<p>A state appeals court upheld $5 million in damages and attorneys’ fees Thursday to a former San Francisco deputy city attorney who was fired after investigating questionable city payments to plumbing companies.</p>
<p>Joanne Hoeper, an 18-year veteran of the office who was then serving as chief trial deputy to City Attorney Dennis Herrera, was removed by Herrera in August 2012 after presenting the findings of her investigation. He transferred her to a temporary position at the district attorney’s office, and then dismissed her from that post in January 2014.</p>
<p>Hoeper had been alerted in December 2011 to a pattern of rising payments by the city to sewer companies for alleged damage to sewer lines by the roots of city-owned trees. She said she determined that the tree roots were not actually harming the sewer lines, that city payments to the companies had soared from $142,000 a year to $4 million in a decade, and that two city attorney staffers had approved dubious payments.</p>

<p>Her report to Herrera said that some <a class="wpil_keyword_link" href="https://dailysanfranciscobaynews.com/bay-spaces-150-yr-outdated-water-pipe-drawback-nbc-bay-space/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a> companies were defrauding the city and that San Francisco was paying inflated prices to replace sewers that did not need replacement. Hoeper said she found no evidence of kickbacks or corrupt practices by city employees, but said one staff member was wrongly accepting claims from the plumbing companies rather than the property owners.</p>
<p>Hoeper was distraught about her removal from the office and said she told Herrera she had turned down a job offer from then-Attorney General Kamala Harris in 2011 after Herrera assured her she had a future in the office.</p>
<p>When she sued over her firing, however, the office denied retaliating against her and said Herrera had decided to replace her years earlier for other reasons,compounded by “her exercise of poor judgment in dealing with the investigation.”</p>
<p>But a Superior Court judge found in March 2017 that the dismissal was retaliatory and had violated Hoeper’s rights under the state Whistleblower Protection Act. She was awarded $2.63 million in damages and $2.4 million to reimburse her attorneys.</p>
<p>In Thursday’s ruling, the First District Court of Appeal in San Francisco said the evidence “amply supports” the jury’s conclusion that Hoeper’s sewer investigation was a factor in her firing. The court also said the dismissal and the surrounding circumstances effectively ended Hoeper’s 30-year legal career, supporting damages for lost income and emotional distress.</p>

<p>On another issue, the court rejected the city’s argument that much of the evidence Hoeper presented should have been excluded because it involved confidential attorney-client interchanges between Herrera’s office and the city.</p>
<p>San Francisco waived any such confidentiality by releasing parts of its report, including its condemnation of Hoeper’s performance, to The Chronicle and another publication, the Westside Observer, Justice Peter Siggins said in the 3-0 ruling.</p>
<p>“This decision supports whistle-blowers who risk their careers to stand up to corruption in government,” said Hoeper’s lawyers, Karl Olson and Therese Cannata.</p>
<p>John Coté, a spokesman for Herrera, said the case was simply an employment dispute, and that no court had made any finding of corruption.</p>
<p>“Sometimes juries get it wrong, and that’s what happened here,” Coté said in a statement. “It’s unfortunate the court did not recognize that the city attorney had ample legitimate reasons for terminating Ms. Hoeper.”</p>

<p>SAN FRANCISCO &#8212; Tearful from the memory of her father, Jane Fonda embraced the John Steinbeck Award that she had just received and thanked a standing audience in San Francisco&#8217;s Herbst Theatre on Wednesday.</p>
<p>&#8220;My father is in this statue,&#8221; said the 85-year-old film legend and political activist. Her father, Henry Fonda, played Depression-era sharecropper Tom Joad in the 1940 film adaptation of Steinbeck&#8217;s &#8220;Grapes of Wrath.&#8221;</p>
<p>The John Steinbeck Award is given by the Martha Heasley Cox Center for Steinbeck Studies at San Jose State University. It honors writers, artists, thinkers, and activists whose work demonstrates empathy, commitment to democratic values, and belief in the dignity of people pushed to the margins of society.</p>

<p>Fonda accepted the award after talking an hour on stage with podcaster Greg Dalton, at an event hosted by The Commonwealth Club&#8217;s Climate One project.</p>
<p>&#8220;We had Steinbeck books all over the house during my childhood and I&#8217;ve read them all,&#8221; Fonda said. &#8220;The Grapes of Wrath is my favorite. The biblical rhythm, the way every chapter starts with this panorama of masses of people moving across the earth like ants because their lives have been destroyed by rich people and by banks.&#8221;</p>
<p>A cancer survivor, Fonda appeared poised and animated as she shared anecdotes about her life in activism. Seeing women as catalysts, she recalled a particular woman leading at an anti-Vietnam War rally in Texas in the 1970s.</p>
<p>&#8220;She didn&#8217;t treat me like a celebrity. She saw me,&#8221; Fonda said. &#8220;I realized there&#8217;s a lot of these people in the world that are totally different than the people that I&#8217;ve grown up with. I wanted to be like them. They were all women. It was a profound, soul-altering experience for me.&#8221;</p>
<p>Fonda has spent the last decades fighting for Indigenous peoples&#8217; rights, economic justice, LGBTQ rights, gender equality and more. She was arrested on the steps of the U.S. Capitol in 2019 protesting the climate emergency as a participant in Fire Drill Fridays, a national movement to protest government inaction on climate change that she started in partnership with Greenpeace USA.</p>
<p>Her latest project is the Jane Fonda Climate PAC, a national effort to elect and support climate champions. She spoke about a proposed referendum supported by the oil companies for the November 2024 ballot to roll back a 2022 California ordinance requiring a 3,200-foot setback separating new oil wells from communities.</p>
<p>In California, 2.7 million people live near oil wells and have a higher risk of asthma, birth defects and cancer, according to the Campaign for a Safe and Healthy California, a group Fonda supports.</p>
<p>&#8220;One of the reasons we haven&#8217;t gotten good legislation for too long in California is because of oily Democrats in the Legislature,&#8221; she said. &#8220;Right now, you can&#8217;t get much done in Congress but, down ballot, your state legislatures, city councils, supervisors, controllers, they have such power.&#8221;</p>
<p>Before departing, Fonda turned to the audience and shouted over the applause, &#8220;Don&#8217;t forget! When I come back and you hear there&#8217;s something going on, come out and join me!<strong>&#8220;</strong></p>

<p>Up until this year, the bathrooms at Mission District dive bar El Rio were to be dreaded, not celebrated (read: very long lines). But in March, the 45-year-old LGBTQ bar unveiled a stylish renovation, complete with three new toilets — and now, they’re getting some recognition. </p>

<p>El Rio is a finalist for the 2023 America’s Best Restroom contest, sponsored by Ohio-based restroom supplies company Cintas, as first spotted by the San Francisco Standard. This is the 22nd year of the contest. In the press release announcing the 10 finalists this year, Cintas praised El Rio’s “two new dazzling restrooms: one ADA accessible and an adjacent two-stall stunner.”</p>
<p>The restrooms were designed by Maryam Rostami and Kate Thorson at TEF Design, funded in part by donors through a GoFundMe campaign. </p>

<p>“Evoking a futuristic Tokyo-bound subway, they feature brightly colored and patterned tile and paint, backlit mirrors — including a full-length version with multiple lighting options — and sleek and modern sinks and fixtures,” said the press release.</p>

<p>“The idea was, if we were going to do it, let’s make them beautiful,” El Rio owner Lynne Angel told SFGATE over email. “Maryam and Kate ensured that happened from plans to completion. The Cintas nomination is icing on the cake. If others like our new bathrooms as much as we do then that’s fantastic. We can’t help it! They look great!”</p>
<p>El Rio’s competitors for the best restroom title include the sleek stalls at the Baltimore/Washington International Airport and an Alice in Wonderland-themed restaurant bathroom in Greenville, South Carolina. Last year’s winner was the spacious, modern restrooms at the Tampa International Airport. The 2023 finalists were released on July 11, and the public has through Aug. 11 to vote for their favorite. </p>

Fortunately, this mission failed spectacularly.<br />&#8220;It was raining and I was dancing the streets of Times Square enjoying every second of it.  &#8220;My aunt had to tell me to slow down,&#8221; he recalls, now a happier New Yorker.  &#8220;What I love most is here, at its peak &#8211; the core from which everything explodes.&#8221;<br />With determination and talent, Donica still hasn&#8217;t faltered, earning his first Tony Award nomination for playing the handsome, gallant knight Sir Lancelot in a beautiful revival of the classic musical Camelot at the Lincoln Center Theatre.<br />&#8220;I&#8217;m just grateful and that just makes me want to do the work even more. <p>A 2016 graduate of Otterbein University, Donica honed his craft in regional theater, playing Jesus in &#8220;Jesus Christ Superstar&#8221; at the Weathervane Playhouse in Ohio and was in the ensemble in &#8220;South Pacific&#8221; at the Utah Shakespeare Festival.<br />He made his Broadway debut in 2016 as Raoul in The Phantom of the Opera, which came full circle.  As a child he had been in the audience at that New York visit and had been fascinated by the Phantom&#8217;s abilities.  &#8220;I thought, &#8216;I have to learn to use my voice the way a man uses his voice.&#8217;  And that&#8217;s what I intend to do.&#8221;<br />Donica has had roles in the television series &#8220;Charmed&#8221; and &#8220;Blue Bloods&#8221;, and has also played the roles of Marquis de Lafayette and Thomas Jefferson in the ensembles of the musical &#8220;Hamilton&#8221; in Los Angeles and San Francisco.  He was the originator of the role of Freddy Eynsford-Hill in the Lincoln Center Theater&#8217;s 2018 revival of My Fair Lady.<br />In the lavish, sweeping &#8220;Camelot,&#8221; he plays a virtuous if selfish knight caught in a love triangle with King Arthur and Guenevere.  The story was updated by Aaron Sorkin to focus on the dream of democracy, but Alan Jay Lerner and Frederick Loewe&#8217;s songs remain.</p>
<p>Tony Award-winning director Bartlett Sher cast Donica in both My Fair Lady and Camelot, roles that required the actor to be passionate and sweet in the first role and a cheeky, sword-catching dude in the second.<br />&#8220;You have a wonderful artist on your hands who is able to dive into a role and into a world and deliver very different things in each case,&#8221; says Sher.  &#8220;There&#8217;s that kind of connection in his body, that connection to his voice, deep intelligence and endless creativity that makes him so special.&#8221;<br />Donica in &#8220;Camelot&#8221; first appears almost like a righteous angel on stage &#8211; she sings &#8220;C&#8217;est Moi&#8221; with the lyrics &#8220;Here I stand as pure as a prayer/Incredably clean with virtue to spare&#8221; &#8211; but ends the musical very human.  what he describes as a sobering yet entertaining journey.<br />“For me, Camelot is America.  And we must fight every day to tell the stories of what freedom is and what America is.  Because if we don&#8217;t talk about it and put it into action, it doesn&#8217;t really exist,&#8221; he says.<br />The role is vocally and physically demanding.  He had previously gained 15 pounds and expected to sweat much of it off.  He recently visited his physiotherapist, who immediately knew that Donica had lost weight because the settings on the table no longer suited him.<br />Born in Minnesota, Donica spent his first birthday in Chicago, then moved to Tennessee for eight years and then on to Indiana.  He looked at kidz bop and TV commercials with children singing &#8211; Oscar Mayer hot dogs and Welch&#8217;s juice commercials &#8211; and wondered if that was a way.<br />&#8220;I remember as a little kid I saw the kids in those commercials and I turned to my mom and said, &#8216;I could do that.&#8217;  Why don&#8217;t I?&#8217;” he says.  &#8220;I don&#8217;t think she really thought, I&#8217;m that serious.  But I think I meant it very seriously.”<br />He joined a community theater in Indianapolis and attended theater camp where there was once a team building trust activity and Donica was the only one willing to commit and fall back into a stranger&#8217;s arms.<br />&#8220;I remember the teacher saying, &#8216;You will get good results here because you trust,'&#8221; he recalls.  “The theater world is a safe place.  I was taught to trust, which means you will get into a dangerous situation.”<br />The trip to New York was a test for a boy who loved open fields and disliked crowds.  His mother didn&#8217;t want to dissuade him, just to make sure he really wanted it.  Now she has been invited to see him at the Tony Awards.<br />On June 11, he will compete against Shucked&#8217;s Kevin Cahoon and Alex Newell, Kimberly Akimbo&#8217;s Justin Cooley and Some Like It Hot&#8217;s Kevin Del Aguila for best performance by an actor in a leading role in a musical.  ”</p>
<p>Donica, who used to watch old Tony ceremonies on YouTube, still can&#8217;t imagine him being there.  &#8220;I don&#8217;t think I really believe it anymore because I never really set out to win a Tony Award or anything like that.  As a kid, all I dreamed of was performing with the Tonys.”</p>

<p>In the lavish, sweeping &#8220;Camelot,&#8221; he plays a virtuous if selfish knight caught in a love triangle with King Arthur and Guenevere.  The story was updated by Aaron Sorkin to focus on the dream of democracy, but Alan Jay Lerner and Frederick Loewe&#8217;s songs remain.</p>
<p>Tony Award-winning director Bartlett Sher cast Donica in both My Fair Lady and Camelot, roles that required the actor to be passionate and sweet in the first role and a cheeky, sword-catching dude in the second.</p>
<p>&#8220;You have a wonderful artist on your hands who is able to dive into a role and into a world and deliver very different things in each case,&#8221; says Sher.  &#8220;There&#8217;s that kind of connection in his body, that connection to his voice, deep intelligence and endless creativity that makes him so special.&#8221;</p>
<p>Donica in &#8220;Camelot&#8221; first appears almost like a righteous angel on stage &#8211; she sings &#8220;C&#8217;est Moi&#8221; with the lyrics &#8220;Here I stand as pure as a prayer/Incredably clean with virtue to spare&#8221; &#8211; but ends the musical very human.  what he describes as a sobering yet entertaining journey.</p>
<p>“For me, Camelot is America.  And we must fight every day to tell the stories of what freedom is and what America is.  Because if we don&#8217;t talk about it and put it into action, it doesn&#8217;t really exist,&#8221; he says.</p>
<p>The role is vocally and physically demanding.  He had previously gained 15 pounds and expected to sweat much of it off.  He recently visited his physiotherapist, who immediately knew that Donica had lost weight because the settings on the table no longer suited him.</p>
<p>Born in Minnesota, Donica spent his first birthday in Chicago, then moved to Tennessee for eight years and then on to Indiana.  He looked at kidz bop and TV commercials with children singing &#8211; Oscar Mayer hot dogs and Welch&#8217;s juice commercials &#8211; and wondered if that was a way.</p>
<p>&#8220;I remember as a little kid I saw the kids in those commercials and I turned to my mom and said, &#8216;I could do that.&#8217;  Why don&#8217;t I?&#8217;” he says.  &#8220;I don&#8217;t think she really thought, I&#8217;m that serious.  But I think I meant it very seriously.”</p>
<p>He joined a community theater in Indianapolis and attended theater camp where there was once a team building trust activity and Donica was the only one willing to commit and fall back into a stranger&#8217;s arms.</p>
<p>&#8220;I remember the teacher saying, &#8216;You will get good results here because you trust,'&#8221; he recalls.  “The theater world is a safe place.  I was taught to trust, which means you will get into a dangerous situation.”</p>
<p>The trip to New York was a test for a boy who loved open fields and disliked crowds.  His mother didn&#8217;t want to dissuade him, just to make sure he really wanted it.  Now she has been invited to see him at the Tony Awards.</p>
<p>On June 11, he will compete against Shucked&#8217;s Kevin Cahoon and Alex Newell, Kimberly Akimbo&#8217;s Justin Cooley and Some Like It Hot&#8217;s Kevin Del Aguila for best performance by an actor in a leading role in a musical.  ”</p>
<p>Donica, who used to watch old Tony ceremonies on YouTube, still can&#8217;t imagine him being there.  &#8220;I don&#8217;t think I really believe it anymore because I never really set out to win a Tony Award or anything like that.  As a kid, all I dreamed of was performing with the Tonys.”</p>

<p>Bob Metcalfe is a 21st-century Renaissance man—although he denies he ever considered himself a &#8220;medieval man.&#8221;  Bob was an inventor, electrical engineer, publisher, expert, venture investor, professor, innovator and now a geothermal engineer.  As Bob observes, on the verge of reaching the teenage age of 77 in just a few weeks, &#8220;I&#8217;m starting my seventh career!&#8221; Metcalfe is also now the recipient of the prestigious 2022 Turing Award, presented to him on June 10 in San Francisco is awarded.  Earning the Turing is tantamount to being anointed as a Rock Star of Tech.</p>
<p>I first met Bob two decades ago at the Nantucket Conference, an industry gathering of business and technology founders and venture investors on the &#8220;island far away&#8221; of Nantucket, MA.  Bob&#8217;s role at the Nantucket Conference was that of resident expert and wise man and final best of class for nearly a decade.  As he describes it, “My job was to sit through each session for two days and then summarize the takeaways and key takeaways.  Not everyone liked my conclusions.”</p>
<p>Bob has never been immune to strong public positions and provocative statements.  In a famous 1996 incident, Metcalfe falsely predicted the collapse of the Internet and agreed to &#8220;eat his words&#8221; on a public stage.  As Reuters reported at the time, &#8220;The networking pioneer-turned-computer-industry columnist who last year predicted the collapse of the internet Thursday kept his promise by literally eating his words,&#8221; noting that Metcalfe filled the offending column with liquid in a blender before pouring it into a bowl and &#8220;slurping down the contents of the bowl to the cheers of the crowd&#8221;.  Metcalfe remarked wryly, “I was wrong.  I ate the pillar.  I&#8217;m sorry.  I&#8217;m not worth it&#8221;. Always the graceful showman.</p>
<p>Over the decades, Metcalfe has built a legendary reputation in the world of innovation &#8211; from Boston to Silicon Valley to Austin (TX) and back.  He is now returning to his roots at Massachusetts Institute of Technology (MIT), where he received his BS in Electrical Engineering in 1969 and his PhD in Applied Mathematics and Computer Science in 1973, in addition to an MS in Applied Mathematics from Harvard Business School.  Metcalfe will return to his alma mater at MIT as a Research Affiliate in Computational Engineering at the Computer Science and Artificial Intelligence Laboratory, commonly known as CSAIL.</p>
<p>Metcalfe will forever be remembered as the inventor of Ethernet (he is nicknamed &#8220;Ether Dad&#8221;), which he introduced in a May 22, 1973 memo while working at the Xerox Research (PARC) computer science lab in Silicon Valley.  He refers to Ethernet as an &#8220;installation for the Internet&#8221;, whereby PCs were initially connected via a local area network (LAN).  Metcalfe founded 3Com (short for &#8220;Computer Communication Capability&#8221;), an industry pioneer in computer networking, where he served as founder, chairman, CEO, investor and &#8220;cheerleader&#8221;.  The company was acquired by Hewlett-Packard in 2009 for $2.7 billion in cash.  During this time, Metcalfe also became known for Metcalfe&#8217;s Law, which states that the value of a telecommunications network is proportional to the square of the number of users connected to the system, a fundamental premise behind the Internet.</p>
<p>After retiring from 3Com, Metcalfe moved on to his next career &#8211; as CEO/Editor of International Data Group&#8217;s (IDG) highly regarded InfoWorld Magazine, followed by a stint as a Limited and General Partner at Polaris Ventures, where he was a Partner Emeritus remains – previously in 2011 he relocated to Austin, TX to serve as Professor of Innovation and Entrepreneurship at the Cockrell School of Engineering and the McCombs School of Management at the University of Texas, where he remains Professor Emeritus of Electrical and Computational Engineering is.</p>
<p>Returning to work at MIT CSAIL brings Metcalfe closer to his summer home in Owls Head, Maine in the Camden, Maine area.  There, Bob navigates the waters of Penobscot Bay in his fleet of small boats.  In 1996, Bob, along with former Apple Computer CEO John Scully, launched the Pop Tech conference in Camden.  The conference, which celebrated its 25th anniversary in 2021, describes itself as a &#8220;global network dedicated to the vanguard of emerging technologies, science and creative expression&#8221;.  Bob will continue to split his time between Maine, Austin and Cambridge (MA).</p>
<p>Long considered the Nobel Prize in computer science, the Turing Award was first presented in 1966 by the Association for Computing Machinery (ACM).  The awards were created in honor of Alan Turing, the British mathematician credited with founding the foundation of theoretical computing and artificial intelligence, whose tragic life was portrayed in the 2014 film The Imitation Game, which received a nomination for Best Picture and Best Picture received Actor nomination for Benjamin Cumberbatch&#8217;s moving performance at the 87th Academy Awards.</p>
<p>The Turing is awarded annually to individuals who have made a lasting contribution or great technical importance to the field of computer science.  Widely regarded as the highest recognition in computing, the award is accompanied by a $1 million prize funded by Google.  Metcalfe admits to being honored to receive the award, commenting, &#8220;Turing recipients include the greatest pioneers in the advancement of computer science, from Marvin Minsky to Tim Berners-Lee.  I am grateful to be counted among these giants.”</p>
<p>Metcalfe looks forward to continuing its efforts in educating the next generation of innovation leaders.  He welcomes the advancement of what he sees as a collaborative innovation ecosystem stretching from Silicon Valley in the west to Austin in the southwest and Boston in the northeast. <p>AHP grants are awarded annually to FHLBank San Francisco members working in partnership with affordable housing developers and community organizations.  Tri Counties Bank successfully nominated three organizations to be considered for the grants: Collier Avenue (Nice, Calif.), Piper Way Senior Housing (Redding, Calif.), and Siskiyou Crossroads (Yreka, Calif.).
</p>
<p>AHP awards are highly competitive, ranked based on an extensive scoring process and granted to the highest-ranking projects.  Basic eligibility requirements include projects demonstrating a need for subsidy and both developmental and operational feasibility.  Further, rental housing projects must reserve at least 20% of units for households at or below 50% of the HUD area median income (AMI) while owner-occupied housing projects must serve households at or below 80% AMI.
</p>
