where I’m gonna be laying my head within the next three months after the Ellis Act eviction,” Stewart said.

Three years into their ownership, Green Sage defaulted on a $55 million loan from a Canadian private commercial mortgage lender, Romspen. The managers of Green Sage have since disappeared.

In September, Ellis Act evictions were served to residents of the Oakland Cannery enabling the landlords to take their properties off the market and remove all tenants.

According to Wikipedia, the Ellis Act is a 1985 California state law that allows landlords to evict residential tenants to “go out of the rental business” in spite of desires by local governments to compel them to continue providing rental housing.

Mark Mersel, an attorney who represents Romspen, states that after Green Sage defaulted on their loan, the mortgage company had to foreclose on the property.

He stated that many, if not all, of the current tenants at the Oakland Cannery had not paid rent or did not have valid leases with the property, and that they are all “basically squatters.”

“All Romspen is trying to do is get this property to operate, not be a blight on the neighborhood, and operate it for its industrial intended purpose,” Mersel said.

Monroe suspects the evictions were retaliation for lawsuits and complaints about unlivable conditions in the building and says he saw this coming from a mile away.

“The first day the landlords were on site they just openly said ‘we’re going to be removing you guys,’” Monroe said.

Eddie Ytuarte from the Oakland Tenants Union asserts that under the Ellis Act, unless the tenants were given relocation payments at the time of the notice, the eviction is invalid.

“A lot of things that landlords refuse to do are actual code violations,” Ytuarte stated. “For instance, if the plumbing is no good, or if the heat is insufficient, it’s breaking city codes and if the tenants are under rent control, they could petition for lower rents or they could sue in small claims court.”

Neither Stewart nor Monroe received relocation payments, only copies of checks via email.

Ytuarte suggested that tenants looking to fight eviction should seek pro-bono legal services or find an attorney who will take on the case for a much lower rate.

Monroe said that they tried those options, but to no avail. In other efforts, he and Stewart have hosted events to bring in city officials, like Mayor Sheng Thao and almost every Oakland City Council member to plead their case and find support from their resources.

A City of Oakland’s public information officer (PIO) wrote in an email to the Post that they have attempted to connect local developers who want to preserve the live-work space to the property owner, but the property owner has not shown any interest.

“The City has been working to protect the Oakland Cannery and other live/work communities from displacement pressure due to cannabis for many years. In 2018, the City adopted legislation prohibiting any type of cannabis business in live/work spaces. Then in 2023 it went further, prohibiting cannabis cultivation on any part of a property that contains work/live spaces,” said the PIO.

“Unfortunately, no local protections can prevent landlords from filing an eviction under the Ellis Act, as that is California State law,” the PIO concluded.

Councilmember Kevin Jenkins, who represents District 6 where The Cannery is located, stated that beyond moral support, there’s not much else that his office can do to help the residents.

“I think displacement has been a big issue in the last 15 to 20 years. We are losing a large share of our African American population from Oakland. A lot of them are being displaced and being forced to move outside of the county and outside the state,” Jenkins said.

Monroe and Stewart stopped paying rent in response to the mistreatment of Green Sage and the COVID-19 pandemic. The eviction moratorium protected tenants from eviction due to unpaid rent during the pandemic.

City ordinance states that in order for a property owner to terminate residency, they have to provide a good or just cause. The Ellis Act is considered a just cause.

Ultimately, it’s not about the buyout price for Monroe or Stewart. They want The Cannery to remain an affordable live-work space for artists.

“It’s more than just having a place to lay my head. It’s a place of advocacy. It’s a place for art to be preserved. For a culture to be preserved and for a community to be lifted,” Stewart said.

About 30 residents of the Oyster Cove Marina in south San Francisco can move to the nearby Oyster Point Marina for a year after the Bay Conservation and Development Commission decided at its Sept. 15 meeting to offer them the temporary fix as a humanitarian measure Place to live while looking for another place to go.

During the meeting, the BCDC made the decision after concerns were raised by liveaboard residents who felt the period was not enough to find permanent residency.

“We can have that [residency at Oyster Point Marina] for a year trying to find other liveaboard moorings, which is very difficult with the understanding that we will do that,” said Matt Klein, a liveaboard operator at Oyster Cove Marina.

The 455-berth Oyster Point Marina is owned by South San Francisco but operated by the San Mateo County Harbor District. 10% of the berths are allocated to residents living on board. The marina has 29 liveaboards and there are plans to add another 11 liveaboards to the additional spots on the waiting list soon. While the proposed fix would exceed 10 percent compliance for Oyster Point Marina, the BCDC said it will not enforce the issue over the next year, according to a staff report for the meeting.

Mark Addiego, a South San Francisco councilor and also a BCDC member, said the goal is to give residents on board enough time to find permanent homes.

“Even though it’s BCDC and their job is to protect the bay,” Addiego said. “Everybody’s like, ‘Hey, this is housing for these people and without that, what’s going to happen to them?'”

At the moment they are trying to accommodate them with their existing boats, he added.

“Many of the live on board boats have expressed that they currently have no place to go and that at other existing marinas the wait list for live on board moorings throughout the Bay Area can be many months long said Anniken Lydon, manager of the Bay Resources program.

There is a concern that the boats living on board would be anchored outside the marinas in the bay because they have no other options. Anchoring is dangerous for the boaters living on board and the environment, she added.

The staff sent a letter of intent to the City of South San Francisco and the San Mateo County Harbor District outlining the staff’s proposed approach that allows the Oyster Point Marina to accommodate the additional liveaboards while exceeding the 10% liveaboard quota.

According to the report, the residential use of the bay is not in compliance with the McAteer-Petris Act or the Public Trust as it is not a “water oriented” use nor is it intended to further the needs of the Public Trust.

The end of a standoff between landlords and tenants at an apartment building near Mission Dolores Park was heralded with a jubilant April 6 press conference announcing that a nonprofit organization had acquired the building — and allowed tenants to remain.

The Mission Economic Development Agency acquired the building at 3661 19th Street for $7.48 million under the city’s Small Sites Program, funded by the Mayor’s Office of Housing and Community Development.

As the Bay Area Reporter reported back in 2021, the 12-unit rent-controlled complex was purchased by two limited companies in August 2018. Shortly after the purchase — despite alleged assurances from a previous owner — the LLCs began seeking evictions from the tenants through the Ellis Act.

The Ellis Act, enacted in 1985 by then-Governor George Deukmejian, is a state law that prevents local authorities from prohibiting evictions if the owner decides to go out of business as a landlord. It was one of the few forms of evictions allowed to continue during the lockdown caused by the COVID-19 pandemic.

According to the mayor’s housing office, MEDA has now bought the building through the city’s small construction program.

“MEDA officially purchased the site on January 27, 2023, ending a no-fault eviction under the Ellis Act that would have ousted longtime BIPOC [Black, Indigenous and people of color]LGBTQ+ and seniors,” explained Anne Stanley, communications manager for the office. The building is now preserved as permanent, affordable housing and will be rehabilitated to address seismic, electrical, plumbing, elevator and roofing improvements.

According to a fact sheet from the Citywide Affordable Housing Loan Committee, the city has committed $9.9 million in permanent financing for the building, including acquisition and rehabilitation. The source of funding is general notes.

Jose Garcia, head of the conservation program at MEDA, said at the press conference: “We are proud to have worked with these residents and the community to make this possible.”

Eric Shaw, a gay black man who is the director of the MOHCD, told the BAR that “central to our office’s mission is investing in programs that support efforts to combat displacement and increase housing stability for all San Franciscos.”

“The takeover of 3661 19th Street ended an innocent Ellis Act eviction that would have evicted longtime San Francisco residents,” he said. “The 12-unit building now remains permanently affordable for current and future tenants.”

Tenant Paul Mooney – who played a key role in organizing his flatmates – celebrated the win.

“I’m happy to announce that we won!” said Mooney. “I moved to San Francisco as a gay man, looking for a community of my own, looking for a place to call home. I love it here: this wonderful, weird, crazy city and neighborhood. I couldn’t imagine living anywhere else as magical as this place.”

Mooney’s persistence was applauded several times during the press conference — from diverting his morning walk so he could check in at MEDA’s offices to buying fake charcoal and having it delivered to the former landlords at their homes in Redwood City, like the BAR did at the time reported .

Mooney said it was proof “that you can beat the Ellis Act.

Steve Collier, a gay man and attorney for the Tenderloin Housing Clinic, said, “It was really a struggle on all fronts.” By pushing the previous landlords both in and out of the courtroom, Collier said the tenants were able to clear them make it make more financial sense for them to take a deal.

“Their whole business plan was to get the tenants out in three months,” Collier said at the news conference. “It’s crazy to think they can get away with it in San Francisco.”

“Not with Steve Collier,” interjected Rafael Mandelman, District 8’s gay supervisor. The building is in his district.

“It’s a great outcome for these tenants, and it’s also great that District 8 will have 12 more sustainable affordable units in a neighborhood that has experienced significant gentrification and displacement,” Mandelman told the BAR. “I am very grateful to the Mayor’s Office, MEDA, the Tenderloin Housing Clinic, community attorneys and the residents themselves for their perseverance.”

Mandelman said at the press conference that Districts 8 and 9 (the Mission) are the epicenter of no-fault evictions in the city.

“These are wonderful communities and the things that make them wonderful to live in make them wonderful for speculators,” the supervisor said.

“There’s a special place in heaven for lawyers in San Francisco, on the frontlines every day,” he added, thanking Collier for his 36-year commitment to fighting evictions.

The building’s current occupants are 60% LGBTQ, 50% Asian American/BIPOC, and half seniors, “a large majority.” [of] People with disabilities,” says a MEDA leaflet.

Larry Kuester, a gay man who has lived in the building for 33 years, the longest of any tenant according to MEDA, is just glad it’s over.

“It was extremely stressful,” he said. “I am very happy. This is the best news we could have received.”

The former owners of the property could not be reached for comment.

“This community has always been a community,” said Barbara Abrams, 74, who has lived in her 10th-floor apartment overlooking the Empire State Building since the 1970s. “People say hello. You hold the door open for each other. It is simply beautiful.”

Now suddenly there was a victim.

Mr. Caballero, 55, started working as a handyman at Co-ops in February 1990 and ten years later he was given an apartment on the understanding that he would be available 24 hours a day for emergency repairs.

The neighborhood had a rougher image back then, and the co-ops came out of financial hardship, and apartments became empty. Myrtle Avenue, the complex’s northern boundary, was known as Murder Avenue.

Mr. Caballero, who has an easy-going demeanor, became a favorite of residents, as did his two children. “He smiles all the time,” Ms. Abrams said. “I never saw him scowl.”

Seven hundred residents signed a petition urging the board to keep Mr. Caballero and his family in place. When local residents demonstrated outside a board meeting in February, carrying signs that read “Worker Justice” and “Hector Stays,” someone called the police. An 88th Precinct official urged the crowd to disperse. “The eviction,” she announced, “is a done deal.”

This only increased the anger in the complex.

“I didn’t think it was radical to say, ‘We want to keep the community the way it is,'” said Helen Yentus, 38, who bought her home three and a half years ago. “As a gentrifier, as a new person, that’s what I moved here for.”

SAN FRANCISCO (CBS SF / BCN) – To give residents facing eviction another chance, San Francisco supervisor Dean Preston expects to enact law during Tuesday’s board meeting that requires landlords to give tenants a 10 day notice before filing an eviction notice.

Prior to the COVID-19 pandemic, landlords wishing to move out a tenant could typically file a three-day eviction lawsuit before the eviction process began.

CONTINUE READING: Amazon Web Services Reports Fatal Outage; Netflix, Venmo, Instacart among many websites affected

However, since the pandemic, California law introduced a new 15-day obligation for landlords to notify renters of eviction for non-payment of rent. The new state law aims to give tenants more time to access funds through rent relief programs.

Preston said his bill would ensure that similar protections remain in place for tenants exposed to an eviction after the pandemic-induced protections expire.

“This bill would create a warning period,” Preston said in a phone interview on Monday. “What we are doing with this legislation is that the protection is permanent, not just during the pandemic. We should give people options instead of driving them away. “

According to Preston, a former tenant lawyer, evictions can make it difficult for renters to find housing in the future and can even affect people’s physical and mental health, putting them at higher risk of displacement or homelessness.

“The broader context here is that California is pretty tough on this rent non-payment issue,” Preston said. “On the fourth day – that’s it. Even if the tenant can raise the money, he can still be evicted from his apartment. “

CONTINUE READING: “Prolific” retail theft suspect in San Francisco back in jail after being arrested

The Housing Rights Committee of San Francisco Executive Director Fred Sherburn-Zimmer said, “Renters have more time to fix problems, which means tenants can stay in their homes.”

“People should have time to resolve disputes before landlords request an eviction,” said Ora Prochovnick, Eviction Defense’s collaborative eviction director of litigation and policy. “This law is a game changer. It will help save thousands of San Franciscans who would otherwise lose their homes. “

If the law were ultimately approved by the city’s board of directors and then enacted by Mayor London Breed, the law would make San Francisco the first city in the state to introduce such an eviction notice.

Back in October, shortly after California’s eviction moratorium imposed during the pandemic expired and hundreds of thousands of renters across the state who were unable to pay their rent were vulnerable to the loss of their homes. In response, Preston declared his district a “no evacuation zone” and encouraged tenants to apply for government rent reduction funds, to seek legal representation and to find out about local evictions, among other things.

Preston’s borough includes neighborhoods such as Hayes Valley, Fillmore, Japantown, Lower Pacific Heights, Western Addition, Cole Valley, and Inner Sunset.

WASHINGTON (AP / CBS SF) – The Centers for Disease Control and Prevention enacted a new eviction moratorium that would last until October 3 as the Biden government tried to quell mounting criticism from progressives that at-risk tenants were while of a pandemic.

The ban announced on Tuesday could help keep millions in their homes as the delta variant of the coronavirus has spread and states are slow to release federal rental subsidies. It would temporarily halt evictions in counties with “significant and high levels” of virus transmission and cover areas home to 90% of the US population.

The announcement was a reversal for the Biden administration, which let an earlier moratorium expire over the weekend after a Supreme Court ruling prevented an extension. This tore open a dramatic split between the White House and progressive Democrats, who insisted that the government do more to prevent some 3.6 million Americans from losing their homes during the COVID-19 crisis.

In a speech at the White House on Tuesday, Biden said he was urging the CDC to reconsider its options. However, he still seemed hesitant about whether the new moratorium could withstand complaints about its constitutionality, and said he had sought expert opinions on whether the Supreme Court would approve the measure.

“Most of the constitutional research says it likely won’t pass constitutional pattern,” Biden said. “But there are some important scientists who think that it is possible and that it is worth the effort.”

The president added that the moratorium – even if challenged in court – will “likely give states and cities a little more time” to free up billions of dollars in federal aid to tenants.

Politically, the extension could help close a rift between liberal democratic lawmakers, who urged the president to take executive action to keep tenants in their homes. The government had spent the past few days reassuring Democrats and the country that they could find a way to limit the damage from possible evictions through the use of federal aid.

However, the pressure increased as key lawmakers said this was not enough.

Leading Democratic leaders joined MP Cori Bush, D-Mo., Who has been camping outside the US Capitol for several days. The new congresswoman once lived in her car as a young mother and referred to the experience to urge the White House to prevent widespread evictions.

When she wiped her eyes in front of a crowd in the Capitol following the CDC announcement, Bush said she shed “happy tears.”

“My God, I don’t think we did that,” she said. “We just did the job just by loving people to keep millions in their homes.”

House spokeswoman Nancy Pelosi (D-CA) said it was a day of “extraordinary relief.”

“The looming fear of eviction and exposure to the streets has been removed for countless families across America. Help is here! ”Pelosi said in a statement.

Government officials had previously stated that a Supreme Court ruling had prevented them from imposing a new moratorium without the support of Congress. When the court upheld the eviction ban by 5 to 4 votes until the end of July, a majority judge, Brett Kavanaugh, wrote that Congress must act to extend it further.

But on Tuesday, the CDC cited the slow pace of state and local governments in paying housing subsidies as a justification for the new moratorium.

Aside from the moratorium, Biden has insisted that federal funds – about $ 47 billion previously approved during the pandemic – must leave the door to help tenants and landlords.

“The money is there,” said Biden.

The White House has said that state and local governments have been slow to pull out federal money and are pushing them to do it quickly.

Treasury Secretary Janet Yellen briefed Democrats in the House of Representatives on Tuesday of work in progress to ensure federal housing aid reaches tenants and landlords. She provided data so lawmakers could see how their districts and states were doing in distributing aid, according to one person who answered the call.

The Treasury Secretary tried to encourage Democrats to work together, despite lawmakers saying Biden should act alone to extend the eviction moratorium, according to someone in the private call who insisted on anonymity to discuss the contents.

According to this person, on the call, Yellen said that she agreed that “we must use all resources” and that she appreciates the efforts of the Democrats and “does not want to leave a stone unturned”.

The CDC imposed the initial eviction ban as part of the COVID-19 response as jobs shifted and many workers lost their incomes. The ban was intended to curb the spread of the virus among people who took to the streets and were taken to emergency shelters, but also penalized landlords who lost income as a result.

National Apartment Association President and CEO Bob Pinnegar said the organization has “always taken the same position – the eviction moratorium is an unfunded government mandate that forces housing providers to provide costly service without compensation and places insurmountable debt on tenants” .

Democratic lawmakers said they were surprised by Biden’s initial decision to end the moratorium, despite the fact that the CDC hinted in late June that it was unlikely to extend the eviction ban beyond the end of July.

MP Maxine Waters, the powerful chair of the financial services committee, has been speaking privately to Yellen for days, urging the finance minister to use her leverage to get states to push the money out the door. However, Waters also urged the CDC to act independently.

Following the CDC’s announcement on Tuesday, Waters released a statement thanking Biden for “listening and encouraging the CDC to act! This extension of the moratorium is the lifeline that millions of families have been waiting for. “

On Monday, Congresswoman Barbara Lee, D-Oakland, joined the Choir of Voices, which has been growing since the eviction moratorium expired, the White House and Centers for Disease Control on Sunday in extending it.

“The pandemic is not over yet,” Lee said in a press release released from her office on Sunday evening. “With the dangerous delta variant becoming widespread, there is still a risk that low-income communities – especially black and brown communities – lose their homes and end up on the streets. Consistent with the executive powers granted during a public health crisis, the White House and CDC should immediately extend the eviction moratorium.

Lee, co-chair of the Majority Leader’s Task Force on Poverty and Opportunity, said her district and California were at the epicenter of the country’s housing crisis. By the time the moratorium expires, an estimated 11 million Americans could be thrown onto the streets as COVID-19 rises again across the country.

“This is more important now than ever as evictions not only leave families without a roof over their heads, but also have the potential to worsen the spread of COVID-19,” she said. “Individual states shouldn’t have to look after themselves. The Biden administration and the CDC can fix this with the stroke of a pen by extending the moratorium.

This latest moratorium will remain in effect until October 3, which may give some tenants more time to apply for emergency funds and assistance.
